Ordinance No. 17042-07-2006 AN C)RDlNANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $4fl0,Otl0 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE MCADAMS BUILDING-SIX POINTS SUSTAINABLE DEVELOPMENT PRO.iECT; PRDVIDING FOR A SEVERABlLITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. $E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 9. That in addition to #hase amounts aliocafed to the various City departments for Fiscal Year 20U5- 2006 and in the Budget of the City Manager, there shat! also be increased estimated receipts and appropriations in the Grants Fund in the amount of $4flfl,flflfl, from available funds, far the purpose of funding the McAdams BuiidingSix Points Sustainable Development Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 98552 and all other ordinances and appropriations amending the same except in Phase instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adapt the attached resolution to authorize entering rota an interiocal agreement {ILA) with the North Central Texas Council of Governments (NCTCOG) for the McAdams Building-Six Paints Sustainable Development project (Project); 2. Authorize the City Manager to accept Sustainable Development funds in the amount of $32D,DDD from NCTCOG; 3. Authorize the transfer of $BD,DDO from the New Development Fund to the Grants Fund far the local match; 4. Adapt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $4DD,DDO; 5. Authorize anon-interest bearing loan from the General Fund in the amount of $8D,DDD to the Grants Fund; and 6. Authorize payment of $BD,DDD to NCTCOG in lieu of administrative fees, with the understanding that these funds will be reimbursed in full upon Project completion. DISCUSSION: On ,tanuary 19, 2006, (M&C G-15D65) the City Council authorized the Planning Department to submit nominations for seven projects far funding through the Sustainable Development Program. On April 13, the Regional Transportation Council approved funding in the amount of $32D,DDD for the McAdams Building-Six Paints Project. This grant amount requires a local match of $BD,DDD, which brings the total Project amount to $4DD,DDD. The required local match of $BD,DDD will come from 2DD4 bond funds allocated as local match far streetscape improvements in urban villages. In lieu of charging administrative fees, NCTCOG requires that the local match of $8D,DDD be paid before Lognarrae: 22SD MCADAMS Pale 1 0~2 they will issue a Notice to Proceed on the Project. NCTCOG will return these funds to the City when expenditures have reached 80% of the Praject fatal, and retain the interest earned to cover administrafiive casts. Upon approval of this M&C, staff will complete the following activities: 1. Submit the resolution to NCTCOG on ar before Friday, July 14, for consideration by the Surface Transportation Technical Committee, the Regional Transportation Council, and the Executive Board of NCTCOG. 2. Upon approval by the aforementioned bodies, work with NCTCOG to execute an interlocal agreement. 3. Submit payment of $80,000 to NCTCOG, which will be reimbursed in its entirety upon completion of the Project. 4. After receipt of a Notice to Proceed, issue a request far qualifications from appropriate engineering firms. This project is located in COUNCIL DISTRICTS 2 and 4 FISCAL. INFORMAT[ONICIERTIFICATION: The Finance t7irectar certifies that upon approval of the above recommendations, receipt of the funding, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
