SECOND RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY CONTRACT NO.
53746,A NON-EXCLUSIVE MOWING AND GROUNDS MAINTENANCE SERVICES
AGREEMENT FOR NORTHEAST RIGHT-OF-WAYS BETWEEN THE CITY OF FORT
WORTH AND LAWN PATROL SERVICE,INC.
This SECOND RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY
CONTRACT NUMBER 53746 ("Second Renewal and First Amendment") is made and entered into by
and between the CITY OF FORT WORTH ("City"), a home-rule municipal corporation of the State of
Texas, acting by and through its duly authorized Assistant City Manager, and LAWN PATROL
SERVICE, INC. ("Contractor"), a Texas corporation, acting by and through its duly authorized
representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement, the same being Fort Worth City Secretary Contract Number 53746
("Agreement");
WHEREAS, the primary term of the Agreement expires on November 30, 2020 and includes
four(4)one-year renewal options;
WHEREAS, the City and Contractor exercised the First Renewal Option, which expires on
November 30,2021 the same being CSC No. 53746-R1;
WHEREAS,the parties desire to exercise the second one-year renewal term, effective beginning
on December 1,2021 and ending on November 30,2022;
WHEREAS, the Agreement provides for on-call mowing services on either an individual or
recurring basis at pricing equivalent to comparable;
WHEREAS, the Contractor desires to provide certain on-call mowing services for the City in
accordance with the terms of the Agreement and this Second Renewal and First Amendment as shown in
Exhibit B-1;
WHEREAS, Contractor requested a unit price increase of 3.0% for work that it performs at
certain locations throughout the City; and
NOW,THEREFORE,the City and Contractor agree to renew and amend the Agreement for one
additional year as follows:
I.
The City and Contractor agree to renew and amend the Agreement for the second renewal term of
one year,effective beginning on December 1,2021 and ending on November 30,2022.
II.
All unit prices in Exhibit B of the Agreement,including any previous On-Call amendments if applicable,
pertaining to grounds maintenance are hereby amended to increase the pricing by 3.0%for all locations
set forth in ITB/RFP No. 20-0056.

III.
1. All other terms and conditions of the Agreement shall remain in full force and effect
except as specifically set forth in this Second Renewal and First Amendment.
2. All terms of this Second Renewal and First Amendment that are capitalized but not
defined shall have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF,the City and Contractor have executed this Second Renewal
and First Amendment to be effective on December 1st,2021.
