Home My WebLink AboutResolution 4196-04-2013 A Resolution NO. 4196-04-2013 A RESOLUTION AUTHORIZING THE EXECUTION OF AMENDMENT NUMBER 1 TO THE LOCAL PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION TO TERMINATE THE FUNDING AGREEMENT; AND EXECUTE A NEW LOCAL PROJECT ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION AND TARRANT COUNTY IN THE AMOUNT OF $6,288,244.00 FOR IMPROVEMENTS TO EAST I" STREET BETWEEN BEACH STREET AND OAKLAND BOULEVARD WHEREAS, A Master Funding Agreement between the City of Fort Wortli and the Texas Department of Transportation ("State") has been adopted and states the general terms and conditions for transportation projects developed through a Local Project Advanced Funding Agreement (LPAFA); and WHEREAS, the Texas Transportation Commission passed Minute Order 110266, dated October 27, 2005 that provides for the development of, and funding for, the roadway project described herein; and WHEREAS, the State and City of Fort Worth executed a Local Project Advance Funding Agreement in 2006 for the reconstruction of East I` Street between Beach Street and Oakland Boulevard; and WHEREAS, In 2006, Tarrant County voters approved a comprehensive bond program designed to fund needed improvements to the countywide transportation system, which included $1,723,500.00 for East I" Street between Beach Street and Oakland Boulevard; and WHEREAS, the City of Fort Worth desires to execute Amendment Number I of the Local Project Advance Funding Agreement with the State to terminate the 2006 funding agreement; and WHEREAS, the State, Tarrant County and City of' Fort Worth desire to execute a new funding agreement allowing City participation in the amount of $1,857,966.00, Tarrant County participation in an amount of $1,723,500.00, State participation $333,058.00 and Federal participation $2,373,720.00 for construction of East I" Street from 2-lanes to 4-lanes divided between Beach Street and Oakland Boulevard for a total funding of $6,288,244.00. F2RTWORT Resolution No. 4196-04-2013 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: The City Manager or his designee is authorized to execute Amendment Number I of the Local Transportation Project Advance Funding Agreement (LPAFA) with the Texas Department of Transportation ("State") terminating the 2006 LPAFA and execute a new LPAFA with the State and Tarrant County in the amount of $6,288,244.00 for the reconstruction of East I" Street from 2-lanes to 4-lanes divided between Beach Street and Oakland Boulevard. Adopt the attached resolution authorizing execution of Amendment No. 1 to terminate the 2006 Local Project Advance Funding Agreement (M&C C-21412) and authorizing the execution of a Local Project Advance Funding Agreement with the Texas Department of Transportation and Tarrant County in the amount of$6,288,244.00 for improvements to East First Street between Oakland Boulevard and Beach Street; and 2. Authorize payment to Texas Department of Transportation in the amount of$622,940.00 for costs related to improvements to East First Street, in accordance with the Local Project Advance Funding Agreement. DISCUSSION: Execution of a Local Project Advanced Funding Agreement (LPAFA) with Texas Department of Transportation and Tarrant County will provide Federal, State and Tarrant County funds as shown in Table 1 to reconstruct East First Street from two-lanes to four-lanes divided between Beach Street and Oakland Boulevard which is included as an arterial project in the 2004 Capital Improvement Program. Table 2 lists the previous LPAFA executed in 2006 that will be terminated through this action that included only TxDOT funding participation. These funds will be recorded as cash being held by others for internal accounting purposes, and once construction begins, funds will be expended based on progress reports as they are received from TxDOT. This project is located in COUNCIL DISTRICT 4, Mapsco 64S, 64T, 64U, and 64V.
