HomeMy WebLinkAboutOrdinance 17080-08-2006Ordinance No. 17080-08-2005 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $303,002 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $334,580 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON CLOER DRIVE (WINFIELD AVE TO BOYD AVE} AND HARLANWOOD DRIVE (LYNNCREST DRIVE TO PRESTON HOLLOW ROAD} (CIP PROJECT NO. OD15D); PROVIDING FOR A Si=VERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $303,002 and the Sewer Capital Projects Fund in the amount of $334,580 from available funds for the purpose of funding a contract with McClendon Construction Company, Inc. for Pavement Reconstruction and Sanitary Sewer Replacement on Cloer Drive (Winfield Avenue to Boyd Avenue) and Harlanwaad Drive {Lynncrest Drive to Preston Hollow Road}. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $637,6$2.OD from the Water and Sewer Operating l=and to the Water Capital Projects l=and in the amount of $303,002,DD and Sewer Capital Projects Fund in the amount of $334,680.00; and 2. Adopt fhe attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in fhe amount of $3D3,002.00 and the Sewer Capital Projects Fund in the amount of $334,680.00, from available funds; and 3. Authorize fhe City Manager to execute a contratt with McClendon Construction Co. Int., in the amount of $t,286,824.25 far Pavement Reconstruction and Water and Sanitary Sewer Replacement an Glaer Drive {Winfield Avenue to Boyd Avenue) and Harlanwood Drive {Lynncrest Drive to Preston Hallow Road). DISCUSSION: The 2D04 Capital Improvement Program {CIP) includes funds far Pavement Reconstruction on Cloer Drive (Winfield Avenue to Bayd Avenue) and Harlanwood Drive {Lynncrest Drive to Preston Hollow Road). Street improvements include pavement reconstruction, cansti'uttion of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. The pavement reconstruction was designed based an two alternates: o Alternate "A" consists of a 6-inch hot mix asphalt tantrete (HMAC) pavement over 8-inch Time stabilized subgrade with ~-inch concrete curb and '18-inch gaffer. Alternate "B" consists of a 6-inch concrete pavement aver 6-inch lime stabilized subgrade with 7-inch Gancrete Curb. The project was advertised in the Commercial Retarder on April 2D and April 27, 2006. MiWBE -McClendon Cons#ruction Co., Inc., is in compliance with the City's M/WBE Ordinance by committing to12% MIWBE participafion and documenting good faith effort. The City's goof pn this project is 18%. Funding in the amount of $81,982.00 is included for associated water and sewer construction survey, material testing and inspection (wa#er $37,348.U0 and sewer $44,834.00). The contingency funds to cover change orders total $28,660.00 (water $13,862.00 and sewer $12,798.00). Funding in the amount of $71,090.65 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency funds for possible change orders for paving and drainage improvements total $25,000.00. This project is located in COUNCIL ©ISTRICT 3, Mapsco 75 V & Z and 90E.
