Ordinance No, 17087-08-2006 AN ORDINANCE INCREASING ESTIMATED RECEII'TS AND APPROPRIATIONS 1N THE WATER CAPITAL PROTECTS FUND IN THE AMOUNT OF $87,192 AND TI-'IE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $21,060 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING CHANGE ORDER NO. 1 TO CITY SECRETARY CONTRACT NO. 33351 WITH CONATSER CONSTRUCTION, TX., LP.; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONI~'LICT HEREWITH; ANI7 PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to tl~e various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $87,192 acid the Sewer Capital Projects Fund in the amount of $21,060 from available funds for the purpose of executing Change Order No. 1 to City Secretary Contract No. 33351 with Conatser Construction, TX., LP. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, i~~operative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 1.6582 and alt other ordinances and. appropriations amending the same except in those instances where the provisions of this ordi~iance are in direct conflict with such other ordinances and appropriations, in which ins#ance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $108,252.00 front the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of $87,192.00 and Sewer Capital Projects Fund in the amount of $21,g6q.gq; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $87,192.00 and the Sewer Capital Projects Fund in the amount of $21,060.00, from available funds; and 3. Authorize the City Manager to execute Change Order No. 1 to City Secretary Contract No. 33351 with Conatser Construction, TX., 1wP in the amount ofi $108,252.00, thereby increasing the contract amount to $862,114.00. DISCUSS!©N: On March 21, 200fi, (M&C C-21347} the City Council with Conatser Construction TX., LP in the amount ofi Replacements on Throcl<morton Street and 14th Street. authorized the City Manager to execute a contract $753,862.00 for Water and Sanitary Sewer Main Change Order No. 1 will provide for the following: 1. The lowering of the water main located on Houston Street in order to avoid conflict with a TXU conduit and proposed storm drain pipe. 2. The installation of a gate value on an existing water main in order to maintain uninterrupted fire protection to the Tarrant County College building during construction. 3. The installation of the sewer main crossing the Houston Street111th Street intersection by means other than open cut due to conflict with several previously un[cnown utilities at the intersection. 4. The replacement of the sewer service far the proposed Omni Hotel by open cut #rench method instead of by trenchless method as originally proposed to eliminate a swag in the service line. MNVBE -Conatser Construction TX., LP is in compliance with the City's MIWBE Ordinance by committing to an additional 4% MNVBE participation on this change order.
