HomeMy WebLinkAboutResolution 5569-05-2022 A Resolution NO. 5569-05-2022 CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD ON MAY 7, 2022, FOR THE PURPOSE OF SUBMITTING TO THE VOTERS OF THE CITY OF FORT WORTH, FOR ADOPTION OR REJECTION, THIRTEEN (13) PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF THE CITY OF FORT WORTH WHEREAS, on February 8, 2022, the City Council adopted Ordinance No. 25328-02-2022, calling for and ordering a special election to be held on Saturday, May 7, 2022, for the adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth; and WHEREAS, on May 7, 2022, a special election was held at which the qualified voters of the City had the opportunity to vote for the adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth; and WHEREAS,all circumstances surrounding the calling of election, giving of notice,holding of election, and return of ballots have been legally had and done;and WHEREAS, pursuant to Chapter 67 of the Texas Election Code, the City Council of the City of Fort Worth is required to canvass the returns and declare the results of the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT: SECTION 1. The declarations and findings contained in the preamble of this Resolution are hereby found to be true and correct and shall be made a part hereof. SECTION 2. The City Council hereby finds and declares that a special election regarding the adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth was held on May 7, 2022, at which election qualified voters were given the opportunity to vote for adoption or rejection of proposed amendments to the existing charter of the City of Fort Worth. SECTION 3. The City Council further finds and declares that the returns for such election are as follows: Tarrant Denton Parker County County County Total Proposition F For 13,493 254 34 13,781 Against 14,866 216 21 15,103 Shall Section 3 of Chapter III of the Fort Worth City Charter be amended to provide that the mayor's annual pay shall be half of the average annual base-rate salary for all City department heads and that the other city council members' annual pay shall be half of the average annual base-rate salary for all City assistant department heads starting October 1, 2022? Proposition Q For 22,046 385 42 22,473 Against 5,134 77 7 5,218 Shall Section 3 of Chapter I of the Fort Worth City Charter be amended to delete outdated language and to reflect that an annexation election will be called and conducted in accordance with state law and may be conducted directly by the city or by county election officials contracted by the city with voters to mark ballot to indicate their selection? Proposition R For 16,952 290 40 17,282 Against 10,190 177 10 10,377 Shall Section 11 of Chapter X of the Fort Worth City Charter be amended to clarify that the independent auditor's duties consist of auditing records and expressing an opinion on the annual comprehensive financial report and single audit and to remove requirement for physically printed copies? SECTION 4. The City Council further finds and declares that such returns are correct, and adopts them as the returns of the election held on May 7, 2022, together with the tabulation of the total number of votes received in each precinct. SECTION 5. The City Council finds that Propositions G, I, J, K, L, M, N, P, Q, and R be declared adopted by the City Fort Worth and the Fort Worth City Charter shall be amended to reflect the above adopted Propositions. Since Propositions F, H, and O failed, those changes will not be implemented. SECTION 6. It is hereby officially found and determined that the meeting of the Fort Worth City Council at which this Resolution was adopted was open to the public, and that public notice of the time, place, and purpose of said meeting was given, as required by Chapter 551 of the Texas Government Code. SECTION 7. This Resolution shall take effect upon adoption on this 17'h day of May, 2022.
