HomeMy WebLinkAboutContract 51288-A2 CSC No.51288-A2 AMENDMENT No.2 TO CITY SECRETARY CONTRACT No. 51288 WHEREAS, the City of Fort Worth (CITY) and AECOM Technical Services, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 51288, (the CONTRACT) which was authorized by M&C C-28764 on the 26th day of June, 2018 in the amount of $306, 375 . 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $0 . 00 which revised Attachment B but did not change the overall contract amount and which was administratively authorized on February 4, 2021; and WHEREAS, the CONTRACT involves engineering services for the following project : CROWLEY/N. CROWLEY & CLEBURNE INTERSECTION IMPROVEMENTS, CPN 101578; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT : 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $227, 673. 00. (See Attached Funding Breakdown Sheet, Page -4-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $534, 048. 00. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect . Crowley/Cleburne Road & Crowley Road Task Orders 2 & 3-Preliminary and Final Design, Bid and Construction Phase Services City Secretary Contract No.51288 CPN 101578 Dear Ms. Acevedo, We appreciate the opportunity to present this proposal for additional preliminary and final design services for the 2018 Bond Intersection Project- N. Crowley/Cleburne Road & Crowley Road. The work effort outlined in Attachment A will be accomplished on an hourly basis for a not-to- exceed fee of$227,673.00 The City project number is 101578. As you are aware the project scope has expanded well beyond the original scope of the simply adding a right turn lane to the eastbound approach. Through evaluation of traffic counts it was determined the left turn movements from the eastbound approach are the largest movements and are the most significant cause of congestion for the eastbound approach. Therefore, several intersection improvement alternatives were developed and discussed with City and Texas Department of Transportation staff. A reallocation of design fees from Task 2 to Task 1 was approved to expand the area of Subsurface Utility Engineering and topographic survey efforts to develop the intersection improvement alternatives for dual left turn and a southbound free right turn. It was decided to improve the intersection capacity and function by providing dual left turn lanes on the eastbound approach, provide storage length for the eastbound right turn movements and accommodate large truck vehicle right turn movements for the westbound and southbound approaches utilizing the existing shoulder of southbound Crowley Road (FM 731). After the above-described intersection alternatives were developed and an appropriate alternative selected, the AECOM design team began work on the 60% submittal package and was within a couple of weeks making that submittal. At that time Crowley Independent School District (CISD) informed the City of their intention to add a westbound approach to the intersection to accommodate traffic from the proposed CISD stadium and administration building east of Crowley Road. To assist with determining the ultimate intersection configuration that included a westbound approach, the City requested the AECOM design team develop additional intersection configuration exhibits with opinions of probable construction cost. Several coordination meetings with the City, CISD and TxDOT have occurred to evaluate intersection configuration alternatives and select the final intersection configuration. It has been decided the final intersection configuration shall be as shown in the attached Exhibit 1. The initiation of construction of the City's intersection improvement project will not occur until after August 2022. Therefore, a temporary westbound connection Crowley/N.Crowley&Cleburne Intersection Improvements CPN 101578 CSCN 51288 including temporary signals will be constructed by CISD so the connection will be in place on or before August 2022 when the proposed CISD stadium is to open for activities. The selected intersection configuration requires several additions to the existing scope of services as identified below. • Additional topographic survey is needed for the parking area of the property at the northwest corner of the intersection. • Additional topographic survey is needed for the temporary westbound connection once it has been constructed to determine demolition quantities and physical improvements/modifications on the east side of the intersection to be included in the City's intersection improvement project. • Additional topographic survey is needed for the area of the proposed final westbound connection. • There are associated impacts to existing utilities, drainage and striping along N. Crowley- Cleburne Road and Crowley Road for the proposed eastbound to southbound right turn lane, proposed southbound acceleration lane, proposed southbound to westbound right turn lane and proposed southbound deceleration lane. • The addition of the westbound approach creates the need for an additional traffic signal as well as modifications to address changes created by the temporary signals installed by CISD for the temporary westbound connection. • The eastbound to southbound and southbound to westbound right turn lanes necessitate the acquisition of rights-of-way and probable temporary construction easements. • Due to Crowley Road (FM 731) being a TxDOT on-system roadway and Local On-System Agreement requirements, additional services to meet TxDOT environmental requirements will be required. The environmental services will necessitate additional management and design efforts as well. We have developed this amendment to address the changes in scope and to account for the previous fee reallocation. To facilitate continued progress of the project and in good faith,the AECOM team is moving forward with design of the modified scope of work up to the limit of the existing fees for Task Order 2 while this amendment is prepared, submitted and approved for the additional services. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. ENGINEER shall use its reasonable efforts within the limits of time and funds available hereunder to perform the following services. OBJECTIVE The objective of the Crowley Road & N. Crowley Road/Cleburne Road Intersection Project is to improve capacity of intersection by adding a second left turn lane and adding a right turn lane on the N. Crowley Road/Cleburne Road EB approach of Crowley Road, expanding the WB lane of N. Crowley Road/Cleburne Road from Crowley Road westward to accommodate large truck turning movements and include a WB approach to the intersection to accommodate the Crowley Independent School District Sports Complex. These services may be provided as additional services if required and approved by the City. TASK 10. QUALITY CONTROL/ QUALITY ASSURANCE ENGINEER to provide to the City a Quality Control/ Quality Assurance Plan (QC/QA Plan) outlining the ENGINEER's method of ensuring the highest levels of design and accuracy are incorporated into the calculations, plans, specifications, and estimates. ENGINEER is responsible for and shall coordinate all subconsultant activity to include quality and consistency of plans. If, at any time, during the course of reviewing a submittal of any item it becomes apparent to the CITY that the submittal contains errors, omissions, and inconsistencies, the CITY may cease its review and return the submittal to the ENGINEER immediately for appropriate action. A submittal returned to the ENGINEER for this reason may be rejected by the CITY Project Manager. 