HomeMy WebLinkAboutOrdinance 20672-03-2013 Ordinance No. 20672-03-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $36,000.00, SUBJECT TO RECEIPT OF EXECUTED CONTRACT AMENDMENTS, FOR THE PURPOSE OF REIMBURSEMENT OF EXPENSES TO THE CITY OF FORT WORTH DURING CONTRACT PERIOD FROM SEPTEMBER 1, 2013 THROUGH AUGUST 31, 2014; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of$36,000.00, subject to receipt of executed contract amendments, for the purpose of reimbursement of expenses to the City of Fort Worth during contract period from September 1, 2013 through August 31,2014. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, 'inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which 'instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the execution of Amendment No. 3 to the Intergovernmental Cooperative Reimbursement Agreement with the Texas Commission on Environmental Quality for the operation of a local air pollution particulate emission monitoring site, at Haws Athletic Center, 600 Congress Street in an amount not to exceed $36,000.00 for a total contract in the amount of$133,718.53 for the period of September 1, 2013 through August 31, 2014; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$36,000.00 in Fiscal Year 2014 subject to receipt of executed contract amendments; and 3. Apply indirect cost at the most recently approved rate of 21.48 percent for the Transportation and Public Works Department. DISCUSSION: The Texas Commission on Environmental Quality (TCEQ) has contracted with the City for operation and maintenance of monitoring equipment provided by the TCEQ for one particulate matter monitoring station. The station is located at Haws Athletic Center, 600 Congress Street (Council District 2). The City is responsible for retrieving the sampling filters and data, sending filters and data for analysis, and performing regular audit and maintenance activities on the equipment. Contract Amendment No. 3 adds a new contract term from September 1, 2013 through August 31, 2014 and increases the amount reimbursable to the City by $36,000.00 for said period.
