AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT
OF $1,954,000.00, DECREASING THE ASSIGNED FUND BALANCE BY THE SAME
AMOUNT, FOR THE PURPOSE THE LIVESTOCK PEN EXHAUST SYSTEMS FOR
BURNETT, RICHARDSON-BASS AND MONCRJEF BUILDINGS AT THE WILL
ROGERS MEMORIAL CENTER; PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Culture and Tourism Fund in the amount of$1,954,000.00, decreasing the assigned fund balance by the
same amount, for the purpose of the livestock pen exhaust systems for the Burnett, Richardson-Bass and
Moncrief buildings at the Will Rogers Memorial Center.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall.take effect upon adoption.

Adopt Ordinance Increasing Appropriations in the Culture and Tourism Fund in the Amount of
$1,954,000.00 and Decreasing the Assigned Culture and Tourism Fund Balance by the Same Amount,
Authorize Execution of a Contract with Johnson Controls, Inc., in the Amount of$1,753,584.00 for the
Renovation of the Livestock Pen Exhaust Systems for the Burnett, Richardson-Bass, and Moncrief
Buildings at the Will Rogers Memorial Center, Provide for Contingency and Staff Costs for a Total Project
Cost in the Amount of$1,954,000.00 (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Culture and
Tourism Fund in the amount of $1,954,000.00 and decreasing the assigned Culture and Tourism fund
balance by the same amount; and
2. Authorize the execution of a contract with Johnson Controls, Inc., in the amount of$1,753,584.00 using
a Texas Multiple Award Schedule Cooperative Contract No. TXMAS-6-840160 for the renovation of the
livestock pen exhaust systems for the Burnett, Richardson-Bass, and Moncrief buildings at the Will Rogers
Memorial Center.
DISCUSSION:
The existing original exhaust systems for the livestock pens at these three buildings are 20-30 years old
and have exceeded their functional capacity. They require constant maintenance due to the normal wear
and tear. The new exhaust systems are essential for the health and comfort of the visitors, participants,
and livestock in the three buildings. The exhaust systems will also improve the overall indoor air quality in
these three buildings at the Will Rogers Memorial Center.
PRICE ANALYSIS - The vendor prices were obtained using a Texas Multiple Award Schedule (TXMAS)
Cooperative Contract No. TXMAS-6-840160.
The overall project cost is expected to be:
Construction $1,753,584.00
Contingency, Staff $ 200,416.00
Total $1,954,000.00
M/WBE Office: A waiver for the goal for MBE subcontracting requirements was requested by the
Transportation and Public Works Department and approved by the M/WBE Office because the purchase
of goods and services is from sources where subcontracting or supplier opportunities are negligible.

COOPERATIVE PURCHASE - State law provides that a local government purchasing an item under a
cooperative purchasing Agreement satisfies State laws requiring that the local government seek
competitive bids for purchase of the item. TXMAS was established by the State of Texas to provide a list
of approved contracts that have been competitively bid and awarded by Federal, State or Local
Government entities to increase and simplify the purchasing power of governmental entities across the
State of Texas.
The project is physically located in COUNCIL DISTRICT 7, but will serve Fort Worth residents in ALL
COUNCIL DISTRICTS.

FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation
and adoption of the attached supplemental appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the assigned fund
balance of the Culture and Tourism Fund will exceed the minimum reserve, as outlined in the Financial
Management Policy Statements.