10.1. QC/QA of Survey and SUE Data • The ENGINEER's Surveyor shall perform Quality Control/ Quality Assurance on all procedures, field surveys, data, and products prior to delivery to the CITY. The CITY may also require the ENGINEER's Surveyor to perform a Quality Assurance review of the survey and/or subsurface utility engineering (SUE) work performed by other surveyors and SUE providers. • ENGINEER's Surveyor shall certify in writing via a letter that the survey information provided has undergone a Quality Control/ Quality Assurance process. • ENGINEER's Subsurface Utility Engineering provider shall certify in writing via a letter that the SUE information provided has undergone a Quality Control/Quality Assurance process. 10.2. QC/QA of Design Documentation • ENGINEER shall perform a QC/QA review of all documents being submitted for review at all stages of the design including the 30%, 60%, and 90% and Final Document design review submittals. QA should be performed by an individual within the firm who is not on the design team. • ENGINEER is to acknowledge that each item on the Detailed Checklist has been included by checking "done" on the checklist. If a particular checklist item is not applicable, this should be indicated by checking "N/A". If an entire checklist is not applicable, this should be indicated by checking every item on the list as "N/A" and still included with the submittal. Mark-ups may also be documented using the Comment Resolution Log. • Evidence of the QC/QA review will be required to accompany all submittals. Documentation shall include, but is not limited to, the following items: - PDF of the completed Detailed Checklists - PDF of the QC/QA check print of the calculations, plans, specifications, and estimates demonstrating that a review has been undertaken; - PDF of previous review comments (if any) and the ENGINERR's responses to those comments in the Comment Resolution Log. • If any of the above information is missing, is incomplete or if any comments are not adequately addressed; the CITY may contact the ENGINEER and request the missing information. If the ENGINEER does not respond to the request within 24 hours, the CITY shall reject the submittal. No additional time will be granted for a returned submittal. • If the ENGINEER has not adequately addressed the comments, the submittal shall be rejected and returned to the ENGINEER immediately to address the issues. Non-Labor Expenses. Non-labor expenses shall be reimbursed as Direct Expenses at invoice or internal office cost. Direct Expenses (non-labor) include, but are not limited to, mileage, travel and lodging expenses, mail, supplies, printing and reproduction services, other direct expenses associated with delivery of the work; plus applicable sales, use, value added, business transfer, gross receipts, or other similar taxes. iii. Subcontract Expenses. Subcontract expenses and outside services shall be reimbursed at cost to ENGINEER plus a markup of ten percent (10%). iv. Budgets. ENGINEER will make reasonable efforts to complete the work within the budget and will keep the City informed of progress toward that end so that the budget or work effort can be adjusted if found necessary. ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be adjusted, nor is the City obligated to pay ENGINEER beyond these limits. If ENGINEER projects, in the course of providing the necessary services, that the PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether by change in scope of the project, increased costs or other conditions, the ENGINEER shall immediately report such fact to the City and, if so instructed by the City, shall suspend all work hereunder. When any budget has been increased, ENGINEER's excess costs expended prior to such increase will be allowable to the same extent as if such costs had been incurred after the approved increase. B. The ENGINEER shall be paid monthly payments as described in Section II - Method of Payment. II. Method of Payment A. The ENGINEER shall be paid by the City based upon an invoice created on the basis of statements prepared from the books and records of account of the ENGINEER, based on the actual hours and costs expended by the ENGINEER in performing the work. DISCUSSION: On June 26, 2018 with Mayor and Council Communication C-28764, the City Council authorized execution of an engineering services agreement with AECOM Technical Services, Inc. in the amount of$306,375.00 for the N. Crowley Road and N. Crowley Cleburne Road Intersection Improvements project. On February 4, Amendment No. 1 to City Secretary Contract No. 51288 was administratively approved in the amount of$0.00. The purpose of Amendment No. 1 was to include additional engineering and environmental labor categories and rates in the contract. Amendment No. 1 did not increase the contract amount. This Amendment No. 2 includes costs in an amount of$227,673.00 associated with additional design services and environmental studies to account for significant scope changes that have been incorporated into the project. This project was originally intended to be a new right turn lane for vehicles turning south from N. Crowley Cleburne Road onto N. Crowley Road. During the initial coordination meetings with Texas Department of Transportation (TxDOT), widening of the road, addition of a free right turn lane and dual left turn lanes were proposed at the intersection. Also, a right turn lane for vehicles turning west off N. Crowley Road and onto N. Crowley Cleburne Road was proposed. Later, the planning and design of a new sports complex near the intersection of W. Risinger Road and Hemphill Street for Crowley Independent School District (ISD) caused the need for a new roadway connection on the east side of this intersection. Incorporation of the new connection caused additional major scope changes. This Amendment No. 2 allows for final design of the new intersection geometry with all scope changes along with environmental permitting of the improvements as required by TxDOT as part of the relatively new Local On-System Agreement (LOSA) process. The TxDOT LOSA process and associated environmental permitting did not exist at the time of the original execution of this contract. This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Compliance with the City's Business Equity Ordinance has been achieved by the following method: AECOM agrees to maintain its initial M/WBE commitment of 25\% that it made on the original agreement and extend and maintain that same M/WBE commitment of 25\% to all prior amendments up to and inclusive of this Amendment No. 2. Therefore, AECOM remains in compliance with the City's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 6. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2018 Bond Program Fund for the Crowley Road and Cleburne Road project to support the approval of the above recommendation and execution of the amendment. Prior to expenditures being made, the Transportation and Public Works Department has the responsibility to validate the availability of funds.
