HomeMy WebLinkAboutOrdinance 25517-05-2022 ORDINANCE NO. 25517-05-2022 AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF WRIGHT ARMSTRONG STREET AND JOE CARRIGAN STREET, SITUATED IN THE WILLIAM DEAN SURVEY, ABSTRACT NO. 436 OF THE CITY OF FORT WORTH, DENTON COUNTY, TEXAS; AS SHOWN ON THE PLAT OF WAYSIDE PARK ESTATES ADDITION, ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN VOLUME 388-Y, PAGE 123, PLAT RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING COLLECTIVELY APPROXIMATELY 13,626 SQUARE FEET MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. 1. That a portion of Wright Armstrong Street, situated in the William Dean Survey, Abstract No. 436, City of Fort Worth, Tarrant County, Texas, as shown on the plat of Wayside Park Estates Addition, an addition to the City of Fort Worth, as recorded in Volume 388- Y, Page 123 of the Plat Records of Tarrant County, Texas, and containing approximately 1,766 square feet or 0.0405 acre of land more or less, and as more specifically described in Exhibits "A-l" and "B-l" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. 2. That a portion of Wright Armstrong Street, situated in the William Dean Survey,Abstract No. 436, City of Fort Worth, Tarrant County, Texas, as shown on the plat of Wayside Park Estates Addition, an addition to the City of Fort Worth, as recorded in Volume 388- (VA-18-003 Joe Carrigan St&Wright Armstrong St Ordinance No.25517-05-2022 Page 1 of 2 Y, Page 123 of the Plat Records of Tarrant County, Texas, and containing approximately 324 square feet or 0.0074 acre of land more or less, and as more specifically described in Exhibits "A-2" and `B-2" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. 3. That a portion of Joe Carrigan Street, situated in the William Dean Survey, Abstract No. 436, City of Fort Worth, Tarrant County, Texas, as shown on the plat of Wayside Park Estates Addition, an addition to the City of Fort Worth, as recorded in Volume 388-Y, Page 123 of the Plat Records of Tarrant County, Texas, and containing approximately 11,536 square feet or 0.2648 acre of land more or less, and as more specifically described in Exhibits "A-3" and "B-3" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That easements to the land in the above-described vacated street rights of way are hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easements be shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 4. DISCUSSION: Eagle Surveying, LLC on behalf of Elite Development and Construction, LLC, has requested vacation of these portions of Joe Carrigan Street and Wright Armstrong Street to be replatted as a part of the proposed single family residential development, Brookville Ranch.The City Plan Commission recommended approval of this request at its meeting on April 25,2018.An acceptable final plat(FP-18-058) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth(City)originally obtained the above mentioned rights-of-way through plat dedication.The City does not own any fee interest in the rights-of--way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of--way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and Council Communication (M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of- way easement for the streets. This project is located in COUNCIL DISTRICT 2. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
