HomeMy WebLinkAboutOrdinance 25453-04-2022 ORDINANCE NO.25453-04-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF$3,089,528.00,TRANSFERRED FROM AVAILABLE FUNDS IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING SYCAMORE CREEK INTERCEPTOR IMPROVEMENT PROJECT (CITY PROJECT NO. CO2200); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$3,089,528.00, transferred from available funds in the Water and Sewer Fund,for the purpose of funding the Sycamore Creek Interceptor Improvement project(City Project No.CO2200). SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize execution of a contract with Insituform Technologies,LLC.,in the amount of$2,695,235.50 for the Sycamore Creek Interceptor Improvement;and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$3,089,528.00,transferred from available funds in the Water and Sewer Fund,to fund the Sycamore Creek Interceptor Improvement project(City Project No.CO2200)to effect a portion of Water's contribution to the Fiscal Years 2022-2026 Capital Improvement Program. DISCUSSION: The Sycamore Creek Interceptor Improvement was advertised for bid on December 23,2021 and December 30,2021 in the Fort Worth Star- Telegram.On January 27,2022 the following bids were received. In addition to the contract cost,$259,530.00 is required for project management,inspection and material testing and$134,762.50 is provided for project contingency. This project will have no impact on the Water Department's operating budget when completed.The project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. Business Equity: Insituform Technologies, LLC is in compliance with the City's Business Equity Ordinance by committing to 10 percent Business Equity participation on this project.The City's Business Equity goal on this project is nine percent. The project is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified-All Funds within the W&S Capital Project Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the W&S Capital Projects Fund for the Sycamore Creek Interceptor Imp project.Prior to any expenditure being incurred,the Water Department has the responsibility of verifying the availability of funds.
