Beck, District 9 Staff Present: David Cooke, City Manager Laetitia Brown, Interim City Attorney Jannette Goodall, City Secretary Dana Burghdoff, Assistant City Manager Fernando Costa, Assistant City Manager Valerie Washington, Assistant City Manager Leann Guzman, Deputy City Attorney Manya Shorr, Interim Assistant City Manager Reginald Zeno, Financial Management Services (CFO) Whitney Rodriguez, Mayor's Chief of Staff Carlo Capua, Mayor's Deputy Chief of Staff Denis McElroy, Sr. Assistant City Attorney Chris Mosley, Sr. Assistant City Attorney Mike Crum, Director, Public Events Robert Sturns, Director, Economic Development John Samford, Assistant Director, Finance and City Treasurer Call to Order After proper notice given pursuant to the Texas Open Meetings Act, with a quorum of the City Council Members present, Mayor Parker called the Executive Session Meeting to order and the Fort Worth City Council convened into closed Executive Session at 9:03 a.m. on Tuesday, March 29, 2022, in the City Council Conference Room 2020 of the Fort Worth City Hall to discuss matters pertaining to the following: The City Council will conduct a closed meeting in order to discuss matters permitted by the following sections of Chapter 551 of the Texas Government Code: CITY MANAGER 1. Section 551.072, DELIBERATIONS REGARDING REAL PROPERTY Deliberate the purchase, sale, lease or value of real property where deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third party. 2. Section 551.087, DELIBERATIONS REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS Deliberate the commercial or financial information or the offer of a financial or other incentive to a business prospect. CITY OF FORT WORTH, TEXAS CLOSED EXECUTIVE SESSION MARCH 29, 2022 PAGE 2 of 2 Mayor Parker recessed the executive session at 10:03 a.m. Mayor Parker called the executive session back to order at 1:14 p.m. CITY ATTORNEY 1. Section 551.071, CONSULTATION WITH ATTORNEY To seek the advice of its attorney about pending or contemplated litigation, settlement offers, or any matter in which the duty of the attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act. [Tex. Govt. Code §551.071]: a. Legal issues concerning Cause Number 02-17-00185-CV; Court of Appeals for the Second District of Texas; The City of Fort Worth and David Cooke, in His Official Capacity as Fort Worth City Manager v. Stephanie Lynn Rylie, Texas C&D Amusements, Inc. and Brian and Lisa Scott D/B/A TSCA and D/B/A River Bottom Pub; b. Legal issues concerning to Cause Numbers 21-1048, 21-1055, 21-1227; U.S. Court of Appeals for the District of Columbia; Sierra Club, Don't Waste Michigan, Citizens' Environmental Coalition, Citizens for alternatives to Chemical Contamination, Nuclear Energy Information service, Public Citizen, Inc., San Luis Obispo Mothers for Peace, Sustainable Energy and Economic Development Coalition. v. United States Nuclear Regulatory Commission and United States of America; c. Legal issues concerning Cause Number 4:17-CV-0120-P, Northern District of Texas; Jacqueline Craig, Individually, and on behalf of Minors, J.H., K.H., and A.C. and Brea Hymond v. City of Fort Worth, William D. Martin and Itamar Vardi; d. Legal issues concerning David Bakutis, as Administrator for the Estate of Atatiana Jefferson v. Aaron Dean, et al. and Amber Carr, on behalf of minor, Z.C. v. Aaron Dean, et al (Cause No. 4:21-cv-oo665-Y consolidated with Civil Action No 4:21-cv-1053-Y); and e. Legal issues concerning Mary's Creek discharge permit status Postponed to next meeting With no further business to be conducted, Mayor Parker adjourned the meeting at 1:40 p.m. on Tuesday, March 29, 2022.
