CIT"Y" SECRETARY CONTRACT NO, THE STATE OF TEXAS KNOW ALL BY THESE PRESENTS COUNTY OFTARRANT INTERLOCAL AGREEMENT iz� This Agreement is made and entered into this C2 ) day of September, 2003, by and between the County of Tarrant, acting herein by and through its governing body, the Commissioners Court, hereinafter referred to as COUNTY, and the City of Fort Worth,,, acting herein by and through Marc Ott, its duly authorized Assistant City. Manager, hereinafter referred to as CITY, both of Tarrant County', State of Texas, witnesseth: WHEREAS, this Agreement is made under the authority, of Sections 791.001- 791-0291, Texas Government Code,- and WHEREAS, each governing body, in performing, govern gent ai functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party-, and 5 WHEREAS, each governing body finds that the subject of this Agreement is necessary for,the benefit ofthe public and each has the legal authority to perform and to provide the governmental. function or service which is the subject matter of this Agreement; and WHEREAS, each governing body finds that,the performance of this Agreement is, in the com-mon 'interest of both parties and that the division of costs fairly compensates the performing party for the services or functions under this Agreement; and WHEREAS, each goveming body agrees to share in the cost of the construction services described below. NOW THEREFORE, the COUNTY and CITY agree as follows-, The COUNTY agrees to provide the labor and equipment necessary to provide rehabilitation of the following roadways: (a) Trinity Boulevard, froim O. miles east of'Bell Spur to Precinct Line Road for a distance of 11 500 linear feet. The work will 'Include recycling and cement stabilization of bases failures and resurfacing with two 'Inches of HMAC. 1­� j (b) Golden Heights, lying between Harmon Road to the south and Han-non Road to the north, for a distance of' 2,700 linear feet. The work will include reclaiming and recycling the existing roadbed, 'incorporating 4% cement stabilization, reshaping, and placing a two-inch HMAC surface. (c) Hannon Road (1) from Bonds Ranch Road to Golden Heights for a distance of 2,,600 linear feet. The work will include reclaiming and recycling the existing roadbed, incorporating 4% cement stabilization, reshaping, and placing a, two-inch HMAC surface. (d) Harmon Road (2) from Golden Heights to Golden Triangle for a distance of 750 linear feet. The work will include reclaiming and recycling the existing roadbed, incorporating 4% cement stabilization, reshaping, and placing a two-inch HMAC surface. (e,) Harmon Road (3) from US 287 to Bonds Ranch Road for a distance of 8450 linear feet. The work will include reclaiming and recycling the existing roadbed I incorporating 4% cement stabilization, reshaping and placing a two-inch 14 AC surface. (0 Caylor West, from Katy Road to Caylor North for a distance of 4111,400 linear feet. The work will include reclaiming and recycling the existing roadbed, i q, incorporating 4%, cement stabilization, reshaping,, and placing a two HMAC surface. (g) Caylor North, from Caylor West, south to the End of New Construction for a distance of 837 linear feet. The work will include reclaiming and recycling the existing roadbed, incorporating 4% cement stabilization,, reshaping, and placing a two-inch HMAC surface. (h) Ray White (1) from Wall Price Road to 1882 linear feet North for a distance of 1882 linear feet. The work will 'Include resurfacing the existing roadway with two inches, of HMAC. (1) Ray White (2) froni 1882 linear feet north of Wall Price to X667' linear feet north and west of Wall Price (Fort Worth incorporated city limits) for a distance of 1785 linear feet. The work will include resurfacing the existing roadway with two inches,of HMAC. 2. 2.1 The CITY agrees, at its sole option, to either deliver to the COUNTY all of the materials necessary and required for the rehabilitation of the roads, as described in paragraph I of this agreement, or to pay for the actual cost of the materials as *incurred by the COUNTY including any delivery or freight costs. The CITY will provide a. purchase order and will be billed directly by the material supplier. The COUNTY may accumulate and bill the CITY for incidental material cost. (b) Golden Heights, lying between Harmon Road to the south and Harmon Road to the north —$1,7,505. (c) Harmon Road (1) from Bonds Ranch Road to Golden Heights—$16,877. (d) Harmon Road (2) from Golden Heights to, Golden Triangle—$4,988. (e) Harmon Road (3) from US, 28,7 to Bonds Ranch Road—$60,538. (f) Caylor West from Katy Road to Caylor North— $43,15:5. (g) Caylor North from Caylor West south to the End of New Construction — $81523. (h) Ray White (1) from Wall Price Road to 1,882 linear feet North— $171065. (1*) Ray White (2) from 1882 linear feet north of all Price to 31667 linear felet north and west of Wall Price—$2°x,626. 2.2 The total cost to CITY under this paragraph, shall not exceed $435,8,97. 3. The CITY agrees to provide the water necessary for these projects and to waive the cost of the deposit for the hydrant meter. 4. 4.1 The CITY agrees to play for -the cost of providing traffic control, and other incidentals and contingencies estimated in amounts not to exceed as follows: Trinity Boulevard,- $45,762; Golden Heights - $1,750; Han-non Road (1) - $2,,446; Harmon Road (2) - $,499-1 Harmon Road (3) - $6,054; Caylor West - $6,593- Caylor North - $1,611; Ray White (1) - $2,212; Ray White (2) - $3,775. 4.2 The total cost to the CITY under this paragraph shall not exceed $70,702. 5. The CITY agrees to the closing of each road for through traffic for the duration of the project or as deemed necessary by the COUNTY. The CITY agrees that if a Storm Water Pollution Plan is required,, the CITY will be responsible for the dell develop ent of' the Plan. The COUNTY will be responsible for the implementation,and maintenance of the plan during,the duration of the project. The CITY further agrees, to pay for all cost associated with the implementation and maintenance of the plan. 7. The CITY agrees to notify the COUNTY within thirty days of'the completion of a e ffl 'ect of any complaint the CITY has with the prej,ec,t. spci ic pr 01 Nothing in the performance of this Agreement shall impose any liability for claims, against the COUNTY other than claims for which the Texas Tort Claims Act may impose liability. 9. Nothing in the performance of this Agreement shall impose any liability for claims against the CITY other than claims for which liability may be i*rnposed by the Texas Tort Clai'ms Act. 10. The parties to the Agreement, do not intend for any third party to obtain a right by virtue of this Agreement. 11. By entering into, this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein-, further, this Agreement V I i shall not create any rights n any party not a signatory hereto. 12.
