Ordinance No. I7I19-08-204b AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC EVENTS FUND IN THE AMOUNT OF $500,OOfl PROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CAPITAL IMPROVEMENTS AT THE FORT WORTH CONVENTION CENTER AND WILL ROGERS MEMORIAL CENTER; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EPFECTNE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OP FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-200b in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Public Events Fund in the amount of $500,000 from available funds for fine purpose of funding Capital Improvements at the Fort Worth Convention Center and Will Rogers Memorial Center. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, irroperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordiirarrce No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. P. ,for the Repair of the John Justin Parking Garage at Richardson-Bass Building, Will Rogers Memorial Center RECOMMENDATIG}IV: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $500,000 in the Public Events l=und from available funds; 2. Authorize the use of $82,100 of these funds as outlined below in accordance with the City's purchasing and expenditures guidelines; 3. Authorize the City Manager to execute an emergency construction contract in the amount of $82,100.00, with Sedalco, L. P., for the repair of the Jnhn Justin Parking Garage afi the Richardson-Bass Building, Will Rogers Memorial Center. ®ISCUSSION: In January 2046, cracks were discovered in the concrete support I-beams of the John Justin Parking Garage which was built in the 198x3-87 timeframe. Based on staff inspection and safety issue concerns, staff contracted a firm to shore the concrete beams with scaffolding on a temporary basis. Huitt-Zollars, loc., was contracted via the City's open-ended annual architectural services agreement, fio conduct on-site invesfigatians and provide corrective recommendations. Sedalco, L. P., was contracted to assist Huitt-Zollars by excavating the foundation and removing brick veneer and concrete slab areas. Huitt~Zollars recommended that the affected areas be barricaded immediately to prevent patrons from parking in these areas. The barricades blocked off 20 parking spaces on each floor. The Huitt-Zollars' report described serious structural issues including: rotation of the bearing wall; signs of web, flange, and bearing failure; and loosening, spalling, and failing of the embedded plates for the double tees. Huitt-Zollars was contracted to do the required design work. Due to the safety concerns presented by these problems, Sedalco, L. P., will be awarded an emergency construction contract for the repair work and expects to complete the work in 42 calendar days. The emergency contract for the repair work is $82,100. Under Texas Local Government Code §252.022, a procurement necessary because of unforeseen damage to public property is exempted from the competitive bid requirements. The project is physically located in COUNCIL DISTRICT 7, but serves Fort Worth residents in ail Council Districts.
