HomeMy WebLinkAboutOrdinance 20732-05-2013 Ordinance No. 20732-05-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $206,797.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE SEWER MAIN DESIGN AS PART OF THE LITTLE FOSSIL CREEK INTERCEPTOR IMPROVEMENTS AT VARIOUS LOCATIONS WITHIN THE LITTLE FOSSIL CREEK DRAINAGE BASIN; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$206,797.00, from available funds, for the purpose of sewer main design as part of the Little Fossil Creek Interceptor Improvements at various locations within the Fossil Creek Drainage Basin. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be Cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are un direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer in the amount of$206,797.00 from the Water and Sewer Operating Fund to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$206,797.00; and 3. Authorize the execution of Amendment No. 1 to City Secretary Contract No. 43923 with Parsons Water & Infrastructure, Inc., in the amount of$206,797.00 for sewer main design as part of the Little Fossil Creek Interceptor Improvements at various locations within the Little Fossil Creek drainage basin. DISCUSSION: On September 25, 2012, (M&C C-25877) the City Council authorized an Engineering Agreement with Parsons Water& Infrastructure, Inc., in the amount of$391,453.00 for Little Fossil Creek Interceptor Improvements at various locations within the Little Fossil Creek Drainage Basin. The original design provided for the replacement of the severely deteriorated portions of the City's sanitary sewer Main 292 located at various points along Little Fossil Creek. As design has proceeded, Staff has determined that additional sanitary sewer mains located immediately downstream of two original project locations are undersized, severely deteriorated and in need of replacement. Parsons Water& Infrastructure, Inc., proposes to perform the additional design work for a lump sum fee of $206,797.00 for a Revised Contract in the amount of$598,250.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. M/WBE Office: Parsons Water& Infrastructure, Inc., is in compliance with the City's M/WBE Ordinance by committing to 32 percent M/WBE participation on this Amendment No. 1. The City's M/WBE goal on this Amendment is 20 percent.
