AN ORDINANCE MAKING CERTAIN FINDINGS: PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIPIITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF 635 ACRES OF LAND, 111ICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIPIITS OF THE CITY OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVILEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT: PROVIDING A SEVERABILITY CLAUSE AND NAMING AN EFFECTIVE DATE. I-VHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chamber in the City Hall of Fort Worth, Texas, on the 6th day of January, 1969, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and NIHEREAS, notice of such public hearing was published in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 24th day of December, 1968, which date is not more than twenty (20) nor less than ten (10) days prior to the date of such public hearing; and, WHEREAS, the population of the City of Fort Worth, Texas, is in excess of 400,000 inhabitants; and WHEREAS, the corporate area of the City of Fort Worth, Texas, was 198.222 square miles on January 1, 1969, and WHEREAS, the hereinafter described territory lies within the extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and HHEREAS, the territory hereinafter described contains approximately 635 acres, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. The following described land and territory lying adjacent to and adjoining the City of Fort Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boundary limits of the City of Fort Worth, Texas, and the present boundary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to wit: Being a tract or parcel of land out of the E. Jones Survey Abstract 841, R. G. B. Williams Survey Abstract 1669, H. Robinson Survey Abstract 1315, J. H. Conner Survey Abstract 285, P. E. Coleman Survey Abstract 372, J. Brookman Survey Abstract 102, J. F. Redding Survey Abstract 1302, J. W. Plain Survey Abstract 1097, and N. Burton Survey Abstract 244, and more particularly described as follows: TRACT #1 BEGINNING at a point in the present City Limit Line of the City of Fort Worth, said point being in the north line of the W. J. Baker Survey Abstract 101, same also being the south line of the E. Jones Survey Ab- stract 841, said point lying in the west line of the Boaz Estate Tract; THENCE north along the west line of the Boaz Estate Tract approximately 1,000 feet north to a point, said point lying 400 feet north of the north line of the E. Jones Survev Abstract 841, said point also being in the south line of a Tract annexed to the City of Fort Worth for the improve- rient of navigation, City Secretary Ordinance 5080; THENCE with the south line of said Navigation Annexation as follows: East approximately 1,200 feet, more or less, along the line parallel to and 400 feet north from the north line of the E. Jones Survey, projected east to its intersection with a line 600 feet east of the west line of the R. G. B. Williams Survey, THENCE north alona said line parallel to and 600 feet east of the R. G. B. Williams Survey Abstract 1669 to the south line of the H. Robinson Survey Abstract 1315; THENCE east with the south line of the 11. Robinson Survey Abstract 1315 to a point 2,000 feet east from the west line of the H. Robinson Survey; THENCE north along a line parallel to and 200 feet east from the west line of the H. Robinson Survev to a point 800 feet north of the south line of the H. Robinson Survev; THENCE along a line parallel to and 800 feet north of the south line of the H. Robinson Survev to a point 1,100 feet west from the east line of the H. Robinson Survey; THENCE north along a line parallel to and 1000 feet west from the east line of the H. Robinson Survey and the J. H. Conner Survey Abstract 285 to a point 300 feet north of the north line of the H. Robinson Survey; - 2 - 't THENCE east along a line parallel to and 300 feet north from the north line of the H. Robinson Survey projected east approximately 2,000 feet to a point in the west line of the TESCO right-of-way, as described in Volume 1955, Page 60, Deed Records, Tarrant County, Texas; THENCE south along the test line of the TESCO right-of-way, approximately 3,600 feet, more or less, to a point in the present City Limits Line, said point lying on a line parallel to and 1,000 feet south of the south line of the W. M. Rav Survey produced west, said point also being in the east line of the P. Coleman Survey; THENCE south with the present City Lights Line approximately 700 feet to a point in the north line of the W. J. Baker Survey produced east; THENCE west along the present City Limits Line also being the north line of the W. J. Baker Survey produced east approximately 1,470 feet to the east line of the National Farm Life Insurance Company 20 acre tract; THENCE north with the east line of the National Farm Life Tract to its northeast corner for a point; THENCE west with the north line of the National Farm Life Insurance Tract to its northwest corner for a point; THENCE south with the west line of the National Farm Life Insurance Tract to its intersection with the north line of the W. J. Baker Survey, same being the present City Limits Line; THENCE west with the north line of the W. J. Baker Survey and the present City Limits Line approximately 3,720 feet to the point of beginning con- taining approximately, 380 acres, more or less. TRACT #2 BEGINNING at a point in the south line of that property annexed to the City of Fort Worth for the purpose of the improvement of navigation annexed by Ordinance 5080, said point being 400 feet north of the north line of the E. Jones Survey, Abstract 841, said point also being in the west line of the Boaz Estate Tract; THENCE north approximately 1,675 feet to the center line of Randol "^ill Road; THENCE northeasterly and easterly with the centerline of Randol bill Road to its intersection with the west line of TESCO right-of-way, as described in Volume 1955, Page 60, Deed Records, Tarrant County, Texas; THENCE, southerly with the west line of the TESCO right-of-way approximately 1,800 feet to a point in the south line of the above described Navigation Annexation, said point being on a line parallel to and 300 feet north from the north line of the H. Robinson Survey produced east; THENCE west, along a line parallel to and 300 feet north from the north line of the H. Robinson Survey produced east and parallel to and 300 feet north from the north line of the H. Robinson Survey, to a point 1,100 feet west from the east line of the J. H. Conner Survey; THENCE south, along a line parallel to and 1,100 feet west from the east lines of the J. H. Conner and H. Robinson Surveys, to a point 800 feet north from the south line of the H. Robinson Survey; - 3 - e THENCE west, along a line parallel to and 800 feet north from the south line of the H. Robinson Survey, to a point 2,000 feet east from the west line of the H. Robinson Survey, THENCE south, along a line parallel to and 2,000 feet east from the west line of the H. Robinson Survey, to its intersection with the south line of the H. Robinson Survey; THENCE viest, along the south line of the H. Robinson Survey to a point 600 feet east from the northwest corner of the R. G. B. Williams Survey; THENCE south, along a line parallel to and 600 feet east from the west line of the R. G. B. Williams Survey, to its intersection with a line parallel to and 400 feet north from the north line of the E. Jones Sur- vey produced east; THENCE west, along a line parallel to and 400 feet north from the north line of the E. Jones Survey produced east and along a line parallel to and 400 feet north from the north line of the E. Jones Survey, to its intersection with the east line of the Boaz Estate Tract, the same being the point of BEGINNING, containing approximately 255 acres more or less. SECTION 2. The above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxes levied by the City of Fort Worth, Texas, and the in- habitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regu- lations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this or- dinance is for any reason held void or unconstitutional, by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases, or words except as the same are inseparable from and indispensable to the remaining portions of the ordinance. - 4 - SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained.
