AN ORDINANCE VACATING AND EXTINGUISHING ALL OF A
TWELVE FOOT WIDE ALLEY, SITUATED IN THE T. WHITE
SURVERY, ABSTRACT NO. 1636 IN THE CITY OF FORT WORTH,
LOCATED IN BLOCK 11, BROOKLYN HEIGHTS ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH, TEXAS, AS RECORDED
IN VOLUME 63, PAGE 13 OF THE PLAT RECORDS OF TARRANT
COUNTY, TEXAS; CONTAINING APPROXIMATELY 0.088 ACRE OF
LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS:
SECTION 1.
That all of a twelve foot alley, situated in the T. White Survey, Abstract Number
1636, Tarrant County, Texas, located in Block 11, Brooklyn Heights Addition, an
addition to the City of Fort Worth, as recorded in Volume 63, Page 13 of the Plat
Records of Tarrant County, Texas, and containing approximately 0.088 acre of land
more or less, and as more specifically described in Exhibits "A" and "B" attached
hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the right of way easement to the land in the above-described vacated street right of
way is hereby released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a tract of land situated in the T. White Survey, Abstract No. 1636, City of Fort Worth,
and being all of 12.00 foot alley situated in Block 11, Brooklyn Heights Addition, an addition to
the City of Fort Worth as recorded in Volume 63, Page 13, Plat Records, Tarrant County, Texas
and being more particularly described by metes and bounds as follows: (Bearings referenced to
the Texas cooperative RTK Network (NAD83 Texas North Central Zone 4202))
COMMENCING at a found 5/8 inch iron rod for the northeast corner of the intersection of Lovell
Street (a 60 foot Right-of-Way) and Kimzey Street (a 60 foot Right-of-Way) same being the
southwest corner of Lot 8 said Block 11;
THENCE North 00028'05" East with the east right-of-way line of said Kimzey Street, a distance
of 120.00 feet to a found 5/8 inch iron rod for the northwest corner of said Lot 8 and being the
POINT OF BEGINNING;
THENCE North 00'28'05" East continuing with the east right-of-way line of said Kimzey Street,
a distance of 12.00 feet to a found 60D Nail for the southeast corner of Lot 9, of said Block 11;
THENCE South 89031'55" East with the north line of the aforementioned alley and passing Lots
9-16, a distance of 320.00 feet to a found 5/8 inch iron rod for the southeast corner of Lot 16 of
said Block 11, same being in the west right-of-way line of Smiley Street (a 60 foot Right-of-
Way);
THENCE South 00'28'05" West with the west right-of-way line of said Smiley Street, a distance
of 12.00 feet to a found 5/8 inch iron rod for the northeast corner of Lot 1 of said Block 11;
THENCE North 89031'55" West with the south line of the aforesaid alley and passing Lots 1-8,
of said Block 11, a distance of 320.00 feet to the POINT OF BEGINNING and containing

Adopt Ordinance Vacating an Alley Between Kimzey Street and Smiley Street to Galen Medical, LLC, for
the Development of a Medical Office Building (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating an alley between Kimzey Street and Smiley Street to Galen
Medical, LLC, for the development of a Medical Office Building; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (Mayor and
Council Communication G-15624).
DISCUSSION:
Baird, Hampton and Brown, Inc., on behalf of Galen Medical, LLC, has requested the vacation of this alley
to replat it with the adjoining property for a new medical office building and adjacent parking lot. The City
Plan Commission recommended approval of this request at its meeting on December 21, 2012. An
acceptable replat (FS-012-162) has been received.
The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting
process. The City does not own land under or adjacent to the above referenced alley. Since no City
funds have been expended to purchase property or easement rights, collection of the fair market value or
any portion thereof is recommended by Staff to be waived.
This project is located in COUNCIL DISTRICT 9.

funds.
