HomeMy WebLinkAboutOrdinance 17070-07-2006Ordinance Na. 1'70'10-07-2006 AN ORDINANCE INCREASING APPROPRIATIONS IN THE GENERAL FUND 1N THE AMOUNT OF $42,280 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING CHANGE ORDER NO. 2 TO CITY SECRETARY CONTRACT NO. 32558 (M&C C-21437, SEPTEMEiER 27, 2045) WITH J & J CONSTRUCTION, ING_ TO REPLACE PLAYGROUND STRUCTURE DESTROYED BY FIRE AT ENGLIWOOD PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THfS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES 1N CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City depar#ments for Fiscal Year 2005- 2406 in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $42,280 and decreasing the unreserved, undesignated fund balance by the same amount, for the purpose of funding Changer Order No. 2 to City Secretary Contract No. 32596 (M8~C C-21037, September 27, 2045) with J & J Construction, Inc. to replace playground structure destroyed by fire at l:nglewaad Park. SECTION 2. That should any portion, section ar part c~fi a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, apinian ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Nn. 16582 and all other ordinances and appropriatians amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriatians are hereby expressly repealed. Approva! of Change Order No. 2 to Contract with J & J Construction Inc., for Play Structure Replacement at Englewood Park and Adopt Appropriation Ordinance RECOMIVIENDATION: It is recommended that the City Council: 1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the General Fund by $42,280.00 and reducing the General Fund balance by the same amount; and 2. Authorize the City manager to execute a Change Order Nn. 2 to Contract with J & J Construction Inc., {City Contract No. 32596} in the amount of $42,280.00 to replace playground structure destroyed by fire at Englewood Park. DISCUSSION: On September 27, 2005, (M&C G21037) the City Council authorized the award of a constructian contract with J & J Hardscape Construction Inc., in the amount of $22'!,0'15.00 funded from the 2004 capital improvement program for Playground Renovations at Englewood, Sycamore and Tandy Hills Parks. Upon construction completion on May 22, 2006, final inspection was held for all three sites with all corrective items completed on June 2, 2006. However, on June 4, 2006, the playground structure at Englewood Park was burned. Parks and Community Services Department determined that the playground structure was a total loss and removed it from the site for public safety reasons. This Change Order includes the purchase and installation of a new playground structure. The damage to the playground structure does not exceed the deductible for the City's property insurance policy. In accordance to the City's M/VVBE Ordinance, no additional MIWBE participation is required since the change order amount is less than $50,000.00 Englewood Park is located in COUNCIL DISTRICT 5. FISCAL INFORMATIONlCERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the General Fund.
