HomeMy WebLinkAboutContract 50692-A5 AMENDMENT NO. 5 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES FIRE STATION 43 STATE OF TEXAS CITY SECRETARY CONTRACT NO. 50692-A5 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and RPGA Design Group Inc., (Consultant) made and entered into City Secretary Contract No. 50692 (The Contract) which was authorized by the City Council by M&C C-28651 , the 3rd day of April, 2018, for Fire Station 43 + Utility Extensions, Linkmeadow Drive & Interstate Highway 30 / Fort Worth, Texas-land WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services for FS #43 — Additional site adaption services. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional professional services for the site adaptation services. The cost of this additional service is $105,600.00 plus $7000.00 in reimbursable expenses. The scope of services is described more fully in RPGA Design Group, Inc. Letter dated January 18, 2021 (revised 5/27/21), subject: "Fire Station #43, Walsh Ranch Site / Fort Worth, Texas, Amendment #5 — Phase 2 Site Adaptation Services". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $549,354.97 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." This Additional Services Proposal reflects our anticipated Professional Services for the completion of the Site Adaption of the new Fire Station #43 to the Walsh Ranch site at the southwest corner of Walsh Ranch Parkway and Walsh Avenue in Fort Worth, Texas. We submit the following: I. Project Description A. General Description: Fire Station #43 will be a site adaptation of the previous Fire Station #43/#45 design with approximately 10,500 total square feet, located on approximately 2.07 acres. Fire Station #43 will be a one (1) story, two (2) company fire station with 3 apparatus bays. The fire station design will utilize the new Proto-type designed for the original Fire Station #43 site and currently being implemented on Fire Station #45 in north Fort Worth. It is anticipated that exterior modifications, based on comments received for Walsh Ranch, will be made to the Proto-type design. B. As a site adaptation we understand that the site design for the new design will be similar to FS 43 incorporating site and landscape features required by Walsh Ranch. II. Scope of Services A. General Services: RPGA will meet with the Owner to clarify and define the Owner's requirements and budget prior to commencement of work. RPGA will supervise and coordinate consultants' activities, review all consultants' documents and review all pertinent consultant documents with the Owner. Consultants hired independently by the Owner are excluded from RPGA's supervision and coordination. III. Compensation: A. Based on our understanding of the scope of services to be performed the fees are as stated below. If during the development of the project changes are made to the scope and/or construction budget of the project, the fees will be subject to revision. Reimbursable fees will be billed to the Owner at one and one tenth (1.10) the expense incurred by RPGA. Reimbursable expenses will include, but not be limited to, the following: a) cost of reasonable incidental charges exclusive of markup for delivery charges; cost of reproduction, postage and handling of drawings, specifications and other documents; and renderings, models and mock-ups requested by the Owner and as required in the normal preparation of Schematic Design, Design Development and Construction Documents as required for reviewing and developing the Documents for the project. b) cost of TDLR accessibility variance application fees, project filing fees, plan review and inspection fees. c) all necessary costs of printing and/or courier services for the purpose of bidding the Construction Documents and Specifications will be the responsibility of the Owner. IV. Documents: All plans and drawings will be prepared and submitted by RPGA to the Owner for approval on 24" x 36" or 30" x 42" bond sheets, with all plotted lettering clearly legible when the sheets are reproduced and reduced to half size. It is to be implicitly understood that we, RPGA, will act in your best interests and, at all times, carry out duties with reasonable diligence and expedience. DISCUSSION: The purpose of this Mayor& City Council Communication (M&C) is to authorize the execution of Amendment No. 5, in the amount of$112,600.00, to a professional services agreement with RPGA Design Group, Inc., for design services for a new Fire Station 43, to provide required modification of the construction documents for the change of location to Walsh Ranch Parkway. On July 15, 2003, (M&C C-19661) the City Council authorized the City Manager to execute an Agreement with RPGA Design Group, Inc. (RPGA) for the design of Fire Station No. 38 and the development of a prototype design for a two-company, three-bay fire station. Fire Station 43 will be this prototype facility design adapted to the specific site in far west Fort Worth. Amendments No. 1 through No. 4 were administratively executed to address various issues with the previous site and initial relocation. Amendment No. 5 will address required modification to the site plans, utilities, and exterior modifications in order to be located in the Walsh community. The City's SBE goal on this project is 20\%. The new Fire Station No. 43 will be located in COUNCIL DISTRICT 3. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the 2014 Bond Program for the Fire Station 43 project to support the approval of the above recommendation and execution of the amendment. Prior to any expenditure being incurred, the Property Management Department has the responsibility to validate the availability of funds.
