BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE DP RENOVATING THE

SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the
Budget of the City Muougcr, there shall also be increased exhnnutcd receipts and appropriations in the
Culture and Toutism Fund in the amount of$562,000.00, decreasing the assigned Culture and Tourism fund
balance by the same amount, for the purpose of renovating the auditorium air handler and providing chilled
and hot water purnp redundancy ut the YV1l| Rogers Memorial Center.
SECTION 2.
That should any portion, 000|ioo or part of section of this ordinance be deoLucud iu*a|id, inoperative or
void for any reason byu court ofcompetent judodic1km, such decision, opinion or judgment shall iuonway
impair the remaining portions, sections, or pudo of f sections of this ordinance, which said remaining

SECTION 3.
That this ordinance obuU be uucuu]odve of Ordinance No. 20411-09'2012 and all other ordinances and
appropriations amending the uucoc except in those instances */bnro the provisions of this ordinance are in
direct conflict with such other ordinances and opprmpdudouu, in which iootuooe said conflicting provisions
n[said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT:
Adopt Supplemental Appropriation Ordinance Increasing Appropriations in the Culture and Tourism Fund in
the Amount of $562,000.00 and Decreasing the Assigned Culture and Tourism Fund Balance by the Same
Amount, Authorize Execution of a Contract with Johnson Controls, Inc., in the Amount of $476,951.00 to
Renovate the Auditorium Air Handler and Provide Chilled and Hot Water Pump Redundancy at the Will
Rogers Memorial Center and Provide for Contingency and Staff Costs for a Total Project Cost in the
Amount of $562,000.00 (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Culture and
Tourism Fund in the amount of$562,000.00 and decreasing the assigned Culture and Tourism fund
balance by the same amount; and
2. Authorize the execution of a contract with Johnson Controls, Inc., in the amount of$476,951.00 using a
Texas Multiple Award Schedule Contract No. TXMAS-6-840160 to renovate the auditorium air handler and
provide chilled and hot water pump redundancy at the Will Rogers Memorial Center.
DISCUSSION:
The Auditorium air handler needs new wall structure and mechanical device repair work and pump
redundancy is necessary as a single pump failure will result in the loss of heating and cooling capacity for
the Coliseum, Amon G. Carter Exhibit Building, Richardson-Bass Building and Auditorium. This work is
necessary to provide temperature comfort and back-up chilled and heated water pump system for the
patrons attending the many events at the Will Rogers Memorial Center.
PRICE ANALYSIS —The vendor prices were obtained using a Texas Multiple Award Schedule
Cooperative Contract Number TXMAS-6-840160.
The overall project cost is expected to be:
• Design ($14,500.00) previously funded
• Construction $ 476,951.00
• Contingency, Staff $ 85,049.00
• Total $ 562,000.00
M/WBE Office: A waiver for the goal for MBE/SBE subcontracting requirements was requested by the
Transportation and Public Works Department and approved by the M/WBE Office, in accordance with the
M/WBE or BIDE Ordinance, because the purchase of goods and services is from source(s) where

subcontracting or supplier opportunities are negligible.
COOPERATIVE PURCHASE — State Law provides that a local government purchasing an item under a
cooperative purchasing Agreement satisfies State laws requiring that the local government seek
competitive bids for purchase of the item. TXMAS was established by the State of Texas to provide a list
of approved contracts that have been competitively bid and awarded by Federal, State or Local
Government entities to increase and simplify the purchasing power of governmental entities across the
State of Texas.
The project is physically located in COUNCIL DISTRICT 7 but will serve Fort Worth residents in ALL
COUNCIL DISTRICTS.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation
and adoption of the attached supplemental appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the assigned fund
balance of the Culture and Tourism Fund will exceed the minimum reserve as outlined in the Financial
Management Policy Statements,
