HomeMy WebLinkAboutOrdinance 20668-03-2013 Ordinance No. 20668-03-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $25,968.60, DECREASING THE UNASSIGNED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF MAKING ADDITIONAL PAYMENTS TO THE TARRANT COUNTY TAX ASSESSOR — COLLECTOR FOR THE TAX ASSESSMENT AND COLLECTION SERVICES FOR FISCAL YEAR 2013; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of$25,968.60, decreasing the unassigned fund balance by the same amount, for the purpose of making additional payments to the Tarrant County Tax Assessor — Collector for the tax assessment and collection services for Fiscal Year 2013. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: On July 10, 2012, (M&C C-25674) the City Council authorized the execution of an Agreement between the Tarrant County Tax Assessor-Collector and the City of Fort Worth for providing assessment and collection services of ad valorem taxes levied by the City of Fort Worth for Fiscal Year 2013. That Mayor and Council Communication (M&C) authorized a total payment estimated in the amount of$301,590.00, which was based on providing service at a cost of$0.90 per account for an estimated 335,100 accounts. On January 14, 2013, the City of Fort Worth received the final invoice for assessment and collection services, which reflected an actual total of 363,954 accounts at a cost in the amount of$327,558.60. The per-account rate of$0.90 remained unchanged. Of the 28,854 additional accounts, the great majority(95 percent or more) are related to mineral interest (gas well) properties that represent approximately the amount of $140,000,000.00 in market value. Although the Tarrant Appraisal District's third party appraisal contractor provides data for most new accounts in the April - May timeframe, they also supplement the tax roll throughout the fall and winter, which is the reason for most of the unanticipated additional accounts that were added after the original M&C was approved.
