Ordinance No. 20758-05-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $41,231.00, SUBJECT TO RECEIPT OF A MONETARY DONATION FROM THE FORT WORTH BOTANICAL SOCIETY, INC., FOR THE PURPOSE OF FUNDING ANNUAL SALARY AND BENEFITS OF A GARDENER FOR THE ROCK SPRINGS GARDEN IN THE FORT WORTH BOTANIC GARDEN; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEATING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of$41,231.00, subject to receipt of a monetary donation from the Fort Worth Botanical Society, Inc., for the purpose of funding annual salary and benefits of a gardener for the Rock Springs Garden in the Fort Worth Botanic Garden. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair the remaining portions, sections, or pails of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repeated. SECTION 4. This ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGAI,GY: Ty -r 'a ssistant City Attorney — ADOPTED AND EFFECTIVE: May 21,2013 Biographical Sketch of Victor Tinsley Victor Tinsley was born in 1897 in a house that still stands on Silver Creek Road west of what is now Loop 820. His father died when the oldest of the 5 boys was twelve years old, and after that each boy stayed home in rotation one year as it came his turn to run the farm so that his brothers could ride their horse or wagon, depending on the water level on the West Fork crossing, in to North Side High school. Victor attended and graduated from the University of Texas with a degree in Civil Engineering after an interruption while he served in the Army during WW 11. Hewas hired by Southwestern BeIlTelephone Co. and was transferred to Abilene, then Amarillo, back to Fort Worth where he met and married his wife, Cleyone, then to the company's Saint Louis headquarters then back to Fort Worth as Division Plant Superintendent where he remained until his retirement in 1963. He then obtained his real estate and insurance licenses which he sometimes let interfere with his gardening. He served on numerous City boards and commissions, as a precinct chairman, on the Board of the First Methodist Church and was President of the local Lions Club. He once bragged that he was the only man to ever be General Superintendent of both the First Methodist and White Settlement Baptist Sunday schools. After retirement he served as Texas President of the Telephone Pioneers of America,their nationwide retirement organization. Biographical Sketch of Cleyone Tinsley Cleyone Fort was raised in Silverton Texas where her father had a dry goods store and came to Fort Worth after graduating from Clarendon College to seek a teaching job. She was hired as a teacher at South Hi Mount Elementary in 1925 and met Victor and they married in 1927. Later that year they moved to St. Louis, returning to Fort Worth in 1933 where their sons Victor Jr. and John Fort were born. Cleyone was very active in the Fort Worth Garden Club, serving as its President and becoming the first Nationally Accredited flower show judge in the area. She stayed active in those organizations for the remainder of her life. Biographical Sketch of John Fort Tinsley John Fort Tinsley was born in Fort Worth in 1939 and attended Alice Carlson Benmenb][y, McLean Junior High and Paschal High 8choo|. Ulmn oVnmp|ebad his four years at the University of Texas with his BBA in accounting. He was hired at graduation by the national accounting firm Ernst and Ernst even though he sd|| had his military service in the Texas Air National Guard ahead of him. After his discharge from the oen/ice. E&E sent him tpthe Harvard Business School, where he was reportedly the youngest person they ever sent. When he returned honme, he became active civica||y, serving on the boards ofThe Fort Worth Botanical Society; Guardianship Services; The Child Study Canter Founda1ion, Caomota High School, the Fort Worth Club Outdoor Sports C|ub, and as president or chairman of Leadership Fort Worth, Forum Fort Worth, Family Services Associmhon, the. Metropolitan YMCA, The United Way, The Harvard Business School Club and other local entities. John |mvmU Fort Worth and declined promotions within the company that vxVu|d have resulted in his leaving Fort Worth. He said that the Fort Worth lifestyle was more important than prestige. He became a Partner in the Fort Worth office and nevertomhanotherjmb. retiring to enjoy life at age 55. In addition to his inherited love of gardening, John became a world traveler