WHEREAS, pursuant to Chapter 2, Section 1 of the Charter of the City of Fort Worth, as well as Sections 169(b) and 170(b) of Article 6701d, Revised civil Statutes, the City of Fort Worth has authority to establish prima facie maxi- mum and minimum reasonable and prudent speeds within its corporate boundaries for vehicles on streets and highways; and, WHEREAS, upon the basis of engineering and traffic in- vestigations, taking into consideration the width and con- dition of the pavement, the usual traffic, as well as other circumstances on public streets and highways, the City Council has determined (1) that slow speeds at certain locations con- sistently impede the normal and reasonable movement of traf- fic, and (2) that certain speeds at certain locations are reasonable and safe prima facie minimum speeds, and (3) that certain speeds at certain locations are reasonable and safe prima facie maximum speeds; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SEC11'10N 1, That Section 261 (Definitions) of Chapter 26 of the .2- Fort Worth City Code (1964) , as amended, be and the same is hereby amended to read as follows: "Sec. 26-1. Definitions. "Whenever the following terms are used in this chapter, they shall have the meanings respectively ascribed to them in this section: "Authorized emergency vehicle means vehicles of the fire department (fire patrol) , police vehicles, pub- lic and private ambulances for which permits have been issued by the State Board of Health, emergency vehicles of municipal departments or public service corporations as are designated or authorized by the governing body of an incorporated city, and private vehicles operated by volunteer firemen while answer- ing a fire alarm. ""Commercial motor vehicle means any motor vehicle designed or used for the transportation of property, not including a passenger bus, passenger automobile, motorcycle, panel delivery truck or pickup truck. "Crosswalk means (a) that part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the ab- sence of curbs from the edges of the traversable roadway; and (b) any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing, by lines or other markings on the surfaces or by any other official traffic-con- trol device. "Freeway means every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, street, or roadway. "Frontage road means a street located next to a free- way and auxiliary thereto, constructed so as to pro- vide vehicular access to and from the freeway. The following terms have the same definition as 'front- age road' and. any one of these terms may be substi- tuted for the term 'frontage road' when used in this Chapter 26: 'access road, ' 'access street, ' 'front- age street, ' 'service road, ' and 'service street. ' "Highway means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel, "Intersection means (a) the area embraced within the prolongation or connection of the late;�.al curb lines, or if none, then the lateral boundary Nines of the roadways of two or more highways which join one an- other at any angle, or the area within which vehicles traveling upon different highways joining at any angle may come in conflict; (b) where a highway in- cludes two roadways thirty (30) feet oz, more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such inter- secting highway also includes two roadways thirty (30) feet or more apart, then every crossing of two road- ways of such highways shall be regarded as a separate intersection; and (c) the junction of an alley with a street or highway shall not constitute an intersection, "Junked vehicle means any vehicle which is inoperative and which does not have lawfully affixed thereto both an unexpired license plate or plates and a valid motor vehicle safety inspection certification and which is wrecked, dismantled, partially dismantled, or discarded, but excluding vehicles in operable condition specially adopted or constructed for racing or operation on pri- vately owned drag strips or raceways, vehicles retained by the owner for antique collection purposes rather than for salvage or for transportation, and vehicles stored as the property of a member of the armed forces of the United States who is on active duty assignment outside the continental and territorial limits of the United States. "Loading zone means a space or section of the curb set aside for the exclusive use of loading and unloading persons, supplies or merchandise, "Mobile home means a living quarters equipped and used for sleeping and eating which may be moved from one location to another over a public street by being pulled behind a motor vehicle, "Motorbus means any trackless vehicle operated for hire upon a regular schedule over a defined route, "Motorcycle means every motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in contact with the -4- ground but excluding a tractor. "Motor vehicle means every vehicle which is self- propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. "Official traffic-control device means any sign, signal (including a