HomeMy WebLinkAboutOrdinance 25361-03-2022 ORDINANCE NO.25361-03-2022 AN ORDINANCE ADJUSTING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE TAX NOTE 2017 FUND, BY INCREASING RECEIPTS AND APPRPRIATIONS IN THE PARK VISTA AT KELLER HASLET PROJECT(CITY PROJECT NO. 101020) IN THE AMOUNT OF $500,000.00 AND DECREASING RECEIPTS AND APPROPRIATIONS IN THE JUMP START PROGRAMMABLE PROJECT (CITY PROJECT NO. P00099) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be adjusted estimated receipts and appropriations in the Tax Note 2017 Fund,by increasing receipts and appropriations in the Park Vista at Keller Haslet Project(City Project No. 101020) in the amount of$500,000.00 and decreasing receipts and appropriations in the Jump Start Programmable Project(City Project No.P00099)by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of a contract with XIT Paving and Construction,Inc.in the amount of$1,580,011.10 for construction of Park Vista at Keller Haslet Road Intersection Improvements project(City Project No. 101020); 2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Tax Note 2017 Fund by increasing receipts and appropriations in the Park Vista at Keller Haslet project(City Project No. 101020)in the amount of$500.000.00 and decreasing appropriations in the Jump Start Programmable project(City Project No. P00099)in the same amount; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the 2007 CritCapProj-CO2013A Fund in the amount of$600,000.00 from available funds for the Park Vista at Keller Haslet project,(City Project No. 101020)for the purpose of funding a construction contract;and 4. Amend the Fiscal Years 2022-2026 Capital Improvement Program. The project was advertised for bid on December 2,2021 and December 9,2021 in the Fort Worth Star-Telegram. On January 13,2022 the following bids were received: Bidders Amount XIT Paving and Construction,Inc. $1,580,011.10 Rebcon,Inc $1,581,487.50 Reliable Paving,Inc $1,585,175.80 2L Construction,LLC $1,618,333.70 Reyes Group Ltd. $1,662,515.65 McClendon Construction Co., Inc. $1,695,256.30 The Fain Group,Inc $1,764,835.30 McCarthy Building Companies, Inc $1,777,263.58 Fort Worth Civil Constructors, LLC $2,092,462.00 Construction of Park Vista Boulevard at Keller Haslet Road is anticipated to begin in Summer 2022. Funding for this project is being provided from the 2018 Bond program. This project is included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election(Ordinance No.23209-05-2018) and subsequent actions taken by the Mayor and Council. XIT Paving and Construction, Inc.is in compliance with City's BIDE Ordinance by committing 16.0%MBE participation on this project. The City's MBE goal on this project is 15%. Funding for this project was not included in the FY2022-2026 Capital Improvement Program(CIP)because construction cost estimates were not complete at the time of CIP development. The action in this M&C will amend the FY2022-2026 Capital Improvement Program as approved in connection with Ordinance 25073-09-2021. Funding is available for appropriation in the TPW Dept Highway&Streets Department's Unspecified All Funds and the Jump Start Programmable projects for the purpose of funding the Park Visa at Keller Haslet project. The Project is located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified-All Funds project within the 2007 GhtCapProj-CO2013A Fund and the Jump Start(TPW&PMD)programmable project within the Tax Note 2017 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the CritCapProj-CO2013A Fund,2018 Bond Program Fund and the Tax Note 2017 Fund to support the approval of the above recommendations and award of the contract. Prior to an expenditure being incurred,the Transportation and Public Works Department has the responsibility of verifying the availability of funds.
