JUSTIFICATION (REASONS)FOR CHANGE ORDER
Change Order 2 authorizes professional services to amend the air permit for the Village Creek Biosolids Management and Beneficial Reuse Facility
(VCBMBR).The current air permit allows the new biosolids dryer to use natural gas as fuel.The City Is working on a project to deliver digester biogas from the
Village Creek Water Reclamation Facility to VCBMBR so that it can be used as a supplemental fuel source for the dryer.An air permit amendment Is required
to allow biogas to be utilized facility.A scope of work describing the services provided as part of this Change Order is attached. The target schedule for
amednded air permit is September 2023.

Change Order 2 Notes
The proposal for change order 2 is attached. Synagro estimates that Andritz and Freese and Nichols
used approximately 100 hours to support the preparation and submittal of the original air permit for the
project. The proposed fee is based on a similar amount of hours for Andritz and Freese and Nichols plus
the charge for the sub consultant and Synagro's standard mark up. The level of effort for Freese and
Nichols'services is attached.

Assumptions and Clarifications
1 Biogas permit modification will not affect,or alter the definitions of the Design Build project,Acceptance,Design-
Build Liquidated Damages,or the TWDB project requirements. Work performed under this Change Order shall be
exempt from the SBE/MBE participation requirements.
2 TCEQ's permit amendment application fee is an estimate based on best available information and subject to
change depending on TCEQ review.
3 No effort or costs is included to expedite processing the application by TCEQ.If City desires expedited processing
by TCEQ,the additional fee to TCEQ is$10,000.
4 A pre-application meeting,if needed,with TCEQ will be virtual.An in-person meeting in Austin,TX is an Additional
Service.
5 There will be no public notice activities.Based on preliminary emissions information based on data provided by
City,biogas firing will not result in annual emission increases greater than the public notice thresholds(i.e.;5
ton/yr for NOX,PM,and VOC;50 ton/yr for CO;10 ton/yr for S02;and 0.6 ton/yr for Pb).Public Notice,if required,
is an Additional Service.
6 City will collect and provide data regarding expected biogas quality necessary to satisfy TCEQ requirements.The
Company to identify data requirements based on preliminary meetings with TCEQ.
7 As a precondition to any operation utilizing biogas,The Company and City to discuss and agree on any impacts to
operations,including but not limited to operating costs related to burner tip cleaning,frequency and cost of
digester gas testing and calculation of the Maximum Natural Gas Usage Guarantee,and/or any other costs based
on the outcome of the biogas permit modification,City's upcoming blogas cleanup/pipeline project,and TCEQ
requirements with reporting,monitoring and testing. Stack emissions testing and impacts to operations will be
addressed when the air permit is obtained.

VCWRF BIOSOLIDS MANAGEMENT AND BENEFICIAL REUSE PROJECTBIOGAS
PERMIT MODIFICATION
SCOPE OF WORK
The City of Fort Worth has selected Synagro of Texas-CDR, Inc. (the"Company")for the design, build,
operation,and maintenance of its biosolids processing facility for the Village Creek Water Reclamation
Facility.The existing TCEQ permit No. 15990, issued on June 10,2020,only authorizes the firing of pipeline-
quality natural gas in the biosolids dryer and therefore does not authorize firing of biogas.
The Company has requested assistance from Freese and Nichols, Inc. (FNI) in obtaining authorization for
emissions due to biogas firing in thebiosolids dryer.
FNI shall render the following professional services in connection with this change order:
A. Development of Air Permitting Strategy, Pre-Application Meeting Assistance,Application Follow-up
1. Perform ancillary activities to obtain the air permit in a timely fashion.These activities include
providing a permitting strategy so that a well-defined path is followed.Arrange for, and participate
in,a pre-application virtual meeting with TCEQ if necessary.Communicate with TCEQ before
application submittal and during application review.
B. Preparation of New Source Review(NSR)Air Permit Application
1. Prepare the NSR permit application(e.g.amendment or other mechanism) in accordance with
TCEQ regulations and guidance documents.The application will include the following elements
stipulated by TCEQ:
• Description of requested permitting action, process description,and flow diagram;
6 Appropriate TCEQ air permit application workbook,forms,and tables;
9 Summary of regulatory applicability;
G Best Available Control Technology(BACT)evaluation,and
• A check for the permit application fee(to be provided by others).
2. Provide a draft version of the air permit amendment application in electronic format(i.e., as an
Adobe pdf document)for review and approval.Participate in a telephone conference to receive
comments on the draft document. Incorporate comments into the document and produce a final
version of the application. Provide hard copies and electronic copy(pdf)of the final document,
forsubmittal to the TCEQ,Synagro,and the City.
C. Air Dispersion Modeling and Impacts Review
1. Perform air dispersion modeling and an associated impacts review in accordance with TCEQ's Air
Quality Modeling Guideline and the TCEQ's Modeling and Effects Review Applicability(MERA)
guidance. Prepare an associated Air Quality Analysis report for submittal with,or subsequent to,
theNSR air permit amendment application. In the minor NSR Air Quality Analysis, it will be
demonstrated that the Project will not cause or contribute to an exceedance of National Ambient
Air
Quality Standards (NAAQS) or State Property Line Standards. It will also be demonstrated that the
Project will not adversely affect human health or the environment(as per TCEQ toxics modeling
requirements).

RECOMMENDATION:
It is recommended that the City Council authorize execution of Change Order No. 2 in the amount of
$81,696.00 to City Secretary Contract No. 53332 with Synagro of Texas-CDR, Inc.,for the Village Creek
Water Reclamation Facility Biosolids Management and Beneficial Reuse project for a revised contract
amount of$58,179,699.00.
DISCUSSION:
On December 12, 2019, Mayor and Council Communication (M&C) 19-0381, the City Council authorized
a contract with Synagro of Texas-CDR, Inc., in the amount of$58,001,558.00 for the Village Creek Water
Reclamation Facility Biosolids Management and Beneficial Reuse project(City Project No. 101961).
The contract was subsequently revised by Change Order No. 1 in the amount of$96,445.00
administratively authorized August 27, 2021 that provided for the installation of aviation safety lighting on
top of two storage silos.
This M&C is to authorize execution of Change Order No. 2 in the amount of$81,696.00 to City Secretary
Contract No. 53332 with Synagro of Texas-CDR, Inc.,for the Village Creek Water Reclamation Facility
Biosolids Management and Beneficial Reuse project for a revised contract amount of
$58,179,699.00.This Change Order provides for professional services to amend the air permit for the
Village Creek Biosolids Management and Beneficial Reuse Facility (VCBMBR).
The current air permit allows VCBMBR to use natural gas as fuel for the new biosolids dryer. The City is
working on a project to deliver biogas produced at the Village Creek Water Reclamation Facility to
VCBMBR so that it can be used as a supplemental fuel source for the dryer.The air permit amendment is
required to allow biogas to be utilized as a supplemental fuel source.
Funding for this change order has already been appropriated in the Water&Sewer Capital Project Fund.

FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously
appropriated, in the W&S Capital Projects Fund for the VCWRF Biosolids Mgmt and Reuse project to
support the approval of the above recommendation and execution of the change order to the
contract. Prior to an expenditure being incurred, the Water Department has the responsibility of verifying
the availability of funds.