and it was difficult to name a country he had not visited. He also organized 10 day rafting trips down the Grand Canyon. John intended to live his life 10the fullest and he was successful. His last accomplishment just before he left us was earning his Master Gardener Certificate. Authorize acceptance of a donation from the John Tinsley Estate, via the Fort Worth Botanical Society, Inc., for the restoration of the rock springs garden area in the Fort Worth Botanic Garden at a value of $2,200,000.00; 2. Authorize the acceptance of a donation from the Fort Worth Botanical Society, Inc., in the amount of $41,231.00 for the purpose of funding the annual salary and benefits of a gardener; 3. Authorize the naming of the rock springs garden area at the Fort Worth Botanic Garden as the Victor and Cleyone Tinsley Rock Springs Garden; 4. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Special Trust Fund in the amount of$41,231.00 from available funds; 5. Authorize the waiver of fees with respect to city permits related to the restoration of the rock springs garden area; and 6. Find that the waiver of fees carries out the public purposes set forth herein and that there are sufficient controls to ensure that the public purposes are carried out. DISCUSSION: John Tinsley, who passed away in July of 2011, was a Fort Worth Botanical Society board member. Through his Last Will and Testament, Mr. Tinsley bequeathed approximately $3,200,000.00 to the Fort Worth Botanic Society, Inc. (FWBS)for the purpose of improving and maintaining the Botanic Garden. As a condition to receiving the gift, Mr. Tinsley expressed his desire for naming a building or garden in honor of his father and mother, Victor and Cleyone Tinsley. After discussion with the FWBS and Tinsley's surviving family, it was decided that the restoration and maintenance of the rock springs garden area in the Botanic Garden would be a suitable project for this purpose. Logname: 80ROCKSPRR.ESTORE Page] of 2 TheRWBS board hired James Toal to create o conceptual plan, paid for aaurvey of the area and hired Freese and Nichn|a, inc., to perform hydraulic engineering study. The FVVBG board voted to contract with Scott Tucker Construction Company to restore the rock springs garden area according to Toal's conceptual plan and the design by Sam Jones ufGS8SArchitects. The cost torestore the rock springs garden area will be approximately$2,200,000.00 with construction scheduled to begin in June of this year and completed in January 2014. The remaining portion of Mr. Tins|ey'e donation will be dedicated to the establishment of a maintenance endowment fund of approximately $1,000,000.00 for the rock springs area, which will be managed by the FVVB5. Interest from the maintenance endowment istnbedesignated to fund a Gardener position to maintain this area. Staff recommends that the City Council waive all city permitting fees associated with this project beoounethiap jeoivvi|\ significanUyenhonc* theoesthmtio appeal and visitor experience to the Botanic Garden. The City has sufficient controls in place through its permitting process 10 ensure that this public purpose is carried out. Pursuant to and in accordance with the policies and procedures adopted by the City Council in Resolution No. 725, as amended by Resolution No. 3253, Naming of City-owned Facilities and the City's Parks and Facility Naming Policy, Staff recommends that the rock springs garden area be named the Victor and Cleyone Tinsley Rock Springs Garden in honor of Mr, Tinsley's generous gift and outstanding contributions to the Botanic Garden. Once the restoration of the area is comp|eta, there will be @ plaque installed recognizing the area as the Victor and Cleyone Tinsley Rock Springs Garden. At its April 24, 2013 meeting, the Parks and Community Services Advisory Board concurred with Staffs recommendation to the City Council to proceed in the manner described above. The Parks and Community Services Department has determined that the request ha name the rock springs area inhonor Vf Victor and C|eyone Tinsley meets the requirements 0f the above-referenced City Council resolutions and the Parks Department's Park and Facility Naming Policy and recommends that the City Council name the area accordingly. The requesting party agrees to incur ail costs associated with the naming. The Fort Worth Botanic Garden is located in COUNCIL DISTRICT 7 and serves the entire city. ���......
