HomeMy WebLinkAboutContract 51042-A1R1 CITY SECRETARY CONTRACT NO. 51042-A1 Rl AMENDMENT 1 AND RENEWAL 1 TO CITY SECRETARY CONTRACT NO. 51042 STANDBY AGREEMENT Tetra Tech Inc. This Renewal is executed by and between the City of Fort Worth (hereafter "City"), a home rule municipal corporation situated in portions of Tarrant,Denton and Wise Counties,Texas, with its principal place of business at 200 Texas Street, Fort Worth, Texas, and Tetra Tech Inc. (hereafter "Contractor"), a Delaware Company authorized to do business in the State of Texas, located at 2301 Lucien Way, Suite 120, Maitland, Florida. City and Contractor are each individually referred to herein as a"Party" and collectively as the "Parties." WHEREAS, the parties have previously entered into City of Fort Worth City Secretary Contract No. 51042 (the "Contract"); and WHEREAS,the Contract was executed for Contractor to provide the City debris monitors and debris monitoring services to assist the City in monitoring the operations of the disaster debris removal, hauling and disposal contractor(s) on an as-needed basis; and WHEREAS, the original term of the Contract will expire on February 20, 2022; and WHEREAS, the Contract allows for renewals so long as the Parties agree to renew the Contract at the sole discretion of the City; and WHEREAS, the Contractor has requested a price adjustment to account for increases in wages since the Contract was let; and WHEREAS,the City has reviewed the request and determined that the requested increases are reasonable and allowed under state and local law; and WHEREAS, the parties wish to amend the agreement to increase the contracted prices; and OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX WHEREAS, the City and Contractor also desire to renew the term of the Contract for continued services pursuant to the original Contract for an additional year, specifically from February 21, 2022,to February 20, 2023. NOW, THEREFORE, City and Contractor acting herein by the through their duly authorized representatives, enter into the following agreement to renew the contract: 1. Amendment Exhibit B. Fee Schedule in the Contract is hereby amended and replaced in its entirety with the attached Exhibit B FEE Scheduled. 2. Renewal The term of the Contract is hereby renewed for an additional year and will expire February 20, 2023, unless terminated earlier in accordance with the Contract. 3. Other Terms All other terms of the Contract not amended or changed herein shall remain unchanged and enforceable against the Parties. 4. Electronic Signatures The Parties may sign this Amendment using electronic signatures, including .tif, .jpeg, Adobe signature, or other similar electronic means or formats, and such electronic signature shall be treated as an original for all purposes. WORTH, TX Page 3 of 4 EXHIBIT B FEE SCHEDULE The fee for the services under this Agreement will be based on the actual hours of services furnished multiplied by Contractor's hourly rates as set forth below. The hourly rates are inclusive of all applicable overhead, profit, and travel expenses. Overtime hours will be paid at the same rate as regular time hours. Special costs such as boat rental and marine expenses may be billed to the City at cost without mark-up. FEMA Coordinator-A FEMA coordinator will assist in providing examples of historical precedent and work with FEMA on disaster- specific guidance. They will help the City with FEMA policy interpretations, institute corrective processes and procedures to address project deficiencies, and provide consultation to the City and project manager. Administrative Assistant- Locally hired administrative assistants are responsible for proper time-keeping for all project employees,which includes time sheets and monitor log management. They also aid in project scheduling, assist home owners with inquiries regarding the private property debris removal program, and facilitate the homeowner application process. CFW/Tetra Tech Inc.