traffic-control signal) , marking, or device not inconsistent with State statute or this chapter, placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traf- fic. "Park or paLI�Lja2 means the standing of a vehicle, whether occupied or not, upon a roadway, otherwise than temporarily in obedience to an official traffic- control device or for the purpose of and while actually engaged in loading or unloading merchandise or passen- gers. "Pedestrian means any person afoot. "Person means any individual, firm, partnership, association, corporation, company or organization of any kind. "Pole trailer means every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach, or Pole, or by being boomed, or otherwise secured to the tow- ing vehicle, and ordinarily used for transporting long or irregularly shaped loads such as poles, pipes, or structural members capable, generally, of sustain- ing themselves as beams between the supporting connec- tions. "Police officer means every officer of the municipal police department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations. "Prima facie: The term 'prima facie' is to be defined according to the law of the State of Texas, and, to the extent that there is no conflict with state law, the following meaning shall apply: 'Such as will suffice to constitute proof of a fact unless and until it is over- come, rebutted, or contradicted by other evidence; no particular weight is assigned to prima facie evidence by law except that the factfinder may find a verdict based upon it, as in all criminal cases, the accused starts out with a presumption of innocence that must be overcome by evi- dence beyond a reasonable doubt. ' "Private road or driveway means every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner but not by other persons. "Right-of-way means the right of one vehicle or pedestrian to proceed in a lawful mariner in prefer- ence to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision un- less one grants precedence to the other. "Roadway means that portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate roadways the term 'roadway' as used herein shall refer to any such roadway separately but not to all such road- ways collectively. "Semi-trailer means every vehicle of the trailer type so designed or used in conjunction with a motor vehicle that some part of its own weight and that of its own load rests upon or is carried by another motor vehicle. "Sidewalk means that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines intended for the use of pedestrians. "Street means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel. "Traffic means pedestrians, ridden or herded animals, vehicles, street cars, and other conveyances either singly or together while using any highway for pur- poses of travel. "Traffic-control signal means any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed t.o stop and permitted to proceed. "Trailer means every vehicle without motive power de- -6- signed or used for carrying property or passengers wholly on its own structure and to be drawn by a motor vehicle. "Truck-tractor means every motor vehicle designed or used primarily for drawing other vehicles and not so constructed as to carry a load o1-_-her than a part of the weight of the vehicle and load so drawn. "Vehicle means every device in, upon, or by which any person or property is or may be transported or drawn upon a highway, including motor vehicles, commercial motor vehicles, truck-tractors, trailers, and semi- trailers, severally, as defined in this chapter, but excepting devices moved by human power or used ex- clusively upon stationary rails or tracks. " SECTION 2, That Section 26-3 of Chapter 26 of the Fort Worth City Code (1964) , as amended, be and the same is hereby amended to read as follows: "Sec. 26-3. "It shall be the general duty of the city traffic engineer to determine the installation and proper timing of official traffic•control devices, to conduct engineering analyses of traffic accidents and to de- vise remedial measures, to conduct engineering_ng j-nvesti- gation of traffic conditions and to cooperate with other city officials in the development of ways and means to improve traffic conditions, and to carry out the addi- tional powers and duties imposed by the ordinances. "The city traffic engineer,except as otherwise directed by this chapter, and except as otherwise directed from time to time by the city council, shall have power and he is hereby authorized (1) to regulate the operation and parking of vehicles within the city, including private property used for public purposes, by the erection or placing of official traffic-control devices to indicate prohibited or limited parking, prima facie maximum and minimum reasonable and prudent speeds specified by statute or established by ordinance or other lawful manner, restricted speed areas, one-way streets, through or arterial streets, stop streets, 'U' turns, school zones, loading and unloading zones, and the place and manner of operating or parking