HomeMy WebLinkAboutOrdinance 20671-03-2013 ORDINANCE NO. 20671-03-2013 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF SOUTHLAND AVENUE, SITUATED IN THE WILLIAM WELCH SURVERY, ABSTRACT NO. 1644 IN THE CITY OF FORT WORTH, AS SHOWN ON A PLAT FOR SOUTHLAND SUBDIVISION OF BLOCK 10, FIELD'S WELCH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH, TEXAS, AS RECORDED IN VOLUME 310, PAGE 5 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; CONTAINING APPROXIMATELY 2,550 SQUARE FEET OR 0.059 ACRE OF LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Southland Avenue (a 50' width public right-of-way), situated in the William Welch Survey, Abstract Number 1644, Tarrant County, Texas, as shown on plat for Southland Subdivision of Block 10, Field's Welch Addition, an addition to the City of Fort Worth, as recorded in Volume 310, Page 5 of the Plat Records of Tarrant County, Texas and that portion that was dedicated by plat for Lot 14R, Southland Subdivision of Block 10, Field's Welch Addition, an addition to the City of Fort Worth, as recorded in County Clerk's Document Number D212181876of the Plat Records of Tarrant County, Texas, and containing approximately 2,550 square feet or 0.059 acre of land more or less, and as more specifically described in Exhibits "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. That the right of way easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easements be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. (COUNCIL DISTRICT 9) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating a portion of Southland Avenue north of Pulaski Street to the Ronald McDonald House of Fort Worth, Inc.; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G- 15624). DISCUSSION: Dunaway Associates, Inc., on behalf of The Ronald McDonald House of Fort Worth, Inc., has requested the vacation of this right-of-way to replat it with the adjoining property for expansion of the existing Ronald McDonald House facility. The City Plan Commission recommended approval of this request at its meeting on January 23, 2013. An acceptable replat(FS-012-140) has been received. The City of Fort Worth (City)originally obtained the above mentioned right-of-way through the platting process. The City does not own land under or adjacent to the above referenced street. Since no City funds have been expended to purchase property or easement rights, collection of the fair market value or any portion, thereof, is recommended by Staff to be waived. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that this action will have no material effect on City funds.
