TO CITY SECRETARY CONTRACT No . 50312
WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols,
Inc. , (ENGINEER) made and entered into City Secretary Contract No. 50312 ,
(the CONTRACT) which was authorized on the 30th day of January, 2018 ( M&C
C-28566) in the amount of $3,099,361 . 00; and
WHEREAS, the CONTRACT was subsequently revised by Amendment No. 1
in the amount of $229,755.00 authorized by M&C C-29067 on March 19th,
2019 and Amendment No. 2 in the amount of $366,004 .00 authorized by M&C
C-29178 on July 25th, 2019 and Amendment No. 3 in the amount of
$211,344 . 00 authorized by M&C 20-0137 on March 3rd,2020 and Amendment No.
4 in -the amount of $392, 668 .00 authorized by M&C 20-0460 on June
23rd,2020; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Lake Arlington Lift Station and Force Main; and
WHEREAS, it has become necessary to execute Amendment No. 5 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $323,249. 00.
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $4, 622,381. 00.
3 .
All other provisions of the Contract, which are not expressly

Part 1- Parcels 11-14(Coyel)Tunnel Redesign
Description: Extend the US Hwy 287 tunnel to cross the Coyel auto salvage yard properties.The City
prefers to tunnel beneath the auto salvage yard to avoid paying and coordinating for the removal of the
scrap cars required for open cut construction.The tunnel access shaft will be removed from Parcel 14
(Coyel)and placed on Parcel 11 (Rafah Real Estate).
• Coordinate alignment lowering and tunnel redesign with Gresham-Smith (GS)
• Redesign tunnel (GS)
o Revise 1 plan sheet
o Add 2 tunnel extension plan sheets
• Coordinate open cut plan and profile with the redesigned tunnel section. Incorporate tunnel
redesign into main plan and profile.

Description: Realign the plan and profile across the proposed Enchanted Bay(South)subdivision to
follow the future street right-of-way. FNI will need updated plans from the developer's engineer to
coordinate utility crossings and final plan and profile.

Changes from previous assumptions discussed:FNI previously coordinated with the developer's
engineer on a proposed realignment,The developer has since revised the plat layout.The new layout
requires a completely new re-alignment.This new re-alignment is longer than the original re-alignment.
There are 2 additional proposed TCEs with this re-alignment.Additional sheets that need to major
updates due to the revised re-alignment on the front side of the plan set are included.
• Coordination with developer's engineer(file sharing,checking, and cleanup) required for the
new re-alignment.
• Coordination with developer's contractor for construction access and timelines,
• Provide topographic survey for up to 1,500 LF of new alignment.
• Coordination with design team, including traffic control,erosion control,
environmental/archaeological,tunneling, and odor control to update corresponding plans as
needed

TASK 3a
Part 2—Aerial Crossing Redesign
Description: Lower the Lake Arlington aerial pipeline crossing.This will remove the high point,
specifically the sewer CAV and its enclosure,which was required to contain wastewater seepage from
the air valve. FW Water Field Operations is concerned about access for maintenance during high lake
level periods. FNI will study and coordinate design of a lowered crossing in accordance with the new
Nationwide Permit 58 (NWP 58).
The use of Nationwide Permit 12(NWP 12; Utility Lines)was recommended in the Tech Memo to
authorize proposed impacts to waters of the U.S., as well as strategies to avoid NWP 12 pre-construction
notification (PCN)triggers. In 2021,the U.S.Army Corps of Engineers(USACE) reissued and modified
several NWPs, including NWP 12,which is currently available for oil and natural gas pipeline activities
only.The USACE issued NWP 58(Utility Line Activities for Water and Other Substances)on March 15,
2021. NWP 58 differs from the 2017 version of NWP 12 in several ways, including a reduction in PCN
triggers. FW Water will consider the redesign of an aerial crossing over Lake Arlington to a crossing at
the normal pool elevation,which would previously have triggered NWP 12 PCN submittal.
• Environmental coordination on NWP 58 and addendum to the 2019 Lake Arlington Force Main
Tech Memo to evaluate the use of NWP 58 and design implications for the Lake Arlington
crossing.
o Work with the design team to implement changes under the NWP 58.
• Team coordination (structural,environmental,and erosion control)
• Redesign of the vertical alignment across the lake

• Structural recalculation and possible redesign of casing and piers due to increased forces/more

Part 2—Vortex Manhole&RJN Gravity Main Incorporation
Description: RJN plans for the Rosedale/SH 303 gravity main crossing, near the end of the force main,
will be incorporated into the Part 2 plans and specifications. RJN is also recommending the relocation of
the vortex manhole at the end of the force main to accommodate a proposed future gravity main (not
currently in design).
• Coordination with RJN on the relocation of the vortex manhole and force main/gravity main
connection.

or review of the draft and final easement documents included in the original scope of work and existing
amendments,

