AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
NILES CITY BOULEVARD, SITUATED IN THE ISAAC THOMAS
SURVEY, ABSTRACT NO. 1526 AND EDMUND LITTLE SURVEY,
ABSTRACT NO. 954, CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS; AS RECORDED IN VOLUME 6997, PAGE 1980, DEED
RECORDS, TARRANT COUNTY, TEXAS, AND CONTAINING
APPROXIMATELY 52,919 SQUARE FEET OR 1.2148 OF LAND MORE
OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Niles City Boulevard, a fifty-two foot wide right-of-way, situated in the
Isaac Thomas Survey, Abstract No. 1526 and Edmund Little Survey, Abstract No. 954, as
recorded in Volume 6997, Page 1980 of the Deed Records of Tarrant County, Texas and
containing 52,919 square feet or 1.214 acre of land more or less, and as more specifically
described in Exhibits A attached hereto and incorporated herein by reference be and the same is
vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

RIGHT-OF-WAY ABANDONMENT
BEING a 1.2148 acre (52,919 square foot)tract of land situated in the Isaac Thomas Survey, Abstract No. 1526 and
the Edmund Little Survey, Abstract No. 954, City of Fort Worth, Tarrant County, Texas; said tract being part of Niles
City Boulevard, a 52-foot wide right-of-way, described in Street and Utility Easement recorded in Volume 6997, Page
1980, Deed Records, Tarrant County, Texas; said tract being more particularly described as follows:
COMMENCING at a 1/2-inch iron rod found at the intersection of the north right-of-way line of NE 23rd Street (a
variable width right-of-way)and the east right-of-way line of Packers Avenue(a variable width right-of-way);
THENCE North 89e45'44" East, along the said north right-of-way line of NE 23rd Street, a distance of 145.82 feet to a
1/2-inch iron rod found for the POINT OF BEGINNING at the intersection of the said north right-of-way line of N. 23rd
Street and the west right-of-way line of said Niles City Boulevard;
THENCE along the said west right-of-way line of Niles City Boulevard the following four(4)calls;
North 0°12'17" West, a distance of 290.51 feet to a 1/2-inch iron rod found at the beginning of a non-tangent
curve to the right having a central angle of 16°56'49", a radius of 739.81 feet, a chord bearing and distance of
North 8°17'16" East, 218.02 feet;
In a northeasterly direction, with said curve to the right, an arc distance of 218.82 feet to a 1/2-inch iron rod
found at the beginning of a non-tangent curve to the left having a central angle of 41*19'38", a radius of 684.00
feet, a chord bearing and distance of North 3°51'25"West,482.74 feet;
In a northwesterly direction,with said curve to the left, an arc distance of 493.37 feet to a point for corner;
North 24°18'57" West, a distance of 13.79 feet to a point for corner in the south right-of-way line of Exchange
Avenue(a variable width right-of-way);
THENCE South 89°58'54" East, along the said south right-of-way line of Exchange Avenue, a distance of 61.53 feet

THENCE along the said east right-of-way line of Niles City Boulevard the following six(6)calls;
In a southeasterly direction, with said curve to the right, an arc distance of 4.57 feet to a point for corner;
South 0°06'06" East, a distance of 10.34 feet to a point at the beginning of a non-tangent curve to the right

(CD 2)Adopt Attached Ordinance Vacating Niles City Boulevard to be Replatted with the Adjoining Property for a Multifamily Development, Swift
Lofts, Located in the Stockyards Form Based Code District
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating Niles City Boulevard to be replatted with the adjoining property for a multifamily development,Swift Lofts,
located in the Stockyards Form Based Code District,and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Hom and Associates,Inc.,on behalf of Fort Worth Heritage Development, LLC,has requested vacation of Niles City Boulevard to be
replatted with the adjoining property for a multifamily development located in the Stockyards Form Based Code District, Swift Lofts.The City Plan
Commission recommended approval of this request at its meeting on September 22,2021.An acceptable final plat(FP-22-008)has been
received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the street.
This project is located in COUNCIL DISTRICT 2.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
