HomeMy WebLinkAboutOrdinance 25298-01-2022 ORDINANCE NO.25298-01-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, (1) BY $245,000.00 SUBJECT TO AWARD AND RECEIPT OF THE GRANT FUNDS,AND (2)BY $61,250.00,AS A TRANSFER FROM THE JUSTICE ASSET FORFEITURE FUND TO SATISFY THE CITY'S MATCH REQUIREMENT, FOR A TOTAL OF $306,250.00,FOR THE PURPOSE OF FUNDING THE TEXAS DEPARTMENT OF TRANSPORTATION FY2023 SELECTIVE TRAFFIC ENFORCEMENT PROGRAM GRANT PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, (1) by $245,000.00 subject to the award and receipt of grant funds, and (2) by $61,250.00,as a transfer from the Justice Asset Forfeiture Fund to satisfy the City's match requirement,for a total of$306,250.00, for the purpose of funding the Texas Department of Transportation FY2023 Selective Traffic Enforcement Program grant. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Ratify application for,and authorize acceptance of,if awarded,the Fiscal Year 2023 Commercial Motor Vehicle Grant from the Texas Department of Transportation in an amount of$91,250.00; 2. Authorize the execution of a grant agreement with Texas Department of Transportation for the Fiscal Year 2023 grant; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Justice Asset Forfeiture Fund in the amount of$18,250.00,from use of fund balance,for the purpose of transferring to the Grants Operating Federal Fund as the City's match requirement;and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund (1) by $73,000.00 subject to award and receipt of grant funds,and (2) by$18,250.00,as a transfer from the Justice Asset Forfeiture Fund to satisfy the City's match requirement,for a total of$91,250.00,for the purpose of funding the Texas Department of Transportation Fiscal Year 2023 Commercial Motor Vehicle grant. DISCUSSION: The Texas Department of Transportation Commercial Motor Vehicle(CMV)grants are aimed at reducing the number of commercial motor vehicle crashes,injuries, and fatalities.The CMV grant will pay for the overtime hours of the police officers participating in the program.A local match of at least 20%is required. CMV grant activities include enforcement of speed,seatbelt,driving under the influence,and intersection traffic control laws.The total proposed direct program amount for Fiscal Year 2023 is$91,250.00,which includes$18,250.00 in match funds.Funds will be budgeted for overtime and associated fringe benefits for an estimated 1,000 enforcement hours with an additional estimate of 45 hours for administering the grant.The grant will also fund overtime,along with associated fringe benefits,to provide public information and education events. Award of this grant and receipt of funds would not occur until Fiscal Year 2023.As for the City's required match,the Department has historically used the Justice Asset Forfeiture Fund to satisfy that requirement. Because sufficient balance exists in Fiscal Year 2022 in the Justice Asset Forfeiture Fund,staff recommends that$18,250.00 be appropriated and transferred from the Fund to the Grants Operating Federal Fund. Because the Grant Fund is a life of project fund,the appropriated match will be carried over into the next fiscal year. A portion of the award funds will be used to cover indirect costs at the Police Department's approved rate(currently 3.81%). A Form 1295 is not required because: This contract will be with a governmental entity,state agency or public institution of higher education:TxDOT FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current operating budget,as appropriated, in the Grants Operating Federal Fund and the Justice Asset Forfeiture Fund.The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City.Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds.This is a reimbursement grant.
