AN ORDINANCE. INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $21,120.10 AND THE
SEWER CAPITAL PR0.31=CTS FUND iN THI AMOUNT DF $b,2$0.02 FROM AVAILABLE
FUNDS FOR THE PURPOSE OF FUNDING CHANGE ORDER ND. 3 TD CITY
SECRETARY CONTRACT NO. 31733 WITH AUSTIN BRIDGE & ROAD, L.P., FOR HMAC
SURFACE OVERLAY 2005-6 AT VARIOUS LOCATIONS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts alloca#ed to the various City departments for Fiscal Year 2005-2006 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $21,120.10 and the Sewer Gapital Projects Fund in the
amount of $5,280.02 from available funds for the purpose of funding Change Order Nn. 3 to City Secretary
Contract Na. 31733 with Austin Bridge & Raad, L. P., for HMAC Surface Overlay 2005-06 at various
locations.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdic#ian, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 1,582 and all other ordinances and appropriations
amending the same except in those instances where the previsions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION ~
ADOPTED AND EFFECTIVE: August 3. 2006
This ordinance shall take effect upon adoption.

Adopt an Appropriation Ordinance and Authorize Execution of Change Order No. 3 to Contract with
Austin Bridge & Road, L.P., for H.M.A.C. Surface Overlay 2005-6 at Various ~.QCatians
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to transfer $26,4DD.12 from the Water and Sewer Operating Fund to the
Water Capital Projects Fund in the amount of $21,12D.10 and Sewer Capital Projects Fund in the amaunt ofi
$5,280.D2;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Gapital Projects Fund in the amount of $21,120.10 and the Sewer Capital Projects Fund in the
amount of $5,280.D2, from available funds; and
3. Authorize the City Manager to execute Change Order Na. 3 to City Secretary Contract Na. 31733 with
Austin Bridge & Road, L.P., in the amaunt of $44,OD0.2D, thereby increasing the contract amount to
$777, 847.44.
DlSCU55iON:
On April 12, 2005, (M8~C C-20647) the City Council authorized a contract with Austin Bridge & Road, t_P in
the amount of $622,635.40 for H.M.A_C. Surface Overlay 2DD5-6 at various locations.
The contract was subsequently revised by two previous change orders totaling $111,211.84 as follows:
• Change Order No. 1 in the amaunt of $1 D3,787.5D (M&C C-20914, August 23, 20D5), provided for the
removal of deteriorated base and the pulverizationlasphalt overlay ofi Cockrell Avenue and Orange Street.
• Change Order No. 2 in the amount of $7,424.34 (administratively approved by the City Manager an
April 9, 2006), provided 'For the replacement of existing concrete steps that must be removed in order to
install curb and gutter on Orange and College Streets.
Change Order No. 3 will provide increased pay item quantities far concrete driveway construction to
accommodate the proposed new grades (to comply with current City design criteria} on Nolan and Orange
Streets.
City staff considers the proposed change order amaunt to be fair and reasonable.
The cost of the proposed change order will be shared on a 4D% (TPW) and 6D% (Water} basis, between
the Transportation and Public Works Department and the Water Department.

The project is located in COUNCIL DISTRICTS 3, & and 9.
FISCAL INFC}RMATIONIC1=RTii= ICATION:
The Finance Director certifies that upon approval of the above recommendations, and adoption of the
attached appropriation ordinance, funds wiii be available in the current budgets, as appropriated, of the
Water and Sewer Capital Projects Fund and the Contract Street Maintenance Fund.
