FIRST AMENDMENT
TO CITY SECRETARY CONTRACT NO. 57017,
EASEMENT ENCROACHMENT LICENSE AGREEMENT
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO.57017,
EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and
between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County, Texas
("City"), acting herein by and through its duly authorized City Manager,Assistant City Manager, or
Development Services Department Director, and DRL-DFW Housing Partners,LLC, a(n) Texas limited
liability company("Licensee"), acting herein by and through its duly authorized President/CEO.
RECITALS
WHEREAS, City and Licensee made and entered into City Secretary Contract No.57021 on the
2 1"of January, 2022 (the"Agreement"), to authorize the use of the City's casement for the purposes of
a 4' balcony cantilever;
WHEREAS, it has now been determined by the parties that additional encroachments exist
within the Public Property identified in the original Agreement; and
WHEREAS,it is the mutual desire of City and Licensee to execute this Amendment to the
Agreement to revise "Exhibit A" in the Agreement to incorporate the additional encroachment(awnings)
and depict the revised encroachment area.
NOW, THEREFORE,City and Licensee,acting herein by and through their duly authorized
representatives, enter into the following that amends the Agreement:
1.
The Agreement is hereby amended by incorporating the attached"Exhibit A-1" to this
Amendment which shall be added as part of Exhibit"A"within the Agreement. OFFICIAL RECORD

2.
The effective date of this Amendment shall be the date of its execution by the City.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain in
full force and effect.