• Estimated effort already spent is 121 hours.This effort includes extensive responses FNI
provided to landowner,developer engineer,or attorney questions;site visits specifically related
to easements and landowner requests; creating maps and exhibits to assist in easement
acquisition and for landowner coordination.
o Estimated additional effort still needed is 62 hours.This effort is anticipated for review of the
final agreement terms for all easements,application of terms and landowner comments to the
plans, revisions to easements,and any final landowner coordination required for outstanding
parcels. Known effort is listed below.
o Coordination for landowners that are still in negotiation and respond to their questions
and requests as needed until easements are recorded.
o Revision of 1 temporary construction easement document for Parcel 20.
o Coordination with P21-P23 owners and incorporation of their noted storm drains and
other agreement requirements.
o Coordination with P27—new development(Enchanted Bay(North))that is currently
under construction.
o Revision 1 temporary construction easement document for Parcel 32(Lakeview RV
Park). Incorporate landowner requirements into plans.
o Incorporate P34-1335 landowner requirements into plans.
o Incorporate P57 landowner requirements into plans.
o Coordination with P58-proposed RV park.
TASK 5
Additional PM and General Representation
Description: Extension of time and effort to complete monthly project reporting, construction general
representation and resident representation services for both the force main and lift station based on
current project status and schedule.
• PM reporting extension of 22 months and force main design extension of 6 months.
o September 2021 was the end of the scheduled 36 reporting periods
o Design is anticipated to be complete in March 2022, pending easement acquisition,
developer coordination, and archaeological survey.
o See updated schedule for details.
Lift Station RPR extension of 3 months
o Drawing reviews began 9/2020—18 months ends 2/2022.Anticipated FNI end is
5/2/2022.
Additional General Representation
o Lift Station construction general representation extension of 3 months.
o Additional general rep effort is detailed in Table 1 below.
• Expected effort for the force mains is based on the number of submittals
required by the 90%project manual.
• Expected effort for the lift station is based on the number of submittals already
received plus the anticipated remaining submittals.

and Adopt the Attached Appropriation Ordinance to Effect a Portion of Water's Contribution to the Fiscal
Years 2022-2026 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1.Authorize execution of Amendment No. 5, in the amount of$323,249.00, to City Secretary Contract
No. 50312, an engineering agreement with Freese and Nichols, Inc. for the Lake Arlington Lift Station
and Force Main project for a revised contract amount of$4,622,381.00; and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the
Water & Sewer Capital Project 2018 Fund by increasing estimated receipts and appropriations in the
amount of$323,249.00 for Lake Arlington Lift Station and Force Main (City Project No.100995) and
decreasing estimated receipts and appropriations in the Unspecified project (City Project No.
UNSPEC) by the same amount to effect a portion of Water's contribution to the Fiscal Years 2022-
2026 Capital Improvement Program.
DISCUSSION:
On January 30, 2018, Mayor and Council Communication (M&C) C-28566 authorized an engineering
agreement with Freese and Nichols, Inc., (City Secretary Contract No. 50312) in the amount of
$3,099,361.00 for the preparation of plans and specifications for the Lake Arlington Lift Station and Force
Main project. The agreement was subsequent revised by Amendment No. 1 in the amount of$229,755.00
(M&C C-29067, March 19, 2019)that provided for the design of 1,000 linear foot aerial crossing of the force
main across Lake Arlington additional geotechnical investigations at 8 locations along the force main;
Amendment No. 2 in the amount of$366,004.00 (M&C C-29178, July 25, 2019)that provided for the
preparation of plans and specifications for additional tunneling design, archeological survey, additional
survey along Quail Road, lead testing along lift station access road and design for erosion improvements on
Village Creek Tributary near Salt Rd; Amendment No. 3 in the amount of$211,344.00 (M&C 20-0137,
March 3, 2020)that provided for preparation of additional temporary and permanent easement documents,
urban forestry permit application, and additional subsurface utility engineering (SUE) services, and
Amendment No. 4 in the amount of$392,668.00 (M&C 20-0460, June 32, 2020) that provided for resident
project representation (RPR) and start up assistance on Lake Arlington Lift Station.
Amendment No. 5 will provide for additional easement acquisition assistance, plan redesigns, aerial
crossing design and additional resident project representation support.
It is the practice of the Water Department to appropriate its Capital Improvement Program (CIP) plan
throughout the fiscal year as projects commence, additional funding needs are identified, and to comply with
bond covenants. The actions in the M&C will appropriate funds in support of the Water's portion of the City
of Fort Worth's Fiscal Years 2022-2026 Capital Improvement Program, as follows:

Funding is currently available in the Unspecified-All Funds project within the W&S Capital Project 2018
Fund for the purpose of funding the Lake Arlington, FM, LS and SS project.
Business Equity: Freese and Nichols, Inc., is in compliance with the City's BDE Ordinance by committing
to 20.81 percent SBE participation on this project. The City's SBE goal on this project is 10 percent.
The project is located in COUNCIL DISTRICT 5 and CITY OF KENNEDALE.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified-All Fund project within
the W&S Capital Proj 2018 Fund and upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the W&S Capital Proj 2018 Fund for the Lake
Arlington, FM, LS and SS project to support the approval of the above recommendations and execution of