vehicles; (2) to regulate the movement of pedestrians upon the streets and sidewalks by the erection or placing of official traffic- _7-11 control devices indicating the flow of pedestrian traffic where, in his opinion, there is a particular danger to pedestrians, and to maintain such devices, or cause them to be maintained; (3) to designate bus zones and taxicab stands and to erect or place offi- cial traffic-control devices prohibiting the parking of vehicles other than buses and taxicabs in such stands; (4) to designate truck routes and to regulate the parking of vehicles of various sizes and weights; (5) to cause all such necessary official traffic-con- trol devices to be erected or placed on any street or part of a street when he deems such action necessary; (6) to mark off traffic lanes on streets and parts of streets indicating and directing the flow of traffic, when, in his judgment, such action is necessary; (7) to determine and designate the character or type of, and to place and maintain, or cause to be placed and maintained, all official traffic--control devices, including all offi- cial traffic signs and signals; (8) to determine and designate intersections where particular hazard exists and to determine whether vehicles shall stop at one or more entrances to any such stop intersection, and to erect a stop sign at every such place where a stop is required; (9) to determine and designate intersections where particular hazard exists and to designate whether vehicles on one of the intersecting streets yield the right-of-way to vehicles on the other street and to erect a 'YIELD' sign at every place where need is deter- mined for such a sign; (10) to erect or place official traffic-control devices, including appropriate signs and markings, to designate the truck routes and com- mercial delivery routes described in this chapter; (11) to designate, for such period as might be necessary, alternate truck routes and commercial delivery routes whenever any street designated as a truck route or com- mercial delivery route is being repaired or is other- wise temporarily out of use; (12) to determine and desig- nate spaces for exclusive uses as bus zones, taxicab stands, and passenger and freight loading zones, no park- ing zones, and 'one-way' traffic lanes in which driving is prohibited in one direction and permitted in the op- posite direction, and to place or erect official traffic- control devices, indicating same, within any areaway, parkway, traffic-way or parking space owned or controlled by any public service concern, public service utility company, terminal company, railroad or other quasi-public corporation or public concern, designed for the temporary parking of patrons of such public concern, utility or corporation; (13) to file with the city secretary a map or a written description setting forth every regulation, designation, delineation or determination promulgated by the city traffic engineer pursuant to the authority granted in " (12) ", above, (14) to designate, upon any street or por- tion of any street, the parking meter zones set forth in -8- this chapter where it is determined, upon the basis of an engineering and traffic investigation, that the installation of parking meters shall be necessary to aid in the regulation, control or inspection of the parking of vehicles in the exercise of the police power of regulating, operating or controlling the operation of vehicles using the public streets, to install and maintain parking meters upon the curb immediately adjacent to the individual parking spaces, in order to control and regulate such parking meter zones, to designate the maximum parking time for each parking meter, basing this designation upon the in- vestigation above set forth; to erect or place an official traffic-control device, including lines or marks on the curb or on the street about or along- side each parking meter, in order to designate the parking space for which such meter is to be used; (15) to establish such loading zones as are necessary for the conduct of business and to use official traf- fic-control devices to designate such zones; and (16) to designate some member of his department to make regular collections of the money deposAed in parking meters, which member shall remove these coins from the meters, place the coins in sealed or locked con- tainers, and deliver such containers and funds to a place designated by the city secretary. " SECTION 3. That Section 26 -10 and Section 26�',A of Chapter 26 of the Fort Worth City Code (1964) , as amended, being repetitious of Section 26-3 of said Code as amended by this ordinance, he and the same are hereby repealed. SECTION 4. That Section 26-30 of Chapter 26 of the Fort Worth City Code (1964) , as amended, be and the same is hereby amended to read as follows: "Sec. 26--30, Obedience to official traffic-control devices. "It shall he unlawful for any person to disobey the instructions applicable to said person and indicated on any official traffic-control device placed in accord- ance with the provisions of this chapter or State law, except that each of the following shall be an affirma- tive defense: " (a) that the disobedience occurred when the person obeyed contrary directions of a traffic or police officer, " (b) that the disobedience was authorized by the ex- ceptions granted by this code or by State law to the driver of an authorized emergency vehicle, and " (c) that the official traffic-control device allegedly violated was not in proper position and sufficiently legible to be seen by an ordinarily observant per- son. "Whenever a particular section does not state that offi.