HomeMy WebLinkAboutOrdinance 2017 0RD12,1;i1,TCLP NO. .i%Nr ORDMANCE AJJESSING tu PORTION OF TIM- COST OF D21ROVELMOT 0114 !ZLI1114 STR M, -T' IN ME CITY OF ART WORTHO, TEXA39 BLMZ2111 Ir.7*-S ILMMS.11XTION Vi= THE SOU11i LIaNTE, 01' WEA911�MRD STREW AIM ITS DIT&IISECTION VIITH M MIMI L.INE OF LAN CAS TIM AVIQWE t AGA T'K.,41 OWMMS OF PROP'SrY ABUTTING MEnON, A1,ED I PROPS=, BE IT ORDJAMM BY TH' CITY COUNCIL OF THE G OF FORT WORWIL, TE)L�.3: w1imlHAS,, heretofore the City Council of the said city direct,ed the improvement of Main Street between its intersection with the south line of �1eatherford Street and its intersection, with the north line of Lancaster Ave- nue by resurfacing the same-, end,, 1XIEREASS in accordance with said resolution, specific ations for said were were duly prepared by the C,ity Engineer and adopted by the City Council, and, vd�µ� o bids for said improvements were duly advertised for as re- quired by the City Charters, and said 'bids were received,, opened and cone erect by the City Council,, and the bid of Texas Bitulithic Company for the improvement of the said portion of' said street was accepted by said City Council- and, vaM;A59 the said Texas Bitullithic Company has entered into a co,n- tract with the City of Fort Worth., as provided by the Charter,, for the improveeft ment, of said street within the said l by resurfacing the same with 3" Vertical Fibre Brick pavanent on existing foundation; and, vaDMzASs the said contractor has executed bonds, to the City of Fort Worth for the construction and raaintainance thereof in accordance with the said contract and specifications, with surety as required by the said City Charter, which contract and, bonds with the surety thereof have been duly approved by the said City Goun oil- and,, 'Af , MXAAS, thereafter the City 2:agineer of said city filed his tat ant with the Gity Council concerning the �aid iillp rev mante and the cost thereof, as provided by the Cbarter of the city, which statement was consideraw ed by the City Council, corrected and approved and, Vii. thereafter,, the said Cite Council did by resolution fin and declare the necessity of assessing a portion of the cost of said improves ments against the owners of the property abutting thereon,, and their property, and did prescribe a hearing of the said ers, their attorneys and agents, d fixed a date therefor and did direct the said Secretary of the said city. to issue notice of the said hearing by advertisement, as provided by the said City Charter, and also by pos,ting said notices as provided therein; and, in accordance with the said resolution, the City Secretary did is,sue a notice of the said hearing to the said owners and all interested parties y publication thereof for the time, and in the iaa=er prescribed by the City Chart , in The Star-Telegram, a daily paper of general circulation in the City of Fort Worth, for five 5 consecutive days prior to, the said hearing,, and did also notify the said owners of the said hearing y posting a copy of the said notice to each of them at the post, office, in the City of rt Worth Texas, more than ten days prior to the date of the a i d Vdi"NREASO, the said hearing,, in accordance with the said resolution and notice, was held by the City Council on the 30th day of '"ov er, 1938, at 10t o'clock ���, at which time and place owners appeared to protest the said assessment and the benefits of said i -0 Provement connected with the improvement of said portion of said street , IOW IOW8 to -ml t (1) That the special benefits to each parcel of abutting property hereinafter mentioned in the enhanced value of said property by means, of said improvements exceed in each case the amounts hereinafter assessed against such property and the owners thereof, and the said City Council having considered the evidence! and it appearing therefrom that the apportionment and assessment hereinafter made will effect substantial equality and justice between property owners, and having in view benefits received by and burdens imposed upon such owners, said apportionment is hereby adopted* (2) Tht there is and shall be ae s e a ed against they several.
