HomeMy WebLinkAboutOrdinance 20684-03-2013 Ordinance No. 20684-03-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $167,431.95, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF WATER AND SANITARY SEWER MAIN RELOCATIONS FOR THE TRINITY RIVER VISION-CENTRAL CITY PROJECT AND THE TRINITY UPTON SERVICE AREA PHASE 1-BRIDGE AND CHANNEL RELOCATIONS, PART 3 MAIN STREET BRIDGE WATER, SANITARY SEWER AND STORM DRAIN RELOCATIONS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of$167,431.95, from available funds, for the purpose of Water and Sanitary Sewer Main Relocations for the Trinity Vision-Central City Project and the Trinity Upton Service Area Phase I-Bridge and Channel Relocations, Pail 3 Main Street Bridge Water, Sanitary Sewer and Stonn Drain Relocations. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. J. Louis Construction of Texas, Ltd, in the Amount of $5,929,744.19 for Water and Sanitary Sewer Main Relocations for the Trinity River Vision - Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations, Part 3, Main Street Bridge Water, Sanitary Sewer and Storm Drain Relocations, Authorize Additional Expenditure for Project Costs for a Project Total in the Amount of$6,222,744.19 and Adopt Appropriation Ordinances (COUNCIL DISTRICTS 2 and 9) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund (Trinity River Vision Project) in the amount of$167,431.95; 2. Authorize the transfer in the amount of$167,431.95 from the Special Trust Fund (Trinity River Vision Project) to the Specially Funded Capital Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of$167,431.95 from available funds; and 4. Authorize the City Manager to execute a contract in the amount of$5,929,744.19 with S. J. Louis Construction of Texas, Ltd, for Water and Sanitary Sewer Main Relocations for the Trinity River Vision - Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations, Part 3 Main Street Bridge Water, Sanitary Sewer and Storm Drain Relocations. DISCUSSION: On April 15, 2008, (M&C C-22765) the City Council authorized the City Manager to execute an Engineering Agreement with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the Trinity River Vision - Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations. The overall Trinity River Vision Project includes construction of the Main Street Bridge over a future bypass channel between the Trinity River and Clear Fork Trinity River. This project, Part 3, provides for the abandonment of the existing water, sanitary sewer and storm drain mains located on Main Street (Northside Drive South, 6th Street) that are necessitated by the proposed bridge. Additionally, new water and sanitary sewer mains will be constructed north and south of the bridge in order to maintain service to customers who will be affected by the abandonment of the identified water, sanitary sewer and storm drain mains. In addition to the contract amount, $107,000.00 (Water: $95,000.00 and Sewer: $12,000.00) is required for construction staking, project management, material testing, and inspection, and $186,000.00 (Water: $168,000.00, Sewer: $18,000.00) is provided for change order contingencies. Expenditures under this contract will not cause the City to exceed authorization of$26.6 million in expenditures for the TRV project Once the City's TRV expenditures reach $26.6 million, then the TRV Tax Increment Finance (TIF) district and the Tarrant Regional Water District (TRWD)will begin making annual reimbursements to the City for all TRV-related expenditures above that cap. Of the $5,929,744.19 construction cost associated with this contract, $4,136,616.90 is considered TRV-related andwill be credited towards the city's $26.6 million commitment while the remaining $1,793,127.29 is considered non-TRV related. Currently, the City has spent a total of$17,472,526.00 on the TRV project for design and construction activities associated with water/sewer utilities and roadway/bridge activities. M/WBE Office - S. J. Louis Construction of Texas, Ltd., is in compliance with the City's DBE Ordinance by committing to 14 percent MBE participation on this project. The City's MBE goal on this project is 14 percent. This project is located in COUNCIL DISTRICTS 2 and 9. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and the adoption of the attached appropriation ordinances, funds will be available in the current capital budgets, as appropriated, of the Specially Funded Capital Projects Fund, the Water Capital Projects Fund and the Sewer Capital Projects Fund.
