AMENDMENT No. 1
TO CITY SECRETARY CONTRACT No. 52922
WHEREAS, the City of Fort Worth (CITY) and The Landscape Alliance,
(ENGINEER) made and entered into City Secretary Contract No. 52922, (the
CONTRACT) which was administered on the llth day of October, 2019 in the
amount of $81, 827 . 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Marine Creek Ranch Park Project; and
WHEREAS, it has become necessary to execute Amendment No. l to the
CONTRACT to include an increased scope of work and revised fee .
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
survey and design services specified in a proposal dated August 31, 2020,
a copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $250, 664 . 00 . (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $332, 491 . 00 .

All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Re: Marine Creek Ranch Park and Marine Creek Trail (Park to Lake)
Dear Clarence:
I appreciate the opportunity to submit The Landscape Alliance's (TLA) proposal to provide professional
services related to the design of park improvements for Marine Creek Ranch Park and of trail improvements
for the proposed regional trail from the park to Marine Creek Lake . TLA has developed 30%plans for the
park as part of a prior contract. SRA Parkhill Smith Cooper has prepared 60%plans for the trail as part of
a prior contract. In this proposal SRA will become part of this project team to complete their trail work and
provide limited civil services related to the park. Their proposal to our firm is attached and should be
considered part of our proposal. Services will be consistent with the scope outlined within your request.
These services include :
• Development of 60% Construction Documents for the park.
• Development of 90% Construction Documents for the park.
• Development of 90% Construction Documents for the Marine Creek Trail.
• Development of 100% Final Review Construction Documents for the park and trail.
• Preparation of Final Sealed Documents for Bidding.
• Assistance during Bidding Phase.
• Construction Phase Assistance.
• Platting of the site.
The City has represented that the overall project budget is $3,500,000 with an anticipated construction
budget of$2,800,000. Requested design scope is expected to exceed$3,000,000 and the City has elected
to pursue this scope in anticipation of additional or future funding. Targeted Phase II improvements within
this scope will include:
• Regional Trail connection from the park to the existing trail at Marine Creek Lake. SRA-Parkhill
Smith Cooper has provided the City 60%plans for the trail. Subsequent plan development will be
conducted as part of this scope with SRA being part of our design team.
• Informal Athletic Fields.

• Trails -paved for hike and bike within the park and connecting to the regional trail.
• Basketball Court facilities. One court will include a hard cover with lighting for utilization during
evenings and in hot or inclement weather.
• Playground-More extensive than past City standard facilities.
• Picnic shelters/pavilions,picnic facilities, exercise equipment and related site furnishings.
• Parking additions.
• Lighting additions.
The proj ect scope will further include the following phases of work,some of which may occur concurrently:
Phase I - 60% Construction Documents
This phase will include preparation and submittal of 60% design/construction documents for municipal
review. These documents will incorporate prior input from the City and public. These documents shall plan
and instruct the installation of park improvements based on approved Schematic Design plans prepared in
earlier stages of the planning effort. Prior to design progress,TLA will meet with the Development Review
Committee and related departments to discuss and external requirements. The 60%documents will include:
• geotechnical investigations
• design/construction plans
• outline of anticipated technical specifications
• detailed opinion of probable costs
• Initiate platting process
TLA will attend meetings with the City to discuss review comments and obtain input and approval prior to
pursuing 90% construction documents.
Phase II-90% Construction Documents
This phase will include preparation and submittal of 90% design/construction documents for municipal
review. These documents will incorporate prior input from the City. The 90% documents will include:
• design/construction plans
• anticipated technical specifications
• detailed opinion of probable costs
TLA will attend meetings with the City to discuss review comments and obtain input and approval prior to
pursuing 100%construction documents. Based on conversations with the City,traditional Urban Forestry
documentation and submittal will not be required. Tree preservation and replacement will be reviewed and
approved by the Park Department. The City has represented that it will provide any review, coordination,
and submittal related to historic resources.
Phase III - 100% Pre-Final CD's and Sealed Final Construction Documents
This phase will include preparation and submittal of 100%pre-final construction documents for the City's
review which incorporated prior City review comments and input. Products will include:
• opinion of probable cost
• mylar cover sheet

• design/construction plans
• final technical specifications
This phase will also include submittal to the Texas Licensed Registered Accessibility Specialist for
registration and review.
Following final review by the City, TLA will submit sealed and signed design documents for all
improvements to the City for bidding advertisement, incorporating previous City review comments and
input. Products will include:
• sealed design/construction plans
• seals Page for final technical specifications
• detailed opinion of probable costs for planned improvements
Phase IV-Bid Assistance
TLA shall perform the following tasks:
• prepare and submit written responses to bidder requests for information (RFI's),through the City
• attend pre-bid conference, in support of the City
• assist the City with bid analysis,bid tabulation, and bid award recommendation
Phase V- Construction Phase Assistance
TLA will perform the following tasks:
• attend pre-construction conference in support of the City
• review product submittals and shop drawings
• attend on-site coordination/status meetings as requested by the City during the construction phase of the
project. This is anticipated to be on a schedule of one visit per month plus responding to any urgent
issues. Anticipated visits are estimated at twelve (12).
• participate in and provide site report for final walk through.
• provide for an inspection and report by a Texas Licensed RAS.
Special Services
• Geotechnical Investigation
TLA shall have performed the following tasks also referenced in Phase I duties:
a. provide a geotechnical investigation,analysis,and engineering targeting three locations in the park
and four along the trail which will be representative of planned improvements.
b. provide an official report to the City stating all pertinent design requirements necessary for
completion of park improvements.
• Platting
TLA will utilize the firm of Spooner and Associates to prepare and submit a plat of the property per
guidelines of the controlling jurisdiction. The sheet format will be 24 x 36 at an appropriate scale and
three original hard signed copies with PDF copies will be included. Newly created lot corners will be
staked once the final plat is approved and filed. Platting services include the following exceptions:

