WHEBEAS, the City of Fort Worth (CITY) and RJN Group, Inc.
(ENGINEER) made and entered into City Secretary Contract No. 40121, (thae
CONTRACT) which was authorized by M C C-2,,4176 on the 13th day of Apr 1,
2010 in the amount of $432,396. 00; and

NOW THEREFORE,, CITY and ENGINEER, acting herein by and through their
duly authorized representatives , enter into tae following agreement,
which amends the CONTRACT
Article I of the CONTRACT is amended to nclude! the a.dditional.
engineering services specified in a proposal dated January 24, 2 01. , a
copy of which is attached hereto and incorporated herein. The cast to
City for the additional design services to be performed by Engineer
totals $45, 750 . 00 .

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract,, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $852, 822 . 00 .

Per your direction, please find attached the revised Contract Amendment No. 5R request to, the
M-2,10 Sanitar-y Sower Relocation Project. 'This revised am ndrnont request represents the
previously agreed to amendment items sul raaittcd to the prior project manager in September 20 12,
That prior submission addressed significant extra services during construction phase work
performed from June 2011 to March 2012 during the construction of the M-210 Part 1 project.
This revised) amendment request now also seeks to recover labor and expenses associated with the
additional lid phase and construction services provided for M-2 10 Part 2 project to rnodify the
storm sewer outfa.11 plans and specifications after they were previously approved and accepted by
the Water department and to address geld stoma sewer con flicts discovered during construction.
Each of these amendment cost centers will he discussed in greater detail in the amendment
sr rni ries shown below.
M-210 PARTS I and 2— CONSTRUCTION PHASE SER VICES—EXTRA WORK
previously Performed Construction Phase Services on Part 1 from June 2011 through
March 2012: During this period, RJN produced and issued conformed Part 1 construction
documents J l conducted several prolec.,t site visits at the request of the City and RWD,- RJN
addressed extensive c'ontractor's R.F1 and shop drawing submittals; RJN conducted numerous
hydraulic analyses and assessments during Part I construction to verify the functionality of the
proposed siphon through the numerous and extensive field changes made by the Contractor; RJN
was also asked to run a comprehensive hydraulic analysis reflecting all of the field changes to
verify siphon performance, RJN was asked to produce 1-ar e cilanieter manhole details for Part l;
and lastlly, due to the last niinL to requested st ern outfall design changes, R.IN produced and

2. M-210 Part I Supplemental Site "Visits and Weekly Field Meetings (Task .
Due to schedule ule delays, numerous field, changes made and construction practices,
used by the Contractor, a large number Of Unbudgeted site visits, were made. F JN is
only seeking compensation fcr a total of three site visits/field meetings that were
conducted at the reCluest of the „."RW D (1/24/12 and 3/9/12) and the City (1/13/12).

4. M-210 part 1 Excessive RFI and Shop Drawing Reviews, (Ta,sk 61.IC;I)-,
Significant extra ti ire and efforts were required to address project RF1's and shop
drawings submitted by the contract or, S Jr. Louis, for review and comment. blue to
their schedule delays, a number of critical project materials DPE & FRP: pipe,
rebar and structural concrete) were ordered late and the Contractor requested
alternates be evaluated which was done and lied to several iterations of reviews and
correspondence for each. Additionally, many of their Submittals were incomplete
and again required multiple iterations to resolve. We also had a rlUniber of issues
associated with their pressure grout mixes, tunnel grouting plans and rir%seellaneous

6. M-210 Part 2 Conformed Documents (Task 6.1D)9 Due to the requested stot-n
sewer changes to the Part 2 plans and specifications during bidding, RJN was
directed to produce conf►rnied construction documents for contractor execution.

7. M-2110 Part 2, Issued, Revised, Plan, Sheets to address existing 54-inch storm
sewer alignment conflict discovered during construction (Task 6,.IE).- Due to the
discovery, of a majjor storm sewer and sanitary sewer alignment conflict, a revised
sanitary sewer alignment had to be developed and revised plans issued. Changes
included revising the storm sewer "as-built" infor-oration on the plans to match field
potholes conducted and realigning the proposed M-210 sanitary sewer. RJN's staff
hours, labor and expense costs incurred to perform this item are shown in the
summary cost table below.
8. M-2 10 'Part 3 Conformed Documents and the Production of As-built Documents
for Parts 2 and 3 (NEW OR FUTURE TASK - Task 6.IF).- Due new City
engineering contracting policies, R seeks the funding needed to produce
Conformed Documents for M-210 Part 3 during bidding and Services During
Construction (SDC) tasks. Additionally, funds are needed for RJN to produce the
required project as-built or record drawings for Parts 2 and 3. RJN's staff hours,
labor and expense costs incurred to perf rrn this item are shown in the surnmary cost
table below.
9. M-210 Part I — Hydraulic Analyses of Project Material and Field Design
Changes (Task 9.1H): As noted previously, extensive field changes occurred
throughout this project, necessitating recurring hydraulic calculation checks to
continually verify the impacts of those changes to the functionality of the proposed
sanitary sewer siphon crossing the 'I"rinity River. These field changes, and material
variations included: dropping the river crossing depth 5 ft from the dies,ign elevation
and then recalculating again when Survey verified the depth was proven to be actually
6-ft deeper; the deliveredi F[DPE pipe and fittings had smaller ID"s than approved in
the shop drawing submittals; field generated butt fused bead sizes exceeded
manufacturer's recornmendations; the proposed siphon pipes were reversed in the
tunnel; and the flow line elevation at siphon box two ('S B,#2) was 0.35 ft lower than
the design elevation. MlmerOUS intermediate siphon, hydraulic calculations Nvere

tile construction phase of Part I, the Contractor was unable to submit certified
