CSC No.55195-A2 AMENDMENT No . 2 TO CITY SECRETARY CONTRACT No . 55195 WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 55195, (the CONTRACT) which was authorized by M&C 21-0054 on the 12th day of January, 2021 in the amount of $546,302 . 00; and WHEREAS , the CONTRACT was subsequently revised by Amendment No. 1 in the amount of $561,543 . 00 authorized by M&C 21-0764 on September 28th, 2021; and WHEREAS, the CONTRACT involves engineering services for the following project: Southside IV Pump Station and Hydropneumatic Tank; and WHEREAS , it has become necessary to execute Amendment No. 2 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE , CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $18,184. 00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,126, 029. 00. 3 . Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. WORK TO BE PERFORMED Additional design for a new pressure sustaining valve (PSV) as required to provide a second water line connection and back feed (up to 250 linear feet) along Cavanna Dr. between the McPherson Village Phase 3 and Panther Heights developments. All assumptions and additional services not included in the scope of services remain per the original contract and its amendments. No general or resident representation is included. Task 1. Additional PSV Final Design Task 2. Additional PSV Survey and Easements TASK 1. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT). The ENGINEER will provide final design (90%-100%) for up to 250 LF of additional 8" -12" water main connecting Tract 9 to Tract 10, providing a back feed and loop to the SSIV pressure plane. This water line will cross the ONCOR right-of-way and connect two existing water line stub-outs along Cavanna Drive. The ENGINEER will coordinate with ONCOR to design the water line crossing according to ONCOR encroachment requirements and draft easements that meet ONCOR exhibit requirements. ASSUMPTIONS • No work will commence prior to receiving written NTP • No conceptual or preliminary design will be provided. • No additional meetings will be attended. No separate design package submittals will be provided. Additional design deliverable will include: • Up to 1 additional plan sheet added to the plan set for the SSIV flow transfer station • Up to 1 additional special detail sheet for connections to existing lines added to the plan set for the SSIV flow transfer station • Edits of the City Standard Specifications as required for special designs. • Costs for the additional pipeline construction will be included in the PSV OPCC provided for 90% and 100% designs, No separate OPCC will be provided. • No additional bid phase services will be provided • No additional construction phase services will be provided. DELIVERABLES • 90% design plans and specifications as described in the assumptions. • 100% construction plans and specifications as described in the assumptions. • Conformed construction documents (if applicable) as described in the assumptions. • Record Drawings on Mylar of plans described in the assumptions. TASK 2. SURVEY AND ROW/EASEMENT SERVICES. ENGINEER will support and perform activities related to ROW and land as outlined below, per scoping direction and guidance from the CITY's Project Manager. 2.1 Right-of-Way Research • The ENGINEER shall determine rights-of-way, easements needs for construction of the project. Required temporary and permanent easements will be identified based on available information and recommendations will be made for approval by the CITY. 2.2 Right-of-Way/Easement Preparation and Submittal. • The ENGINEER shall prepare documents to be used to obtain right-of-way and permanent and/or temporary easements required to construct the improvements. • The ENGINEER shall submit the right-of-way and/or easement documents to CITY PM for real property acquisition II City of Fort Worth,Texas Attachment A PMO Release Date:08.1.2014 Page 2 of 3 ATTACHMENT A AMENDMENT NO2FOR SOUTHSIDE IV PUMP STATION AND HYDROPNEUMATIC TANK CITY PROJECT NO.:103116 2.3 Design Survey • ENGINEER will perform field surveys to collect horizontal and vertical elevations and other information needed by ENGINEER in design and preparation of plans for the project. Information gathered during the survey shall include topographic data, elevations of all sanitary and adjacent storm sewers, rim/invert elevations, location of buried utilities, structures, trees (measure caliper, identify overall canopy, and have qualified arborist identify species of trees), and other features relevant to the final plan sheets. Existing drainage at intersections will be verified by field surveys. Spot elevations will be shown on intersection layouts with cross slope to fit intersecting grade lines. ASSUMPTIONS • Up to 2 Easements or right-of-way documents will be provided for ONCOR ROW and Rock Creek. • Up to 2 Temporary right-of-entry documents will be provided for ONCOR ROW and Rock Creek. • Right-of-Way research and mapping includes review of property/right-of-way records based on current internet based Tarrant Appraisal District (TAD) information available at the start of the project and available on-ground property information (i.e. iron rods, fences, stakes, etc.). It does not include effort for chain of title research, parent track research, additional research for easements not included in the TAD, right-of-way takings, easement vacations and abandonments, right-of-way vacations, and street closures. • No Temporary Right of Entry will be provided. • Up to 250 LF of additional survey for along Cavanna Drive, crossing the ONCOR right- of-way will be provided. No intersections will be surveyed. DELIVERABLES • Easement exhibits and meets and bounds provided on CITY forms. • Copies of field survey data and notes signed and sealed by a licensed surveyor. • Drawing of the project layout with dimensions and coordinate list. ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES Additional Services not included in the existing Scope of Services — CITY and ENGINEER agree that the following services are beyond the Scope of Services described in the tasks above. However, ENGINEER can provide these services, if needed, upon the CITY's written request. Any additional amounts paid to the ENGINEER as a result of any material change to the Scope of the Project shall be agreed upon in writing by both parties before the services are performed.
