AN ORDINANCE AMENDING PARAGRAPH 9 OF SECTION 27-19
OF CHAPTER 27 OF THE CODE OF THE CITY OF FORT WORTH
(1964) , AS AMENDED; DESIGNATING THE HOURS DURING
WHICH PARK AND RECREATION AREAS OF THE CITY OF FORT
WORTH LOCATED WITHIN OR WITHOUT THE CORPORATE LIMITS
OF SAID CITY SHALL BE OPEN TO THE PUBLIC; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; RE-
PEALING ALL CONFLICTING ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND NAMING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Paragraph 9 of Section 27-19 of Chapter 27 of the
Code of the City of Fort Worth (1964) , as amended, be and the
same is hereby amended so that hereafter same shall be and
read as follows:
9. It shall be unlawful for any person to enter
any portion of a park or recreation area which is
designated as restricted, or to enter any area
during the hours of the day when such area is not
open to the public or to enter at any time any park
and recreation area which is closed for the season.
Hours during which the area is open to the public
shall be posted by the Director of the Park and
Recreation Department. Unless otherwise posted by
the Director of the Park and Recreation Department,
the hours during which _parks are open to the public
are 7:00 o'clock A.M. to 11:30 P.M.
SECTION 2.
That this ordinance shall be cumulative of all provisions
of the Code of the City of Fort Worth (1964) , as amended, and
all other ordinances of the City of Fort Worth, except in those
instances where the provisions of this ordinance are in direct
conflict with the provisions of such Code or other ordinances,
in which instances said conflicting .provisions of such Code or
other ordinances are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordi-
nance shall be declared unconstitutional by the valid judg-
ment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 4.
That any person violating any of the provisions of this
ordinance shall be fined in any sum not to exceed Two Hundred
Dollars ($200) , and each day's violation thereof shall consti-
tute a separate offense.
SECTION 5.
That this ordinance shall become effective and be in
full force and effect from and after the date of its passage
and publication as required by law, and it is so ordained.
