AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS CAPITAL PROJECTS FEDERAL FUND,
SUBJECT TO RECEIPT OF THE GRANT,IN THE AMOUNT UP TO$6,640,000.00,
AND BY $1,000,000.00 AS A TRANSFER FROM THE 2022 BOND PROGRAM
FUND TO SATISFY THE CITY'S LOCAL MATCH REQUIREMENTS, FOR A
GRAND TOTAL OF $7,640,000.00 FOR THE PURPOSE OF FUNDING THE
HERITAGE PARK; BUS 287 TO WEATHERFORD STREET PROJECT (CITY
PROJECT NO.104146);PROVIDING FOR A SEVERABILITY CLAUSE;MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2021-2022 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants
Capital Projects Federal Fund,subject to the receipt of the grant, in the amount up to$6,640,000.00,and by
$1,000,000.00 as a transfer from the 2022 Bond Program Fund to satisfy the City's local match requirements,
for a grand total of$7,640,000.00 for the purpose of funding the Heritage Park; BUS 287 to Weatherford
Street project(City Project No. 104146).
SECTION 2.
That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 25073-09-2021 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Weatherford Street Project,Adopt Appropriation Ordinances,and Amend the Fiscal Years 2022-2026 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution authorizing execution of an Advance Funding Agreement with the Texas Department of Transportation in the
amount of$10,127,631.00 with federal participation in the amount of$6,640,000.00,state participation in the amount of$1,712,631.00,and
local participation in the combined amount of$1,775,000.00(City$775,000.00 and County$1,000,000.00)for the Heritage Park; BUS 287
to Weatherford Street project(City Project No. 104146);
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund,
subject to receipt of the grant,in the amount up to$7,640,000.00(Federal$6,640,000.00 and Local$1,000,000.00)for the Heritage Park;
BUS 287 to Weatherford Street project(City Project No. 104146);
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects State Fund,
subject to receipt of the grant,in the amount up to$660,000.00(State$660,000.00)for the Heritage Park;BUS 287 to Weatherford Street
project(City Project No. 104146);and
4. Amend the Fiscal Years 2022-2026 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing execution of an Advance Funding Agreement
(AFA)with the Texas Department of Transportation(TxDOT)and authorize acceptance of federal grant funds and state funds in the amount of
$7,300,000.00 for construction of the Heritage Park; BUS 287 to Weatherford Street project.
Heritage Park and Paddock Park are located in Downtown Fort Worth on the northern edge of the Trinity River bluff where the City meets the Trinity
River. Improvements to the two parks and North Main Street is a key linkage opportunity that will implement a vision 50 years in the making.This
Heritage Park; BUS 287 to Weatherford Street project is integral to the future success of the overall project.
The Heritage Park; BUS 287 to Weatherford Street project includes elements for enhancing the safety of pedestrian and vehicular movements.
Improved pedestrian safety will be in the form of"bulb-outs"at the four intersections surrounding the Tarrant County Courthouse and traffic calming
on Belknap Street between Paddock Park and the Courthouse.Vehicular movement improvements will include modification of traffic signals and
roadway/lane alignments,removal of the bus counterflow lane on West Belknap Street,and enlarging the turning radius northbound around
Paddock Park on North Commerce Street.
Funding for the project includes local funds from Downtown Fort Worth Inc.and Tarrant County,federal funds and state funds.The City bears the
responsibility to pay for cost overruns.The table below summarizes funding for the project:

Funding for this project was not included in the FY2022-2026 Capital Improvement Program due to the approval for Congestion Mitigation and Air
Quality Improvement and Surface Transportation Block Grant funds.The action in this M&C will amend the FY2022-2026 Capital Improvement
Program as approved in connection with Ordinance 25073-09-2021.
Funding for the required local match will be from the 2022 Bond Program funds appropriated to the project in a separate M&C.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education:Texas
Department of Transportation
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds
will be available in the current capital budget,as appropriated, in the Grants Cap Projects Federal Fund and Grants Capital Projects State Fund.
The Transportation and Public Works Department and Finacial Management Services will be responsible for the collection and deposit of funds
due to the City. Prior to expenditure being incurred,the Transportation&Public Works Department has the responsibility to validate the availability
of funds.This is reimbursement grant.
