FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON BIRD STREET (BONNIE BRAE TO EAST BEAD END), GWYNNE STREET (EAST BELKNAP TO BIRD STREET), KIMBO COURT {KIMBO ROAp TO SOUTH CUL-DE-SAC}, AND MESQUITE ROAD (FOSSIL TO CAROLER); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; ANp PROVIDING AN EFFECTIVE DATE. BE !T ORDAINEp BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the Ci#y Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $190,466 and the Sewer Capital Project Fund in the amount of $271,895 from available funds for the purpose of funding a contract with McClendon Construction Company, Inc. for pavement reconstruction and water and sanitary sewer replacement on Bird Street {Bonnie Brae to East Dead End), Gwynne Street (East Belknap to Bird Street}, Kimbo Court {Kimbo Road to South Cul-De-Sac) and Mesquite Raad {Fossil to Carolea). SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, SeCtlonS, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the City Manager to transfer $462,361.OD from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $190,466.00 and Sewer Capital Projects Fund in the amount of $271, 895.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $190,466.DD and the Sewer Capital Projects Fund in the amount of $271,895.OD from available fiunds; and 3. Authorize the City Manager to execute a contract with McClendon Construction Co. Inc., in the amount of $755,694.35 for pavement reconstruction and water and sanitary sewer replacement an Bird Street (Bonnie Brae to E. Dead End}, Gwynne Street (East Belknap to Bird Street}, Kimbo Court (Kimbo Road to South Cul De-Sac} and Mesquite Road (Fossil to Carolea}. ®ISCUSSION: The 2004 Capital Improvement Program (CIP) includes funds for the above-referenced street improvements. Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that water and sanitary sewer lines should be replaced prior to street reconstruction. This project was advertised an April 2D, 2006, and April 27, 2006. Alternate "A" Alternate "B"' {As_ p_haltJi (Concrete) No Bid $755.894.35 No t3id $786,842.92 No Bid $889,931.25 TIME OF COMPLETION: 210 Working Days Specified Logname: 3030BIRDST00019 Page 1 0~ 2 The bid documents included two alternates as follows: Alternate "A" consists of a 6-inch hot mix asphalt concrete {HMAC) on 8-inch lime stabilized subgrade, construction of standard concrete curb and gutter, driveway approaches and sidewalk, where shown an the plans. Alternate "B" consists of a 6-inch concrete pavement on 6-inch lime stabilized subgrade, construction of standard concrete curb and gutter, driveway approaches and sidewalk, where shown on the plans. Staff is recommending award to Alternate "B". McClendon Construction Co. Inc. is in compliance with the City's MIWBE Ordinance by committing to 15% MIWBE participation and documenting good faith effort. The City's goal an this project is 24%. McClendon Construction Co., inc., identified several subcontracting and supplier opportunities. However, the M/WBE contacted in the areas identified did not submit the lowest bids. Contingency for water and/or sewer related change orders is $19,836.10 (water: $8,100.50; and sewer: $11,735.60) inspection and survey. Contingency far street improvement related change orders are $17,947.00. The project is located in COUNCII-. DISTRICT 4, Mapsco 63-R and D. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street improvements Fund.
