HomeMy WebLinkAboutResolution 5554-04-2022 A Resolution NO. 5554-04-2022 AUTHORIZE APPLICATION FOR AND AUTHORIZE ACCEPTANCE OF THE GRANT PROJECT FOR THE VICTIMS OF CRIME ACT FORMULA GRANT PROGRAM FROM THE STATE OF TEXAS,OFFICE OF THE GOVERNOR,PUBLIC SAFETY OFFICE AND MAKE ASSURANCES REQUIRED BY THE PUBLIC SAFETY OFFICE OF THE GOVERNOR'S OFFICE WHEREAS, the Public Safety Office of the Governor's Office (PSO) funds grant projects throughout the state; and WHEREAS, the City Council of the City of Fort Worth finds that it is in the best interest of the citizens of Fort Worth to utilize grant funds from the PSO for the Fort Worth Police Department Victim Assistance Unit for an additional Victim Assistance Specialist Position and a High Risk Family Violence Specialist Position during the Fiscal Year 2023 Grant Cycle; and WHEREAS, release of the grant funds is contingent upon the completion of specified requirements set by the PSO, including the passage of a Resolution by the City Council containing certain assurances. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS,THAT: 1. The City Council approves the above-referenced grant project from the Victims of Crime Act Formula Grant Program from the State of Texas, Office of the Governor, Public Safety Office; 2. The City Council designates the City Manager, through the Deputy City Manager, to apply for, accept, reject, alter or terminate this grant on behalf of the City; and 3. In the event of loss or misuse of the PSO grant funds, the City assures that the funds will be returned to the PSO in full. Repeal appropriation resolution#5340-02-2021 previously attached to Mayor and Council Communication 21-0095 approved on February 2,2021; 2. Repeal appropriation resolution#5536-03-2022 previously attached to Mayor and Council Communication 22-0170 approved on March 8, 2022;and 3. Authorize the execution of a grant agreement with the Office of the Governor,Victims of Crime Act Grant to Occur in Fiscal Year 2022 and 2023. DISCUSSION: On February 2,2021,City Council approved Mayor and Council Communication(M&C)21-0095 and resolution#5340-02-2021 for application to and acceptance of the Victims of Crime Act Grant for Fiscal Year 2022. On March 8th,2022, City Council approved M&C 22-0170 and resolution#5536-03-2022 for application to and acceptance of the Victims of Crime Act Grant for Fiscal Year 2023. The appropriation resolutions attached to M&C 21-0095 and M&C 22-0170 state"The City Council designates the City Manager,through the Deputy City Manager for Police,to apply for,accept, reject,alter or terminate this grant on behalf of the City".Currently,the Police Department (PD)has Assistant City Manager Fernando Costa as its authorized official for the Victims of Crime Act Grant."Deputy City Manager'needs to be replaced with"Assistant City Manager"for the Office of the Governor to accept the resolution. City Council is being asked to repeal the incorrect resolutions and enact the attached resolutions for M&C 21-0095 and M&C 22-0170. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:State of Texas Office of the Governor FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the current operating budget,as appropriated, in the Grants Operating Federal Fund.The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds.This is a reimbursement grant.
