ORDINANCE NO. (57/� AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR LIMITED PURPOSE ANNEXATION OF A CERTAIN 7, 257 ACRES (11 . 339 SQUARE MILES) OF LAND, MORE OR LESS, IN TARRANT COUNTY AND PARKER COUNTY, TEXAS, BEING ALL OF THOSE CERTAIN TRACTS OF LAND DESCRIBED IN THE DEEDS RECORDED IN VOLUME 237, PAGE 562 AND VOLUME 193 , PAGE 335 OF THE DEED RECORDS, PARKER COUNTY, TEXAS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT CORPORATE BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PROVIDING FOR SEVERABILITY; AND NAMING AN EFFECTIVE DATE. WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, concerning the proposed limited purpose annexation of the territory hereinafter described, was held in the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 9th day of September 2003 ; and WHEREAS, a second public hearing before the City Council of the City of Fort Worth, Texas, concerning the proposed limited purpose annexation of the territory hereinafter described, was held in the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 23rd day of September 2003 ; and WHEREAS, at each public hearing each member of the public who wished to present testimony or evidence regarding the proposed limited purpose annexation was given the opportunity to do so; and WHEREAS, the City Council heard and considered the appropriateness of the application of rural and urban ordinances in the area proposed for limited purpose annexation at such public hearings; and WHEREAS, the City prepared a report regarding the proposed Walsh Ranch / AX-03-0010 1 limited purpose annexation of the area, consisting of a planning study and a regulatory plan, in accordance with Section 43 . 123 of the Texas Local Government Code; and WHEREAS, a notice of the availability of the report was published in a newspaper of general circulation in the City of Fort Worth and in the area proposed for annexation on August 27 and August 28, 2003 , and the City made the report available to the public in the City' s Development Department and on the City' s Internet website; and WHEREAS, notice of the first and second hearings was published in a newspaper of general circulation in the City of Fort Worth and in the area proposed for annexation on August 27 and August 28, 2003 , and was posted on the City' s Internet website on August 27, 2003 ; and WHEREAS, an additional notice of the second public hearing was published in a newspaper of general circulation in the City of Fort Worth and in the area proposed for annexation on September 11, 2003 ; and WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 100, 000 inhabitants; and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains 7, 257 Walsh Ranch / AX-03-0010 2 acres (11 . 339 SQUARE MILES) of land, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 . The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas is hereby added to and annexed to the City of Fort Worth, Texas, for limited purposes, in accordance with Sections 43 . 121 through 43 . 136 of the Texas Local Government Code, and the present corporate boundary limits of said City are altered to include said area within the corporate limits of the City of Fort Worth, Texas, for limited purposes : Being approximately 7, 257 acres situated in Tarrant County and Parker County, Texas, being all of those certain tracts of land described in the deeds recorded in Volume 237, Page 562 and Volume 193, Page 335 of the Deed Records, Parker County, Texas, and being more particularly described, as follows : Beginning at the most northerly northeast corner of the I&GNRR Co. The above described territory is shown on Map Exhibit D which is attached hereto and expressly incorporated herein by reference for the purpose of illustrating and depicting the location of the hereinabove described territory. SECTION 3 . The Regulatory Plan attached hereto as Exhibit E is hereby adopted by the approval of this ordinance. The regulations identified in the regulatory plan shall be enforced in the area described in Section 1 above. SECTION 4 . The residents of the area described in Section 1 above are entitled to vote in municipal elections regarding the election or recall of members of the City Council or regarding the amendment of the municipal charter, but may not vote in any bond election or be a candidate for or elected to a municipal office. Walsh Ranch / AX-03-0010 8 SECTION 5 . This ordinance shall and does amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict, this ordinance shall be, and the same is hereby made cumulative. SECTION 6 . It is hereby declared to be the intent of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7 . The City Council hereby declares it to be its purpose to annex to the City of Fort Worth every part of the area described in Section 1 of this ordinance, regardless of whether any part of such described area is hereby not effectively annexed to the City. It is the City' s intent that the property described in Section 1 be contiguous to the north right-of-way line of the Texas Pacific Railroad on the south and contiguous on the easterly side to the following plats and tracts recorded in the Tarrant County Deed and Walsh Ranch / AX-03-0010 9 Plat Records, Tarrant County, Texas: Volume 7582 , Page 1924 ; Volume 388-7, Page 87; Volume 388-115, Page 98; Volume 13736, Page 404 ; Volume 11771, Page 1359, Cabinet B, Slide 1848 ; Volume 6477, Page 338, and Volume 12208, Page 2283 . Should this ordinance for any reason be ineffective as to any part or parts of the area hereby annexed to the City of Fort Worth for limited purposes, the ineffectiveness of this ordinance as to any such part or parts shall not affect the effectiveness of this ordinance as to the remainder of such area. Provided, further, that if there is included within the description of territory set out in Section 1 of this ordinance to be annexed to the City of Fort Worth any area which is presently part of and included within the limits of the City of Fort Worth, or which is presently part of and included within the limits of any other city, town or village, or which is not within the City of Fort Worth' s jurisdiction to annex, the same is hereby excluded and excepted from the territory to be annexed hereby as fully as if such excluded and excepted area were expressly described herein. DISCUSSION: On August 12, 2003 (M&C PZ-2495), the City Council approved the timetable for annexing the above referenced property for limited purposes . Public hearings concerning this request were held as required by state law on September 9, and 23, 2003. Institution and approval of the annexation ordinance and the attached regulatory plan completes the limited purpose annexation process. The annexation must be instituted on October 14, 2003 in order to comply with the hearing process established by state law. The City Council can approve the annexation ordinance and attached regulatory plan on October 14, 2003, or continue approval for up to 90 days. State law requires the regulatory plan to specify the planning, zoning, health and safety ordinances the City will enforce and to state the date by which the City will annex the area for full purposes.
