AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE STREET IMPROVEMENTS FUND, IN THE
AMOUNT OF$1,800,000.00,FROM AVAILABLE FUNDS,FOR THE PURPOSE OF
FUNDING THE VICKERY BOULEVARD RETAINING WALL PROJECT (CITY
PROJECT NO.102446);PROVIDING FOR A SEVERABILITY CLAUSE;MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Street
Improvements Fund in the amount of$1,800,000.00, from available funds, for the purpose of funding the
Vickery Boulevard Retaining Wall project(City Project No. 102446).
SECTION 2.
That should any portion,section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a contract with Fort Worth Civil Constructors, LLC in the amount of$1,459,328.30 for the construction of the Vickery
Boulevard Retaining Wall Project(City Project No. 102446);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements Fund in the
amount of$1,800,000.00 from available funds for the purpose of funding the Vickery Boulevard Retaining Wall Project(City Project No.
102446);
3. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the General Capital Projects Fund, by
increasing estimated receipts and appropriations in the Vickery Boulevard Retaining Wall Project(City Project No. 102446)in the amount of
$1,000,000.00 and decreasing estimated receipts and appropriations in the Contract Street Maintenance programmable project(City
Project No. P00020)by the same amount;and
4. Amend the Fiscal Years 2022-2026 Capital Improvement Program.
DISCUSSION:
The Fiscal Year 2021 Pay-Go Contract Street Maintenance Program groups various types of street maintenance into specific contract packages.
The recommended construction contract outlined in this Mayor and Council Communication(M&C)will provide construction of approximately 150
feet concrete retaining wall on Vickery Boulevard east of Micki Lynn Avenue under the Contract Street Maintenance Program(City Project No.
102446).
The proposed retaining wall is an extension of an existing retaining wall at Vickery Boulevard.The extension is proposed for protection against
recurring erosion in the area.
This contract was advertised for bid on March 17,2022 and March 24,2022 in the Fort Worth Star-Telegram.On April 21,2022,the following bids
were received:

Construction for this project is expected to start in summer 2022 and to be completed by winter 2022. Upon completion of the project there will be
no anticipated impact on the General Fund operating budget.
The funding for this project was not included in the Fiscal Years 2022-2026 Capital Improvement Program due to charges being incurred after the
CIP was adopted.The action in this Mayor and Council Communication will amend the Fiscal Years 2022-2026 Capital Improvement Program as
approved in connection with Ordinance 25073-09-2021.Funding is available in Transportation and Public Works Department's Street
Improvements Fund for the purpose of funding the Vickery Boulevard Retaining Wall project.
Approval of recommendation 3 would adjust appropriations between a programmable project and convert the Vickery Boulevard Retaining Wall
Project(City Project No. 102446)into a static capital project.This action is needed as future funding for the Vickery Boulevard Retaining Wall
project is anticipated from other funding sources and the scope of this project differs from that of the current programmable project.
MMBE OFFICE: Fort Worth Civil Constructors, LLC is in compliance with the City's Business Equity Ordinance by committing to 12%Business
Equity participation on this project.The City's Business Equity goal on this project is 12%.
The project is located in COUNCIL DISTRICT 3.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the UNSPECIFIED-ALL FUNDS project in the Street Improvements Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the Street
Improvements Fund for the Vickery Boulevard Retaining Wall project to support the approval of the above recommendations and execution of the
contract. Prior to an expenditure being incurred,the Transportation and Public Works department has the responsibility of verifying the availability
of funds.
