SECTION 00 41 00 — PROPOSAL
DEVELOPER AWARDED CONTRACTS
This proposal must not be removed from this book of Contract Documents.

PROPOSAL FOR: WATER, SANITARY SEWER, STORM DRAIN, PAVING, AND
STREET LIGHT IMPROVEMENTS

Includes the furnishing of all materials, equipment and labor for the installation of inedian
openings, left turn lane, water & sanitary sewer improvements and all necessary appurtenances
and incidental work to provide a complete and serviceable project designated as:
WATER, SANITARY SEWER STORM DRAIN PAVING. AND STREET LIGHT
IMPROVEMENTS TO SERVE HULEN TRACT, PHASE 1B
Pursuant to the foregoing Notice to Bidders', the undersigned Bidder, having thoroughly
examined the Contract Documents, including plans, special contract documents, the Technical
Specifications listed in this contract, the site of the project and understanding the amount of work
to be done, and the prevailing conditions, hereby proposes to do all the work, furnish all labor,
equipment and material except as specified to be furnished by the City, which is necessary to
fully complete the work as provided in the Plans and Contract Documents and subject to the
inspection and approval of the Director of the Department of Transportation & Public Works of
the City of Fort Worth, Texas; and binds himself upon acceptance of this Proposal to execute a
contract and furnish an approved Performance Bond, Payment Bond, Maintenance Bond, and
such other bonds, if any, as may be required by the Contract Documents for the performing and
completing of the said work. Contractor proposes to do the work within the time stated and for
the following sums:

After acceptance of this Proposal, the undersigned will execute the formal contract and will
deliver an approved Surety Bond and such other bonds as required by the Contract Documents,
for the faithful performance of the Contract. The attached bid security, if reyuired, is to become
the property of the Developer.
The successful bidder shall be required to perform the work in accord with these contract
documents and the technical specifications available in City of Fort Worth's Project Resources
website site (httE�s://a�s.f€�rtwc�rtl�te�as.�,fl��-'I'roiectRe�t����ces'} and incorporated herein and
made a part hereof for all purposes.
The undersigned assures that its employees and applicants for employment and those of any
labor organization, subcontractors, or employment agency in either furnishing or referring
employee applicants to the undersigned are not discriminated against as prohibited by the terms
of City Ordinance No. 7278 as amended by City Ordinance No. 7400.

4 THIS AGREEMENT, authorized on is made by and between the Developer,
5 Hawkins Famil■ Joint Venture, authorized to do business in Texas ("Developer") , and Conatser
6 Construction TX. L.P.. authorized to do business in Texas, acting by and through its duly
7 authorized representative, ("Contractor").
8 Developer and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as

Contractor shall complete all Work as specified or indicated in the Contract Documents for the

Article 2. PROJECT
The project for which the Work under the Contract Documents may be the whole or only a part is

Article 3. CONTRACT TIME
3.1 Time is of the essence.
All time limits for Milestones, if any, and Final Acceptance as stated in the Contract
Documents are of the essence to this Contract.

23 The Work will be complete for Final Acceptance within working days after the date
24 when the Contract Time commences to run as provided in Paragraph 12.04 of the Standard
25 City Conditions of the Construction Contract for Developer Awarded Projects.

Contractor recognizes that time is of the essence of this Agreement and that Developer
will suffer financial loss if the Work is not completed within the times specified in
Paragraph 3.2 above, plus any extension thereof allowed in accordance with Article 10 of
the Standard City Conditions of the Construction Contract for Developer Awarded
Projects. The Contractor also recognizes the delays, expense and difficulties involved in
proving in a legal proceeding the actual loss suffered by the Developer if the Work is not
completed on time. Accordingly, instead of requiring any such proof , Contractor agrees

that as liquidated damages for delay (but not as a penalty), Contractor shall pay
Developer Five-hundred Dollars ($500•001 for each day that expires after the time
specified in Paragraph 3.2 far Final Acceptance until the City issues the Final Letter of
Acceptance.

6.1 Contractor covenants and agrees to indemnify, hold harmless and defend, at its own
egpense, the city, its officers, servants and employees, from and against any and all
claims arising out of, or alleged to arise out of, the work and services to be performed
by the contractor, its officers, agents, employees, subcontractors, licenses or invitees
under this contract. This indemnification rovision is s eciiicall�� intended to o erate

This indemnity provision is intended to include, without limitation, indemnity for

PROVIDED, HOWEVER, if Principal shall faiE so to repair or reconstruct any timely
noticed defective Work, it is agreed that the Developer or City may cause any and all such
defective Work to be repaired and/or reconstructed with all associated costs thereof being borne
by the Principal and the Surety under this Maintenance Bond; and
PROVIDED FURTHER, that if any legal action be filed on this Bond, venue shall lie in
Tarrant County, Texas or the United States District Court for the Northern District of Texas, Fort
Worth Division; and