a. This proposal does not include hiring an abstractor to conduct abstracting services for the property,
easement and right of way research. Current platting and/or deed information available at the
County and information provided by the owner will be used for this project.
b. This proposal does not include time associated with City Planning or Council meetings. Those
items will be invoiced hourly based on time and materials.
c. The proposal does not include the preparation of offsite easements and/or mapping. If any
additional services are required, compensation may be requested as an additional service.
d. The proposal does not include fees associated with County and City filing and application fees.
Those costs are assumed to be borne by the City.
e. The proposal assumes the plat will be filed by the City once approved by the controlling jurisdiction.
Additional service exclusions include:
a. Off site improvements.
b. Design of areas beyond designated project areas.
c. Redesign or significant modification to existing drainage channel located within the drainage
easement.
d. Assessment of downstream drainage impacts.
e. Hydraulic and Hydrology study of Marine Creek.
f. Design of pedestrian bridges greater than 29" in height that include guardrails, abutments, etc.
g. Design of utilities, storm drainage systems or relocation of existing utilities not currently included
within the scope of services.
SBE Participation
TLA will engage the services of recognized local sub-consultants to achieve the City's goals related to SBE
participation. Proposed SBE members will include:
• Spooner &Associates will provide platting services for the park project.
• CMJ Engineering will provide geo-technical investigations within the park and designated trail area.
• Baird Hampton Brown will provide electrical engineering related to new and relocated lighting.
• Baker Design Build will provide structural engineering for court cover.
• Accessology will provide review and inspection related to issues of accessability.
Fees
The proposed base fee for the services outlined above is$250,664.00 This fee includes all primary services
described in the scope of services outline to be provided by TLA and its consultants. The proposed fee
includes Special Services of platting and geo-technical services. A schedule of proposed fees by firm is
included herein.
Fees will be billed on an hourly basis,based on services actually rendered. The City of Fort Worth will be
advised in advance of any anticipated changes in services which will impact the fee. Included in the
proposed fee are costs associated with reproduction and travel related to the production of the contract
products. Items not specifically included in the estimated fee include:
1. Additional services or other items not referenced or inferred herein will be charged as an additional
service cost if required and approved by the City.

A statement of charges for services will be submitted by the 1st of each month for the previous months'
services and will be payable within thirty days by the City. It is understood that this agreement may be
cancelled at any time by the City and payment shall be due based on the above method of computation only
on work performed or expenses incurred to the date of cancellation.
Registration / Right to Practice: The Texas Board of Architectural Examiner's has jurisdiction over a
professional's practice and may be contacted at P.O. Box 12337, Austin, Texas 78701-2337, (512) 305-
9000.

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment No. 1 to City Secretary Contract No. 52922,a
Professional Engineering Agreement with Gary Paul Kutilek d/b/a The Landscape Alliance, in the amount of$250,664.00 for additional design
services related to the Marine Creek Ranch Park Improvements Project(City Project No. 102225), increasing the contract amount to$332,491.00.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C)is to authorize execution of Amendment No. 1 to City Secretary Contract No.52922
with The Landscape Alliance, in the amount of$250,664.00 for additional design services related to the Marine Creek Ranch (MCR) Park
Improvements, increasing the total contract amount to$332,491.00.
On October 11, 2019, the City entered into an Engineering Agreement with Gary Paul Kutilek d/b/a The Landscape Alliance (City Secretary
Contract No. 52922), in the amount of$81,827.00 for the master plan development and preparation of schematic design plans for this project.
The Landscape Alliance,will provide engineering related services for the park project located in northwest Fort Worth,outside of the 820 loop,
south of Cromwell Marine Creek Road and west of Marine Creek Parkway. Marine Creek Ranch Park is approximately 49.8 acres, and
includes the Northwest Library which is located in the northwest corner of the park.
The 2018 Bond Program allocated $3,000,000.00 for Marine Creek Ranch Park Improvement which includes the design and construction for the
development of the Marine Creek Ranch Park, including but not limited to, preparation of construction documents and topographic survey, tree
survey, geotechnical investigation, hydrology/hydraulic analysis.Additional project funding in the amount of$246,600.00 has been appropriated
from Park Dedication Fees collected from the MCR Development for Park Improvements.
This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt
is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018)
and subsequent actions taken by the Mayor and Council.
M/WBE OFFICE-Gary P. Kutilek d/b/a The Landscape Alliance is in compliance with the City's BIDE Ordinance by committing to 12%SBE
participation on this project. The City's SBE goal on this project is 12%.
Marine Creek Ranch Park Improvement project is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the PARD Dedication Fees
fund and the 2018 Bond Program fund for the Marine Creek Ranch project to support the approval of the above recommendation and execution of
the amendment. Prior to any expenditure being incurred, the Park& Recreation Department has the responsibility to validate the availability of
funds.

I was about to upload this contract when I noticed that it states it is CSC No. 52992 but that is to
another contract and not with The Landscape Alliance. It has not been uploaded yet but changes will
need to be made that I cannot make and you must get approval from Legal.You will need to ask
them if they are okay with the contract number being changed on the document or if it needs to be
rerouted.
