HomeMy WebLinkAboutOrdinance 25481-04-2022 Ordinance No,25481-04-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND, SUBJECT TO RECEIPT OF THE GRANT, IN THE AMOUNT OF$34,500.00, FOR THE PURPOSE OF FUNDING THE EXTENSION OF THE U.S. DEPARTMENT OF JUSTICE, THROUGH THE CITY OF DALLAS, INTERNET CRIMES AGAINST CHILDREN TASK FORCE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, subject to the receipt of the grant, in the amount of$35,000.00, for the purpose of funding the extension of the U.S. Department of Justice, through the City of Dallas, Internet Crimes Against Children Task Force. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the acceptance of an additional award of$34,500.00 in fiscal year 2022 supplemental funds from the United States Department of Justice, City of Dallas, Internet Crimes Against Children Task Force; 2. Authorize continued acceptance of the fiscal year 2020 Internet Crimes Against Children Task Force Memorandum of Understanding and the Internet Crimes Against Children Standard Operating Procedures; 3. Extend the terms of the fiscal year 2020 contract with the City of Dallas to September 30,2022;and 4. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund,subject to the receipt of the grant, in the amount of$34,500.00,for the purpose of funding the extension of the United States Department of Justice,through the City of Dallas,Internet Crimes Against Children Task Force. DISCUSSION: The City of Dallas,on behalf of its Police Department,applied for and was awarded a grant for fiscal year(FY)2020 from the United States (U.S.)Department of Justice through the Office of Juvenile Justice and Delinquency Prevention under the Federal Missing and Exploited Children's Program to fund the Internet Crimes Against Children Task Force(OJJDP Grant 2019-MC-FX-K056).The City of Fort Worth Police Department is part of this Task Force that targets intemet crimes against children,including child solicitation and child pornography. The City of Fort Worth accepted the FY 2020 Internet Crimes Against Children grant through M&C 20-0181 on April 7,2020,and an additional extension through M&C 21-0214 on March 23,2021.The City of Dallas has received FY 2022 supplemental funding for the Task Force from the U.S. Department of Justice and has extended the end date from September 30,2021,to a new end date of September 30,2022.The City of Fort Worth will receive$34,500.00 of the supplemental funding for FY 2022. By signing the letter of acceptance,the supplemental funds,terms of the initial memorandum of understanding with the City of Dallas,the Internet Crimes Against Children Standard Operating Procedures,and the extended term of the FY 2020 contract will apply.The funds will be used for officer overtime,training,travel,and equipment used to combat intemet crimes against children. Indirect Costs are not allowed under this agreement.The City will be paid on a reimbursement basis. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education: United States Department of Justice, City of Dallas FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current operating budget,as appropriated, in the Grants Operating Federal Fund.The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds.This is a reimbursement grant.
