HomeMy WebLinkAboutOrdinance 25501-05-2022 Ordinance No. 25501-05-2022 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ALLIANCE AIRPORT CAPITAL FUND, IN THE AMOUNT OF $189,763.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE AFW TAXIWAY PAPA EXTENSION PHASE II PROJECT (CITY PROJECT NO. 103000); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Alliance Airport Capital Fund in the amount of$189,763.00, from available funds, for the purpose of funding the AFW Taxiway Papa Extension Phase 11 project(City Project No. 103000). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Alliance Airport Capital Fund in the amount of$189,763.00,from available funds,for the purpose of funding additional expenses on the AFW Taxiway Papa Extension Phase II project(City Project No. 103000)at City of Fort Worth Alliance Airport;and 2. Amend the Fiscal Years 2022-2026 Capital Improvement Program. DISCUSSION: This Mayor and Council Communication (M&C)seeks adoption of an appropriation ordinance to fund unexpected cost overruns,some of which are ineligible to be paid by the federal grant funds. On October 20,2020, M&C 20-0765,the City Council authorized the execution of a construction contract with Mario Sinacola and Sons Excavating, Inc.(Sinacola)in an amount up to$7,713,696.13 for the construction of Phase I of the Taxiway Papa Extension project(Project)at City of Fort Worth Alliance Airport(Airport).The Project is essentially complete but requires additional funding for additional costs,as described below. Staff has prepared Change Order No. 1 in the amount of$70,945.23 to accommodate changes in the Project that include,but are not limited to, the following: • Increased width to the fence line mow strip; • Unforeseen site conditions such as additional earthwork and rock removal; • Removal of previously unknown manhole; • Additional taxiway light fixtures,bases and conduit; • Obtaining access rights for a construction haul route;and • Changes related to Phase II of the Project beginning sooner than expected. The 149 calendar days added are due to weather as well as delays in obtaining access rights for the construction haul route. Phase I of the Project was funded by two separate Federal Aviation Administration(FAA)grants(City Project Nos. 102845& 103000).The Project as a whole was funded from FAA Discretionary dollars, but certain additional costs in the amount of$189,763.00 were incurred for delays in obtaining access rights for the re-established construction haul route,and are ineligible costs under the terms of the grants. Funding for these costs will be from the Alliance Airport Capital Fund.The breakdown of the Change Order is below: Additions1 $453,570.14 CreditsJ ($382,624.91)j Change Order No. 1 Amount $70,945.23j Funding is budgeted in the Cap Out-Imp Other Than Bldgs account of the Aviation Department's Muni Airport Grants Federal Fund. Funding was not included in the Fiscal Years 2022-2026 Capital Improvement Program(CIP)due to the charges being deemed ineligible after adoption of the CIP.The action in this M&C will amend the Fiscal Years 2022-2026 CIP as approved in connection with Ordinance 25073-09- 2021. City of Fort Worth Alliance Airport is located in COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Unspecified-All Funds project within the Alliance Airport Capital Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the Alliance Airport Capital Fund for the AFW Taxiway Papa Ext Phase 11 project to support the approval of the above recommendations and execution of the change order.