-- cial traffic-control devices are required, such section shall be effective even though no devices are erected or in place. " SECTION 5. That Section 26-58, Section 26• 61, Section 26-62 and Section 26-63 of Chapter 26 of the Fort Worth City Code (1964) , as amended, be and the same are hereby repealed. SECTION 6. That Chapter 26 of the Fort Worth City Code (1964) , as amended, be and the same is hereby amended by the addition thereto of a new Section 26 58, and such section shall read as follows: "Sec. 26-58. "Proof of the existence within the City of Fort Worth, Texas, of an official traffic-control device regulating any part of any street or highway, including any part of any freeway, shall be prima facie evidence that such official traffic-control device was erected or placed by and at the direction of personnel duly and lawfully authorized to do so, in accordance with the applicable provisions of State statute and this chapter. " SECTION 7. That Chapter 26 of the Fort Worth City Code (1964) , as amended, be and the same is hereby amended by the addition -10- thereto of a new Section 26-63, and such section shall read as follows: "Sec. 26-63. Speeding. " (a) It shall be unlawful for any person to drive or operate a vehicle on a street or highway at a speed greater than is reasonable and prudent under the circumstances then exist- ing. " (b) It shall be unlawful for any person to drive or operate a vehicle at such a slow speed as to impede the normal and reasonable movement of traffic except when reduced speed is neces- sary for safe operation or in compliance with law. " (c) Any speed is lawful which is less than the prima facie maximum reasonable and prudent speed for the location, yet greater than any prima facie minimum reasonable and pru- dent speed for the location, but any speed in excess of such maximum or less than such minimum shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful, PROVIDED: " (1) that a slower speed is required for compliance with paragraphs (b) and (c) of Section 166 of Article 67014, Revised Civil Stat- utes, where there exists a hazard named therein; AND, PROVIDED FUR- `CHER, " (2) that one or more appropriate signs giving notice must be erected for any location for which the prima facie maximum reasonable and prudent speed specified by Section 166 of Article 6701d, Revised Civil Statutes, has been superseded by a prima facie maxi- mum or minimum reasonable and prudent speed established by the City of Fort Worth or other governmental body as provided by said Article 6701d, 11 (d) Where no prima facie maximum reasonable and pru- dent speed requiring the erection, of one or more appropriate signs giving notice has been estab- lished for a public street or highway within the City of Fort Worth urban district, the prima facie -11- maximum reasonable and prudent speed for said lo- cation shall be thirty (30) miles per hour as specified by Section 166 of Article 6701d, Re- vised Civil Statutes, provided that a slower speed is required by paragraphs (b) and (c) of said Section 166 where there exists a special hazard named therein, " (e) The prima facie maximum reasonab.'le and prudent speed on any street, highway, roadway, path, or parking area open to the public, whether dedi- cated or not, contained within the following public parks shall be five (5) m::.les per hour in parking lots, and elsewhere in each park it shall be the speed, in miles per hour, desig- nated below, provided that in each case an appropriate sign giving notice thereof shall be erected: Maxi- mum Speed (MPH) Botanic Gardens 20 Buck Sansom Park 20 Bunche Park 20 Camp Joy: except that said prima facie 20 maximum speed shall be ten (10) miles per hour on camp Joy Park Road, from the 9700 block of Watercress Drive to the 9800 block of Watercress Drive Carter Park 20 Casino Park 20 Cobb Park 20 Forest Park: except that said prima facie 20 maximum speed shall be twelve (12) miles per hour in the 1900 and 2000 blocks of C*olonial Parkway (from Univer- sity Drive to a point six feet beyond the miniature train tracks to the east) Fort Worth. Thus, according to this view, the section is defective because it could apply to airplanes or trains or horses, for example, as well as motor vehicles. The following is an outline of the proposed ordinance: I. CAPTION II. WHEREAS CLAUSES A. CITE AUTHORITY B. STATE THAT REQUIRED "ENGINEERING AND TRAFFIC INVESTIGA- TION" WAS HADE III.
