(CD 3) Authorize the Execution of a One -Time Purchase Agreement in an Amount Up to $200,000.00 with EZ Dock of Texas, L.P., Utilizing
Buyboard Cooperative Contract 592-19, for the Park & Recreation Department's Lake Como Boardwalk Trail Project
RECOMMENDATION:
It is recommended that City Council authorize the execution of a one-time purchase agreement in an amount of $200,000.00 with EZ Dock of
Texas, L.P., utilizing Buyboard Cooperative Contract 592-19, for the Park & Recreation Department's Lake Como Boardwalk Trail Project.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the award of a purchasing agreement with EZ Dock of Texas, L.P. in
an amount up to $200,000.00 for installation of a boardwalk trail across Lake Como.
The Park & Recreation Department (PARD) approached the purchasing division for assistance in buying materials and services for the Lake
Como Project (part of the Neighborhood Improvement Program). The project consists of a boardwalk trail that traverses Lake Como, extending
from the existing Lake Como dock/pier to the east bank of Lake Como, eventually connecting to the Right of Way (ROW) walk along Merrick St.
The amount includes any subsequent complications such as any installation complications, supply chain issues due to Covid-19, and material
price volatility. PARD obtained a quote from EZ Dock of Texas, L.P. using BuyBoard Contract 592-19.
COOPERATIVE PURCHASE - State law provides that a local government purchasing an item under a cooperative purchase agreement satisfies
any state law requiring that the local government seek competitive bids for purchase of the item. BuyBoard Contracts are competitively bid to
increase and simplify the purchasing power of government entities across the State of Texas. BuyBoard conducted competitive bidding for the
contract 592-19 during January 2019.
BUSINESS EQUITY - A Minority/Women Business Enterprise (M/WBE) goal is not assigned when purchasing from an approved purchasing
cooperative or public entity.
AGREEMENT TERM - Upon City Council's approval, this agreement will commence upon execution by both parties and end on project
completion, which is expected to occur by September 30, 2022.
This project is located in COUNCIL DISTRICT 3.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the General Capital Projects
Fund for the COMO 21-Lake Como Park IM project to support the approval of the above recommendation and execution of agreement. Prior to
any expenditure being incurred, the Park and Recreation department has the responsibility to validate the availability of funds.
