HomeMy WebLinkAboutOrdinance 17017-06-2006ORDINANCE NO. 17017-06-2006 AN ORDINANCE ADJUSTING TI-IE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT; ADDING ONE CAPTAIN POSITION; PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL, BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief previously requested the City Council to readjust and thereafter specify the total number of authorized civil service positions at the police officer rank in the Police Department into conformity wiih the proposed changes as set forth immediately below in order to effect efficient economy of the operations of tha Police Department; and WHEREAS, on September 13, 2005, the City Council approved the most recent ordinance concerning the authorized and budgeted positions for the Police Department. In that Ordinance, the Council adjusted the Police Department's civil service staffing, effective October 1St, 2005, as follows: Deputy Chief 5 Captain 12 Lieutenant 4G Sergeant 132 Corporal/Detective 182 POIICe Officer 972 'T'otal 1,349 WHEREAS, since the adoption of said ordinance, the City Council autharized the City Manager to request amid-year appropriation in the amount of $25,051 to fund one additional captain; and WHEREAS, pursuant to Chapter 143.021 (a), Texas Local Government Code, the City Council may prescribe the authorized number of positions in each classification (rank) and the correct number of budgeted civil service positions by ordinance; NOW, THEREFORE, BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective upon the formal adnptinn of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department fox the remainder of the fiscal year 2005-200G or until modified by subsequent ordinance: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 132 CorpoxaUDetective 182 Polic e Off cer 972 e Tat`c~~ ~ y~~Q SECTION 2. The "Mayor and Council Communication" merr~oxandu~n, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the Council in their adoption as well as tlae Department's izzapleznentation of this ordinance. SECTION 3. This ordinance shall be cumulative of all provisions ofprevious ordinances and of the Code of the City of Fort Worth, Texas (l98&), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Cade, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality sha11 not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is sa ordained. DISCUSSION: On May 23, 2406, (M&C G-15217) the City Councii approved the parkial-year funding of one Police captain position. In order to keep pace with the growth in the City and needs of different neighborhoods, the Police Department must modify how resources are deployed. The department intends to implement a fifth division in fiscal Year 2007. In order to facilitate the implementation of a fifth division, an additional captain position was approved and funded by the Crime Controi and Prevention District for the time period from July 1 through September 30, 2006. This captain will coordinate the planning, conduct resource management activities, identify potential issues and ultimately implement the new division. Permanent funding has been requested in the FY2006-2007 Genera! Fund budget. The Police Department`s authorized strength is 1,349. Upon approval of this recommendation, the assignment of civic service positions authorized for the Police Department will resuit in the addition of one captain position.
