Ordinance No. '#7088-08-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE, WATT=R CAPITAL PROJECTS FUND IN TFiE AMOUNT OF $'175,565 AND THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $215,407.38 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON WALES AVENUE FROM WELCH AVENUE TO WALTHAM AVENUE AND WALTHAM AVENUE FROM WELCH AVENUE TO WALES COURT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $175,565 and the Sewer Capital Projects Fund in the amount of $215,407.38 from available funds far the purpose of executing a contract with McClendon Construction Company, Inc. for Pavement Reconstruction and Water and Sanitary Sewer Main Replacement on Wales Avenue from Welch Avenue to Waltham Avenue and Waltham Avenue from Welch Avenue to Wales Court. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Autharize the transfer of $390,972.38 from the Water and Sewer Operating Fund to the Water Capita[ Project Fund in the amount of $175,555.00 and Sewer Capital Project Fund in the amount of $215,407.38; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $175,565.00 and the Sewer Capital Project Fund in the amount of $215,407.38, from available funds; and 3. Autharize the City Manager to execute a contract with McClendon Construction Company Inc., in the amount of $695,992.44 for pavement reconstruction and water and sanitary sewer main replacement on Wales Avenue (Welch Ave to Waltham Ave} and Waltham Avenue {Welch Ave to Wales Court). ©ISCUSSIQN: The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction nn all streets mentioned above, Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that severely deteriorated water and sanitary sewer lines should be replaced prior to street reconstruction. On June 28, 2005, (Mc~C G-20817) the City Council authorized the City Manager to execute an engineering agreement with ANA Consultants, L.L,C., fior pavement reconstruction and water and sanitary sewer main replacement on Wales Avenue (Welch Avenue to Waltham Avenue) and Waltham Avenue {Welch Avenue to Wales Court) {DOE 484D}. The project was advertised on April 27, 2006 and May 4, 200fi. Wilson, Inc. $814,387.20 Lagname: 30WALTHAMOOlbS Page 1 0~3 RKM Utility Services, Inc. $87t),348.aQ Time of Completion: 140 Working Days The new pavement will consist of B-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete curb. Funding in the amount of $29,877.88 is included far associated water and sewer construction survey, project management, pre_construction, material testing, inspection and project close out (water $14,960.00 and sewer $14,917,88). The contingency funds #o cover change orders total $17,195.40 (water $7,648.90 and sewer $9,547.00). Funding in the amount of $31,101.84 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. The contingency funds for possible change orders for paving and drainage improvernenfs is $17,605.00. MIWBE -McClendon Construction Co., Inc., is in compliance with the City's M/WBE Ordinance by committing to 51 % MIWBE participation. The City's goal on this project is 23%. This project is located in COUNCIL DISTRICT 6, Mapsco 89T. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of the Water Capita!
