AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
LOWE STREET, SITUATED IN THE P.M. TRUITT SURVEY,ABSTRACT
NO. 1508, FORT WORTH, TARRANT COUNTY, TEXAS, DEDICATED
BY THE PLAT OF SHAW-CLARKE ADDITION, AN ADDITION TO THE
CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, ACCORDING
TO THE PLAT RECORDED IN VOLUME 204, PAGE 54, OF THE PLAT
RECORDS OF TARRANT COUNTY, TEXAS, AND CONTAINING
APPROXIMATELY 8,051 SQUARE FEET OR 0.185 OF LAND MORE OR
LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Lowe Street, a sixty (60) foot wide right-of-way, situated in the P.M.
Truitt Survey, Abstract No. 1508, Fort Worth, Tarrant County, Texas, dedicated by the plat of
Shaw-Clarke Addition, an addition to the City of Fort Worth, Tarrant County, Texas, according
to the plat recorded in Volume 204, Page 54, of the Plat Records of Tarrant County, Texas and
containing 8,051 square feet or 0.185 acre of land more or less, and as more specifically
described in Exhibits A and B attached hereto and incorporated herein by reference be and the
same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.

All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
RIGHT-OF-WAY ABANDONMENT
BEING 0.185 acre of land situated in the P.M. TRUITT SURVEY, Abstract No. 1508, Fort
Worth, Tarrant County, Texas, and being a portion of Lowe Street (a 60 foot wide public right-of-
way) dedicated by the plat of SHAW-CLARKE ADDITION, to the City of Fort Worth, Tarrant
County, Texas, according to the plat recorded in Volume 204, Page 54, of the Plat Records of
Tarrant County, Texas. Said 0.185 acre of land being more particularly described by metes and
bounds as follows:
BEGINNING at a 5/8" iron rod found at the Southeast corner of Lot 2, of Block N, of said Shaw-
Clarke Addition, and said point lying at the intersection of the North right-of-way line of said
Lowe Street with the West right-of-way line of 511 Avenue (a 60 foot wide public right-of-way);
THENCE S 000 22' 50" E 60.00 feet, severing said Lowe Street, to a point lying at
the Northeast corner of Lot 3, Block M, of said Shaw-Clarke Addition, and said point lying at
the intersection of the South right-of-way line of said Lowe Street with the West right-of-way
line of said 5th Avenue;
THENCE S 890 37' 10" W 146.81 feet, along the South right-of-way line of said Lowe
Street and the North boundary line of said Block M, Shaw-Clarke Addition, to a point lying at
the Northwest corner of Lot 1, Block M, Shaw-Clarke Addition, and said point lying at the
intersection of the South right-of-way line of said Lowe Street with the Southeast right-of-
way line of a 20 foot wide public alley;
THENCE N 220 26' 00" E 65.09 feet, again severing said Lowe Street and continuing
along the Southeast right-of-way line of said 20 foot wide public alley, to a point lying at the
Southwest corner of Lot 3, Block N, of said Shaw-Clarke Addition;
THENCE N 89° 37' 10" E 121.57 feet, along the North right-of-way line of said Lowe
Street and the South boundary line of Block M, of said Shaw-Clarke Addition, to the POINT
OF BEGINNING containing 0.185 acre (8,051 square feet) of land.
Bearing Base: State Plane Coordinate System, Texas North Central Zone 4202, North
American Datum of 1983. Adjustment Realization 2011.

RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a Portion of Lowe Street to be replatted with the adjoining property for a single family residential lot;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Brittain and Crawford,LLC on behalf of AG3 Real Estate,LLC,has requested vacation of this portion of Lowe Street to be replatted as a new lot
for a new single family home.The City Plan Commission recommended approval of this request at its meeting on July 28,2021.An acceptable
final plat(FS-22-012)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
